SUBJECT: Consider City's Role in
Oversight of Conditions at Mobilehome Parks

During public hearings conducted during 1997 and 1998 on proposed
revisions to the City's Mobilehome Park Rent Stabilization
Ordinance, residents have testified about conditions at the
City's mobilehome parks. These conditions were reported by
residents on May 28, 1997, to be unsanitary and possibly unsafe.
Staff was directed to investigate the City's jurisdiction
regarding possible code violations, and to investigate resident
claims of improper charges relating to water and gas usage and
improper space rent increases.
On June 4, 1997, staff reported to Council of its investigation
of these matters. Residents who had testified were contacted to
ensure they were aware of the jurisdiction of the State of
California Department of Housing and Community Development (HCD)
in matters pertaining to health and safety within mobilehome
parks, and to ensure that residents had the phone number of the
Office of the Mobilehome Ombudsman. (Staff reported on August
20, 1997, on the other related topics of concern to mobilehome
residents.)
Discussion
Due to ongoing resident concerns regarding conditions at Moorpark
Mobilehome Park and testimony to Council as recent as February 4,
1998, staff was directed to investigate further the matter of the
City's jurisdiction over physical conditions at mobilehome parks.

Section 18400 of the State's Mobilehome Parks Act authorizes HCD
to inspect mobilehome parks once every seven years, issue notices
of violations, where necessary, and initiate enforcement
proceedings to ensure health, safety, general welfare, a decent
living environment, and the protection of investments in
mobilehomes. Inspections of both the City's mobilehome parks
will be completed by December 31, 1998.
Although the City's authority to enforce health and safety codes
does not extend into mobilehome parks, as a matter of expediency
and service to residents, the City Building Inspector has
accompanied Ventura County Fire Personnel on inspection or
complaint calls from Villa del Arroyo Mobilehome Park and has
responded to calls about sewer problems at Moorpark Mobilehome
Park.
The Building Inspector's investigation of complaints of sewer
problems at Moorpark Mobilehome Park, with the assistance of the
City's Code Enforcement Officer on at least one occasion, has led
to contacting HCD. In March 1997 sewer waste was found flowing
over open ground. The Code Enforcement Officer provided written
notice to both the tenant and the park manager to begin
sanitizing the area and the Building Inspector notified HCD. The
Building Inspector accompanied HCD's Housing Inspector to the
site of the sewage spill approximately three days later. At that
time, the area was found to be clean and sanitized and the
plumbing system appeared to be working.
In early February 1998, electrical work was observed in process
at Moorpark Mobilehome Park. The Building Inspector notified the
park manager to obtain any required permits and inspections from
HCD. Notification was also provided to HCD for investigation and
follow up.
