SUBJECT: Consider Revisions to Contract for Engineering
Services
OVERVIEW
This presents a request for an increase in the rates to be
charged for Engineering Services.
DISCUSSION
A. Background: In March of 1991 the City entered into an
Agreement for City Engineering Services with Charles
Abbott Associates.
B. Retainer
1. Agreement: Paragraphs A & B of Section I of the
Agreement provide for an automatic adjustment (not to
exceed 7 %) to the retainer for City Engineer and
Traffic Engineering Services, to occur each November 1
based upon the change in the Consumer Price Index.
2. Last Adjustment: The last time the amounts of the
Retainers were adjusted was in November of 1995. That
adjustment was based upon a prior increase in the CPI
for the period ending August 1995.
3. Prior Consideration: In October of 1996 the City
received a request from the consultant City Engineer
for an adjustment to the retainer amount as well as the
rates for engineering services. That request was
denied due to the fact that staff and the consultant
were in the process of reviewing a number of program
costs and alternatives.
4. Reconsideration: The above mentioned review did not
produce any recommended changes to the scope or method
of the delivery of City Engineering Services. It is
appropriate, therefore, for the City Council to
consider a more recent request from the City Engineer
for an adjustment to both the retainers and the rates
for engineering services.

5. CPI Increase: There has been a 5.2% increase in the
CPI [ "U. S. City Average for All Urban Consumers All
Items Indexes "] during the period between August 1995
and August 1997. Using this 5.2% inflation factor,
changes to the existing amounts for the Engineering
retainers are summarized as follows:

6. No Action Required: As stated above, no action is
required by the City Council to implement this change
to the amount of the retainers.
7. Effective Date: Absent specific action to disapprove
the above described "automatic" increase to the
Engineering retainers, the above increase will become
effective on May 1, 1998.
C. Request for Adjustment to Rates for Services
1. Agreement: The Agreement for Engineering Services also
states that the City may consider a request for a Cost -
of- Living Adjustment to the hourly rates charged for
Engineering Services. Such an adjustment, if made, is
normally effective November 1 of each year, based on a
request which received by September 15 of that year.
2. Last Adjustment: Like the retainers, the last time the
rates for services were adjusted was in November of
1995. That adjustment too was based upon a prior
increase in the CPI for the period ending August 1995.
3. Request for Increase: Attached as Exhibit 1 is a
request (3- 23 -98) for an increase in the rates for
engineering services. As discussed above, although
this matter was considered and denied in October of
1996, the conditions have now changed and it is now
appropriate to consider the request.
4. Revised Rates: Using the 5.2% increase in the CPI
discussed above, the adjusted rates for services are
set forth in the request attached as Exhibit 1.

7. Effective Date: The proposed effective date for this
change to the rates for engineering services is May 1,
1998.
RECOMMENDATION
Staff recommends that the City Council approve a 5.2%
increase in the rates for Engineering Services to be made
effective May 1, 1998.

As outlined by provisions in our contract for Engineering Services to the City of Moorpark
dated March 1, 1991, we will be moderately increasing our retainer fees and fee rates to keep
pace with current consumer trends. The proposed increase will be 5.2% as dictated by our
current agreement and the Consumer Price Index for the period August 1995 through August
1997 and will take effect May 1, 1998. The increase covers a two year period because the
City did not allow an adjustment for 1997.
Attached is an itemization of the contract categories showing the related fees and hourly rates
which will be changing.
We look forward to being of service to the community of Moorpark in the coming year and I
would be happy to answer any questions you might have concerning these increases.
