REORGANIZATION: ANNEXATION OF 56.84 ACRES (PARCEL A) OF LAND TO THE CITY OF MOORPARK AND DETACHMENT OF 56.84 ACRES FROM THE VENTURA COUNTY RESOURCE CONSERVATION DISTRICT - PROPERTY LOCATED AT THE EAST END OF LOS ANGELES AVENUE AND HIGHWAY 23 SOUTH OF THE RAILROAD TRACKS; (PARCEL "A" ONLY) IS LOCATED SOUTH OF THE EXISTING CITY LIMITS BACKGROUND: The Local Agency Formation Commission (LAFCO) ON April 15, 1998, approved a change in the Sphere of Influence of the City of Moorpark to enlarge the City boundary by approximately 57 acres to allow the Special Devices, Inc.(SDI) Annexation. Additionally LAFCO approved an annexation request from SDI (Proponent) as LAFCO 97 -13 Special. Devices Reorganization approving the annexing of 56.84 acres of land to the City and allowing expansion of the Ventura County Waterworks District No. 1 by 293.3 acres to provide water and sewer service to the SDI industrial project currently under construction (Refer to attached map). LAFCO also approved a detachment of the 56.84 acres from the Ventura County Resource Conservation District which deals with soils and mining issues in unincorporated areas of the County. The annexation (Reorganization) proceedings were approved by LAFCO Resolution - LAFCO 97 -13. There were no conditions required by LAFCO to complete the annexation. This proceeding to adopt a resolution approving this annexation is being conducted by the City of Moorpark as a public hearing because C.IIml98waynelSDIANNEX- srptwpdII12May98 //11:13 AM 006004 Honorable City Council Subject: SDI Annexation May 6, 1998 Page 2 there is not a 100% consent to annex based upon land ownership. Some of the affected property remains in the ownership of the State of California according to County Assessor records although transfer to SDI ownership was approved several years ago. This is an uninhabited annexation. No one spoke in favor or against the expansion of the City boundary or the Reorganization request (annexation and detachment) to the City, the Waterworks District or the Resource Conservation District. The approving vote by LAFCO was unanimous. Discussion: These proceedings (Petition for annexation to LAFCO) were a condition of approval of the SDI project. Pre - zoning of the 56.84 acres to OS -40 (Open Space -40 acre lot size) was approved as part of overall SDI project approval in 1996 and will become effective when this land is annexed to the City. There is also a permanent conservation easement that has been approved for this area which along with the open space zoning will serve to maintain the annexed area in a permanent open space condition. Approval of this annexation will result in the subject property (56.84 acres) becoming part of the City of Moorpark and governed for any services, zoning etc. by the City, (except sewer, water, and fire), however, the open space designation on this newly annexed land should not result in additional costs. The 293.3 acres, which include the 56.84 acre parcel to be added to the City and the existing SDI ownership, some of which is under development will be added to the Ventura County Waterworks District No. 1 which will allow water and sewer services to be delivered to the property. The Board of Supervisors sitting as the Board of Directors for the District took action on May 5, 1998 to annex this property to the Waterworks District No. 1. The filing fee payable to the State of California is $750.00. TIERRA ("005 RESOLUTION NO. 98- RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK APPROVING AND ORDERING THE SPECIAL DEVICES INCORPORATED REORGANIZATION: ANNEXATION TO THE CITY OF MOORPARK /DETACHMENT FROM THE VENTURA COUNTY RESOURCE CONSERVATION DISTRICT (ANNEXATION NO. 97 -13) Whereas, on April 15, 1998, the Ventura Local Agency Formation Commission approved the above referenced proposal, assigned the short -form designation LAFCO - 97 -13 Special Devices, Inc. Reorganization, and authorized the City of Moorpark to reorganize the affected territory; and Whereas, the territory within the proposal area is uninhabited; and Whereas, a public hearing on this Reorganization was held on May 20, 1998, and this Council finds that the assessed value of land represented by written protests filed and not withdrawn is less than fifty (50 %) percent of the total assessed value of land within the affected territory. NOW, THEREFORE, the City Council of the City of Moorpark does hereby resolve as follows: 1. The reorganization of the territory described in Exhibit "A," attached hereto and made a part hereof, is hereby approved and ordered without election. 2. This action is being taken pursuant to the Cortese /Knox Local Government Reorganization Act of 1985, commencing with Section 56000 of the California Government Code. 3. This proposal is a reorganization and includes all of the following changes of organization: A. Annexation to the City of Moorpark B. The detachment from the Ventura County Resource Conservation District. 4. The reasons for the proposal are to provide various municipal services and to implement the "Guidelines for Orderly Development." 6. The regular County assessment roll will be utilized. 7. The City Clerk is directed to provide five (5) certified copies of this Resolution to the Community Development Department for transmittal to the Ventura Local Agency Formation Commission. Whereas LAFCO found that not all property owners have given consent, the City of Moorpark is designed as conducting authority and is hereby authorized to conduct the required notice of hearing and election. WHEREAS, the above - referenced proposal has been filed with the Executive Officer of the Ventura Local Agency Formation Commission pursuant to the Cortese /Knox Local Government Reorganization Act (Section 56000 of the California Government Code); and WHEREAS, at the times and in the manner required by law the Executive Officer has given notice of the public hearing by the Commission on the proposal; and WHEREAS, the proposal was duly considered on April 15, 1998 as specified in the notice of hearing; and WHEREAS, the Commission heard, discussed and considered all oral and written testimony for and against the proposal including, but not limited to, the Executive Officer's report and recommendation, the environmental document or determination, Spheres of Influence and applicable General and Specific Plans; and WHEREAS, the Local Agency Formation Commission finds the proposal to be in the best interests of the affected area and the total organization of local governmental agencies within Ventura County; NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED by the Local Agency Formation Commission of Ventura County as follows: (1) The Executive Officer's Staff Report and Recommendation for approval of the proposal is adopted. (7) The commission has reviewed and considered the information contained in the Environmental Impact Reports and adopts the lead agency's findings of impact, mitigation measures, and statement of overriding considerations and makes a specific determination that the significant issues and proposed mitigation measures as adopted by the lead agency adequately address the project. [Sections 15091, 15093, and 15096(h)] (8) Commission directs Staff to file a Notice of Determination in the same manner as a lead agency under Section 15075, stating that the Commission has considered the Environmental Impact Reports and Statements of Overriding Considerations as prepared by the Lead Agency [Section 15096 (1)].
