Gilbert, Director of Public Works��/ DATE: March 9, 1998 (CC Meeting: 3- 18 -98) SUBJECT: Consider Resolution No. 98- Amending the FY 1997/98 Budget to Provide Funds for the City's Share of Certain Costs Related to the Development of the Calleguas Creek Watershed Management Plan On March 4, 1998, the City Council considered this request for City participation in certain costs being shared by a number of public agencies, related to the development of the Calleguas Creek Watershed Management Plan. That report failed to recommend a funding source or request an appropriation for the requested funds, and the matter was continued. Attached to this report is a draft Resolution recommending approval of a budget amendment funding these costs ($2,5601 from the General Fund Reserve. Discussion A. History In recent years the Ventura County Flood Control District (VCFCD) has guided efforts related to the development and implementation of a Master Plan for the Calleguas Creek Watershed. Initial efforts involved a series of meetings between all of the various stakeholders which would or could be affected by such a plan. These stakeholders not only included public agencies (cities, sanitary districts, etc.), but also included a large number of private interests (agricultural industry, environmental advocacy groups, etc). The mission of that group was to identify perceived problems and potential solutions. The group completed its task with the formulation of a set of goals and objectives -- the most important of which was the need to proceed with the development and implementation of a Watershed Management Plan. In more recent months, a number of public and private entities, led by the Supervisor Mikels' Office, have initiated efforts necessary to formulate this Management Plan. vtshed2 OOC!." -OZ Watershed Master Plan March 18, 1998 Page 2 B. Request Attached as Exhibit i is a letter from Supervisor Mikels to Mayor Hunter, dated November 14, 1997, requesting that the City of Moorpark share in the cost of retaining a consultant to manage the efforts necessary to prepare the Calleguas Creek Watershed Management Plan. The requested City's share of these costs is $2,500. C. Justification for City Participation City staff has expressed some concerns to staff members of the VCFCD, as well as to Supervisor Mikels' office, regarding the equity of the City of Moorpark's participation in these costs, and/or the City's participation to the same degree as other agencies. Those concerns are, to some degree, addressed as follows: 1. Public / Private -- Why not require some of the private sector stakeholders to participate in these costs? Although Phase I funding is coming from the public sector entities listed below, it is the intent of Supervisor Mikels' Office to seek and obtain funding for a portion of Phase 2 costs from a number of private sector stakeholders. 2. Publicly -Owned Treatment Works [POTWsj -- The other three cities in the watershed (Camarillo, Thousand Oaks and Simi Valley) own sewer treatment facilities. It would appear, therefore, that those cities should pay a higher share of the requested costs. The City of Camarillo, the City of Simi Valley, the City of Thousand Oaks, Waterworks District No. 1, Camrosa Water District, Calleguas Municipal Water District and others, have and are already participating in the cost of a several hundred thousand dollar "Characterization Study." This study will play an important role in the overall Watershed Management Plan. The subject request for funding from the four cities is based on other factors, as explained below. 3. Economic Development -- Can you name any other benefits to justify City participation in these costs? When completed, the Calleguas Creek Watershed Management Plan will be a valuable tool which will be used by both the public sector policy makers as well as the private sector business community. It will have a number of useful applications and benefits and will provide answers to a number of now unresolved questions regarding land use, development, resources and regulations. As such it will remove certain obstacles and /or provide certain incentives for economic development within the cities in the watershed. wtshed2 0 0�.,0 Watershed Master Plan March 18, 1938 Page 3 4. participation by Others -- Who else is participating in these costs and to what degree? Some or all of the funding for this effort is described as follows: • Reg. Water (duality Control Board • Coastal Conservancy • County of Ventura (including, County, VCFCD & WWD No. 1) • Private Sector Stakeholders • Four Cities Simi Valley Thousand Oaks - Camarillo Moorpark Total D. It has been requested that the City share of these costs be forwarded to that agency. E. Phase 2 Efforts The City Council is advised that the requested funds are for Phase 1 of the program and that there may be one or more future requests for Phase 2 funding. F. Funding Source When completed, the Calleguas Creek Watershed Management Plan will be a resource which will benefit a great number of stakeholders in both the public and private sectors, by providing a comprehensive analysis of the watershed, its resources and limitations, as well as mechanisms designed to preserve and protect those resources. In Moorpark this document will be used as a resource in the formulation of both broad policies and site specific decisions in the areas of land use planning, land development and economic development. For these reasons, it is recommended that the subject costs be funded by the General Fund. In that the Public Works Director has been and will be the City's contact person regarding these efforts, it is recommended that these expenses be charged to the to Department 800: Public Works Administration. wtahed2 o0o' ®,I' Watershed Master Plan March 18, 1998 Page 4 RECOMMENDATION (Roll Call Vote) Staff recommends that City Council take the following actions: Approve City funding, in the amount of $2,500, for the City's share of consultant costs related to the development of the Calleguas Creek Management Plan. 2. Direct staff to forward a check in said amount to the lead agency for this project -- the Calleguas Municipal Water District -- to be placed into a special account [Account # 70111 established for this project. 3. Adopt the Resolution No. 98 -_ appropriating funds in said amount from the General Fund and amending the FY 1997/98 Budget for Department 800 -- Public Works Administration, to show said expenditure. vtshed2 () 0Q I., 7L () . RESOLUTION NO. 98 - xxxx A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING THE FISCAL YEAR 1997/98 BUDGET TO PROVIDE FUNDING FOR THE DEVELOPMENT OF THE CALLEGUAS CREEK WATERSHED MANAGEMENT PLAN [FUND 1001 WHEREAS, on June 18, 1997, the City Council adopted the Budget for Fiscal Year 1997/98; and, WHEREAS, a staff report has been presented to the City Council requesting an amendment to the budget to fund certain additional unforseen costs; and, WHEREAS, Exhibit "A," attached hereto and made a part hereof, describes said budget amendment and its resultant impacts to the budget line item(s). NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That a Budget amendment for an aggregate increased amount of $2,500, as more particularly described in Exhibit "A," is hereby approved. PASSED AND ADOPTED this 18th day of March, 1998.
