Gilbert, Director of Public Works VI DATE: April 23, 1998 (Council Meeting 5 -6 -98) SUBJECT: Consider Resolution No. 98- Approving the Program Supplement No. M002 to City / State Agreement No. 07 -5436 Related to the Reconstruction of the Spring Road Bridge Background On January 7, 1998, the City Council authorized staff to advertise for receipt of bids for the reconstruction of the Spring Road bridge. The bid opening date is set for May 14, 1998. It is anticipated that the bid results will be presented to the City Council on May 20, 1998. Discussion A. HBRR Funding This project is partially funded by a federal HBRR grant for the "theoretical" widening of the bridge. Caltrans has allowed these grant monies to be applied to the City's bridge replacement project. The amount of the grant is based upon an estimated bridge widening cost of $506,000. The federal share of that estimated cost is $404,800. B. FNM -76 The City has received from Caltrans the FNM -76 form authorizing the City to proceed with the project. C. Program Supplement On April 23, 1998, the City received Program Supplement Agreement No. M002 to City / State Agreement No. 07 -5436, pertaining to these grant funds. spgbrg2 () ®e'13: Spring Road Bridge Replacement Program Supplement Agreement May 6, 1998 Page 2 D. Resolution Caltrans requires that the city Council adopt a resolution authorizing execution of this Supplement Agreement. RECOMMENDATION Staff recommends that the City Council adopt the attached Resolution approving the subject Supplemental Agreement and authorizing the Mayor to execute said document on behalf of the City Council. spgbrg2 00012% f d PROGRAM aallPPLEMNT NO. Number : 07- 931004 This Program Supplement is hereby incorporated into the Agency -State Agreement for Federal Aid which was entered into between the Agency and the State on 03/01/96 and is subject to all the terms and conditions thereof. This Program Supplement is adopted in accordance with Article I of the aforementioned Master Agreement under authority of Resolution No. , approved by the Agency on (See copy attached). The Agency further stipulates that as a condition to payment of funds obligated to this project, it accepts and will comply with the covenants or remarks setforth on the following pages. All maintenance, involving the physical condition and the operation of the improvements, referred to in Article III MAINTENANCE of the aforementioned Master Agreement will be the responsibility of the Local Agency and shall be performed at regular intervals or as required for efficient operation of the completed improvements. 2. The Local Agency will advertise, award and administer this project in accordance with the current Local Program Procedures or the new Local Programs Manual, when issued. 3. The Local Agency will furnish a qualified Resident Engineer for the contract. 4. The Local Agency will reimburse the State for their share of costs for work requested to be performed by the State. . 5. The Local Agency agrees the payment of Federal funds will be limited to the amounts approved by the Federal Highway Administration in the Federal -Aid Project Agreement (PR -2) /Detail Estimate, or its modification (PR -2A) or the FNM -76, and accepts any increases in Local Agency Funds as shown on the Finance or Bid Letter or its modification as prepared by the Office of Local Programs Project Implementation. 6. The City has elected to replace this bridge instead of rehabilitating it. Federal participation costs are limited to the funding amount initially approved for eligible rehabilitation work on November 22, 1993. This total eligible amount is $506,000 and the maximum Federal reimbursement is $404,800. 7. Whenever the local agency uses a consultant on a cost plus basis, the local agency is required to submit a post audit report covering the allowability of cost payments for each individual consultant or sub- contractor incurring over $25,000 on the project. The audit report must state the applicable cost principles utilized by the auditor in determining allowable costs as referenced in CFR 49, part 18, Subpart C - 22, Allowable Costs. Program Supplement 07- 5436 -M002- ISTEA Page 2 of 2 RESOLUTION NO. 98 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, APPROVING A SUPPLEMENTAL AGREEMENT BETWEEN THE CITY OF MOORPARK AND THE STATE OF CALIFORNIA DEPARTMENT OF TRANSPORTATION PERTAINING TO THE SPRING ROAD BRIDGE REPLACEMENT PROJECT [BHLS- 5436(003); EA NO. 07- 931004] WHEREAS, the City has applied for and has received approval of an HBRR grant, for partial funding of a project for the reconstruction of the Spring Road Bridge; and, WHEREAS, it is necessary and appropriate to document the receipt of said grant funding through the execution of a Supplemental Agreement to City / State Agreement pertaining to Federal -Aid Projects. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That Program Supplement No. M002 to Agreement No. 07 - 5436 is hereby approved. SECTION 2. That the Mayor of the City of Moorpark is hereby authorized to execute said Program Supplement on behalf of the City. PASSED AND ADOPTED this 6th day of May, 1998.
