Subject: Consider Resolution No. 98 - Confirming the Intent
of the City to Accept Certain Surplus State Highway
Right -of -Way Situated Within Tierra Rejada Road
Immediately West of the Route 23 Freeway
1. Carlsberg Development Company is in the process of
constructing off -site improvements along the arterial and
collector streets within and surrounding the property
encompassed by the Carlsberg Specific Plan. Those
construction efforts include street improvements on Tierra
Rejada Road.
2. It has been determined that a portion of the Tierra Rejada
Road right -of -way just west of the Route 23 freeway is
actually a part of the freeway (Caltrans) right -of -way.
3. In order to facilitate the construction and future
maintenance of the street improvements required to be
constructed within the right -of -way owned by Caltrans, it is
necessary to convey a portion of that freeway right -of -way
to the City.
4. On December 17, 1997, the City Council conceptually approved
this proposed relinquishment of surplus freeway right -of-
way.
DISCUSSION
A. Description
The location of that portion of Tierra Rejada Road to be
relinquished to the City is generally shown on the map
attached as Exhibit 1. The property in question is more
specifically described in Exhibit 'A' of the attached draft
resolution.

B. Resolution
The relinquishment process requires the City to adopt a
resolution stating its intent to accept the proposed
relinquishment. That "draft" resolution is attached.
C. Waiver of Notice Period
The attached draft resolution includes a waiver of the
ninety (90) day public notice period required by Section 73
of the Streets and Highways Code.
RECOMMENDATION
Staff recommends that the City Council adopt Resolution Number
98- confirming the intent of the City to accept certain
surplus State highway right -of -way situated within Tierra Rejada
Road immediately west of the Route 23 freeway.

RESOLUTION NO. 98
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MOORPARK, CALIFORNIA, CONFIRMING THE
INTENT OF THE CITY OF MOORPARK TO ACCEPT
CERTAIN SURPLUS STATE HIGHWAY RIGHT -OF -WAY
SITUATED WITHIN TIERRA REJADA ROAD
IMMEDIATELY WEST OF THE ROUTE 23 FREEWAY
WHEREAS, the conditions of approval for Tract 4974 require
the developer of that tract to construct certain street
improvements along and upon Tierra Rejada Road just west of the
Route 23 freeway; and,
WHEREAS, it has been determined that a portion of the street
affected by those proposed street improvements is actually
situated within the Route 23 freeway right -of -way owned by the
State of California; and,
WHEREAS, in order to better facilitate the construction and
future maintenance of those proposed street improvements, it is
necessary for the State of California [ CALTRANS] to convey to the
City of Moorpark [CITY], a portion of said Route 23 freeway
right -of -way situated within Tierra Rejada Road; and,
WHEREAS, on December 17, 1997, the City Council approved
this proposed relinquishment in concept; and,
WHEREAS, it is necessary for the CITY to confirm this intent
by adoption this resolution.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That the CITY hereby agrees to accept from
CALTRANS the conveyance of certain surplus freeway right -of -way
described in Exhibits 'A' & 'B' attached hereto and made a part
hereof.
SECTION 2. That the CITY does hereby waive the ninety (90)
day public notice period required by Section 73 of the Streets
and Highways Code.

LEGAL DESCRIPTION OF RELINQUISHMENT FROM
STATE OF CALIFORNIA TO THE CITY OF MOORPARK
Being a strip of land locally known as Tierra Rejada Road also being a portion of that certain
parcel of land described as Parcel 1A of the FINAL ORDER OF CONDEMNATION as recorded
May 22, 1969 in Book 3492, Page 234 of Official Records in the office of the County Recorder,
County of Ventura, State of California, described as follows.
Beginning at a point in the centerline of that certain strip of land, 60.00 feet wide, locally known
as Tierra Rejada Road (formerly known as Los Angeles Avenue) as described in deed recorded
in Book 26, Page 209 of Deeds in the office of the County Recorder of said County, distant
thereon North 51052'12" East 650.01 feet from the intersection of said centerline with the
centerline of that certain strip of land, 60.00 feet wide, locally known as Moorpark Road, as
described in the deed recorded in Book 40, Page 482 of Deeds in the office of the County
Recorder of said County; thence along the boundary of said deed recorded in Book 3492, Page
234 of Official Records the following 2 courses,
1 st. North 38 007'48" West 54.00 to an intersection with a line which is parallel with and distant
northwesterly, 54.00 feet, measured at right angles from said centerline of Tierra Rejada
Road; thence along said parallel line,
2nd. North 51 052'12" East 304.59 feet; thence at right angles to said boundary,
3rd. South 38 007'48" East 54.00 feet to an intersection to said centerline of Tierra Rejada
Road; thence along said centerline,
4th. South 51052'12" West 304.59 feet to the point of beginning.
EXCEPTING that portion of land lying within Tierra Rejada Road (formerly known as Los
Angeles Avenue) as conveyed to the County of Ventura, as a public road or highway, in deed
recorded December 3, 1888 in Book 26, Page 209 of Deeds.
