SUBJECT: CONSIDER IF CITY SHOULD PREPARE A BALLOT MEASURE PERTAINING
TO CONTROL OF CITY BOUNDARIES AND OPEN SPACE AND AGRICULTURAL
PROPERTIES
Background
On March 10, 1998, the City received a Request for Ballot Title and
Summary and Notice of Intention to Circulate Petition, and written text
of a proposed Initiative measure referred to as the Moorpark Save Open -
Space and Agricultural Resources (SOAR) Initiative. A Notice of
Intention and the Title and Summary of the proposed measure was
published by the proponents on April 2, 1998, in the Moorpark Star, and
a petition is now being circulated to the voters of the City for
signature.
Section 9212 of the Elections Code states that the legislative body may
refer the proposed initiative measure to any city agency or agencies for
a report on any or all of the following:
1) Its fiscal impact.
2) Its effect on the internal consistency of the City's general and
specific plans, including the housing element, the consistency
between planning and zoning, the limitations on city actions under
Section 65008 of the Government Code pertaining to discrimination,
and Chapter 4.2 of the Government Code (commencing with Section
65913) pertaining to affordable housing development approvals, and
Chapter 4.3 of the Government Code (commencing with Section 65915)
pertaining to density bonuses.
3) Any other matters the Council requests to be in the report.
The Elections Code also states that the report may be requested during
the circulation of the petition, or before taking action to submit the
ordinance to the voters for a special or next regular municipal
election, or adoption of the ordinance.

Discussion
The report to the legislative body, referenced above, is to be completed
within the time prescribed by the legislative body but no later than 30
days after the elections official certifies to the legislative body the
sufficiency of the petition for the initiative.
A related matter, that Councilmember Evans has requested that the City
Council consider, is whether the City should prepare a competing ballot
measure pertaining to control of City boundaries and open space and
agricultural properties. The scope of such a measure could be
determined in conjunction with review of the report referenced in the
background section of this report.
It is important to note that the current County of Ventura elections
calendar identifies that for the election on November 3, 1998, all
measures need to be filed with the County Elections office by June 24,
1998, to allow for forwarding to the Board of Supervisors.
