Lindley, Director of Community Services February 9, 1998 (City Council Meeting of February 18, 1998) SUBJECT: Consider Resolution No. 98 -_, Amending the FY 1997/98 Budget by Appropriating Funds from Assessment District 84 -2 ( Fund 210) for Landscape Maintenance Background The City Council is being asked to adopt the attached Resolution which authorizes additional Assessment District 84 -2 (AD 84 -2) Fund expenditures for landscaped maintenance. The City is in receipt of revenue from two developers equal to the amount of the proposed expenditure; therefore, there is not net impact on AD 84 -2. Colmer - Zone 11 The residential development project on Alyssas Court at Pecan Avenue included landscaped parkways (Attachment B). The City conducted a ballot in 1997 and received affirmative votes pertaining to the levy of future assessment for the property owners to maintain the landscaping in the parkways. Since an assessment cannot be collected until the City Council approves the FY 1998/99 Assessment District AD 84 -2 budget, the City has required the developer to maintain the landscaping through June 30, 1998. As is often provided, the developer was presented with the option of transferring maintenance responsibilities to the City prior to June 30, by issuing payment for the full cost of providing said services for the remaining months in the current fiscal year. The City is now in receipt of a check from Colmer in the amount of $550.00 which will cover the landscape maintenance costs (including utilities) that will be incurred over the next five months. As of February 1, 1998, the City has been maintaining the landscaped parkways on Pecan Avenue at Alyssas Court. California Community Builders (CCB) -Zone 10 The City Council took action in 1996 to transfer certain properties in the Mountain Meadows area from the master homeowner association to the City. There were two areas (Attachment C) that were held back until CCB performed specific remedial landscape work to bring the landscaping into conformance with the previously approved plans. Staff has been working with CCB over the C:\DOCS \COMSERV\LANDSCP.AGD 0000141 last 18 months to accomplish the work that was required. Since the necessary remedial work had yet to be completed, staff proposed that the developer pay the City the full amount associated with the work ($4,600). The $4,600 covers the costs associated with the required remedial work, as well as ongoing landscape maintenance (including utilities) through the end of the fiscal year (June 30, 1998). The City is in receipt of a check from CCB. The remedial work is now underway and will shortly be completed by Sunridge Landscape Maintenance Service, the City's landscape contractor. As of February 1, 1998, the City assumed responsibility for ongoing landscape maintenance for the aforementioned properties. The amount assessed property owners AD 84 -2, Zone 10, will need to be increased to cover the costs associated with the newly accepted areas with the adoption of the 1998/99 Assessment District budget. As stated above, maintenance fees from Colmer and CCB have been deposited into the AD 84 -2 Fund in the respective zones and it is proposed that the expenditures associated with landscape maintenance in the two identified areas will be charged against the AD 84 -2 Fund with a zero net effect. Recommendation (Roll Call Vote) Staff recommends that the City Council adopt Resolution No. 98- , amending the FY 1997/98 budget by appropriating additional funds from the Assessment District 84 -2 (210) for landscape maintenance. C ADOCSICOMSERV\LANDSCP.AGD o0oo9z RESOLUTION NUMBER 98- RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK AMENDING THE FY 97/98 BUDGET BY APPROPRIATING $5,150 FROM THE ASSESSMENT DISTRICT 84 -2 FUND (210) FOR EXPENSES RELATED TO LANDSCAPE MAINTENANCE. WFIEREAS, on June 18, 1997, the City Council adopted the Budget for Fiscal year 1997/98; WHEREAS, the City Council has previously agreed to accept the transfer of property from the Mountain Meadows Master Homeowners Association and Colmer Development and the associated landscape maintenance responsibilities; WHEREAS, the City is in receipt of additional Assessment District 84 -2 (210) revenue in the form of fees paid to cover landscape maintenance cost through the end of FY in the amount of $5,150.00; WHEREAS, staff has presented the Council with a report which requests the appropriation of Assessment District 84 -2 (210) funds in the amount of $5,150.00 for landscape maintenance costs associated with Shadyridge Slope area (Zone 10) and Pecan Avenue parkways at Alyssas Court (Zone 11); and WHEREAS, Exhibit "A" hereof describes said budget amendment and its resultant impacts to the budget line item(s); and, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES RESOLVE AS FOLLOWS: A budget amendment appropriating $5,150 to Assessment District 84 -2 as more particularly described in Exhibit "A" attached hereto is hereby approved; and, PASSED, APPROVED, AND ADOPTED this 18th day of February, 1998.
