Nowak, Assistant City Manager DATE: 11 May 1998 (Council meeting of 05- 20 -98) SUBJECT: Discussion on the Relocation of the Police Resource Center Discussion: The City is being required to relocate the Police Resource Center from its current location in the Moorpark Town Center no later than June 1, 1998. The office area immediately adjacent to the site has been offered for rent at the rate of $1.00 per square foot (1,200 square feet) fixed for a three year period. Staff had solicited and received bids for the cost of tenant improvements at the adjacent location. The initial bid was for $33,400: New bids were sought based on a revised space layout. Two bids were received for $25,000 and for $16,500. The City Council approved $20,000 for the work on April 1, 1998. Subsequent to taking bids, the City's Police Captain talked to the School District Superintendent about the lease of some vacant modular units at the District's administrative offices on Flory Avenue. The units total 4,100 square feet. The Captain proposes to locate the detective and other administrative functions from the East Valley Sheriffs Station to this location. in order to use the district site for police use, the City Council would need to assure that the lease agreement is clear that the action does not in any manner change or affect the zoning or use of the District's property. The relocation of operations to the Flory Avenue site will require over $30,000 in tenant improvements and related items. Rent is proposed to be for free for the first year then increase to $16,800 in the second year and $21,600 in the third year (staff has received no confimiation from the Superintendent regarding these figures). It continues to increase by $4,800 per year and could be anticipated to do so beyond the five -year projection. With a larger space and heavier usage than the Resource Center, utility costs would substantially increase. The School District would pay for electrical expenses in the first year only, contrary to prior reports, and the additional telephone costs would have to be picked up. Also, additional signage would be required since the location is not on a major commercial street, a high priority concern to the Council in the past. Not included in these costs are the expense for the possible storage of the Resource Center furnishings and the possible cost of closing the Resource Center operations for a period of time. The Council needs to consider what the function of a Resource Center is: In the attached excerpt from June 1994 Council minutes, it was stated that a storefront activity readily accessible to the public was the basis for having a resource center. Another issue for the,C►ouncil to consider is the long term location issue. A space needs study is currently underway which will help determine the City's long -term space needs for public safety will be, and identify the amount of land required for such a facility. The Council should consider whether it is desirable to move the operations now, only to have to move them again in a few years. The Flory Avenue site would not be consistent with the Council's stated desire to have the Police Resource Center located downtown and on a major street, and also accessible to the High Street area where it was once located. Also, this would be the location for police services until such time as the City is able to fund a new building. The current Sheriffs Facilities Fees being collected will not be sufficient to fund a new facility based on current projected build -out. Attached is a report prepared in -- on the police facilities fees and a projection of fees to be collected at current rates on projects now under consideration. If the Council considers the location of police activities to the Flory Avenue site, it may also want to consider relocating some city hall activities to the building to alleviate the overcrowding conditions being experiences. As proposed, sheriff employees would have over double the square footage per employee as currently exists in City Hall.' Attached are cost estimates comparing the current resource center location and the proposed police service center for the next five years. These are based on figures provided by Captain Lewis, but use the recommended FY 1998 -99 budget as a base and include 4% annual inflation for future costs, which have been common in the past. Captain Lewis indicates that there would be an initial $16,700 savings in overhead costs and an initial annual savings of $11,000 per year in mileage. The amount of mileage savings is only speculative and actual savings are not known. No other overhead savings would be realized until the patrol unit is relocated from the East Valley Station according to Captain Lewis. The attached cost estimates also show that is the cost savings do not materialize, the proposed Flory Avenue site would cost over $136,000 more than the Resource Center location ($323,596 to $186,844). There are still a number of uncertainties for Council's consideration associated with the use of the District buildings on Flory Avenue including land use impact, terms of a lease and rent rates at market value, the increased General Fund expenditures that result in future years, and a preference to have the Resource Center located downtown on a major street. Recommendation: That the City Council direct staff as deemed appropriate. At the same rate ($1.15 per square foo CAA would be paying $1,725 a month, less $138 for the area utilized by the Sheriff's Department for a total of $1,587. Staff's opinion is that the existing rent that CAA is paying at the Poindexter facility, that being $1.15 per square foot, would be a reasonable rent for the 18 High Street facility. Further, staff suggests that if the Agency is to consider the proposal by CAA, that during the contract negotiation process, that additional bids be solicited by CAA in an attempt to lower the costs for the improvements that are listed above, thus providing a savings to the Agency. As stated above., Councilmember Patrick Hunter suggested that this facility be occupied jointly by CAA and the Sheriff's Department as a storefront police office. The main office for the contractual Sheriff's Service would remain at the East Valley Sheriff's Station. The primary reasons for his proposal are: 1) it is a generally accepted concept in law enforcement that maintaining a high police visibility is the greatest deterrent to crime and violence and; 2) there is no reason to believe that this will not be true for the immediate area and the entire community of Moorpark, if 18 High Street were to be utilized for a storefront police facility. The potential advantages of the Sheriff's Department being located at this site are as follows: 1. The facility will afford a higher level of citizen ✓ involvement in furtherance of the community based policing concept, especially for the High Street and surrounding areas (for both commercial and residential areas). 2. It has been found that the perception of safety is as important as the level of crime itself and this facility will add to this perception. When people feel an area* is safe they will be more likely to frequent the.area, use the public facilities and shop there. (l 3. AGENDA REPORT .TO: I lonorable City Council y� _ U � FROM: Richard Hare, Deputy City Manage 6 DATE: March 17, 1995 (CC Meeting 4/5 95) SUBJECT: Consider Ordinance No.-2& ,, Making Revisions to Ordinance No. 9 Regarding the Imposition of Building Permit Fees to Provide Police Facilities The City Council on 3/15/95 set a public hearing for April 5, 1995 to consider the amendment of Ordinance No. 9 and the adoption by resolution of increased building permit fees for the future construction of a police station. Ordinance No. 9, which authorized the imposition of fees to fund a future police facility, was originally adopted in 1984 and the calculation of fees enacted by this ordinance were developed by Ventura County in July 1983 and have not been updated since. The language of Ordinance No. 9 was also copied from the county and does not reflect City references. The staff has proposed technical amendment of the language to be consistent with the City's nomenclature. Other than these technical amendments, the basic concepts, formulas and authorities of Ordinance No. 9 remain the same. At the meeting of 3/15/95, Councilmember Hunter inquired about the exclusion of custodial facilities from the calculation of construction costs. The original county ordinance and the current City ordinance omit the cost for construction of 6,450 square feet of custodial (jail or detention) facilities. Staff has researched this exclusion but has not been able to determine the reason for the exclusion. It is surmised that the county anticipated the jail function would be a centralized function at a central location. It is the opinion of the Moorpark Police Department and staff that custodial facilities will be required in the future police station. At issue is whether or not the cost or a portion of the cost for the construction of custodial facilities should be included in the proposed police facilities fees. At this time they are excluded in the ordinance and resolution. The attached resolution updates the building permit fees imposed by this ordinance. The values described in Ordinance No. 9 are specified, as they relate to the City of Moorpark in the year 2010, which is projected to be when it will be necessary to construct a police station for the City. Ventura County established the cost of constructing a 28,400 square foot (sf) police facility minus the cost of 6,450 sf of custodial space, but including land acquisition, site preparation and landscaping cost to be $4,816,413. The current fees as applied to all new construction are as follows: updated 3/17/95 pdfacfee.ipt 00072 Current Police Facilities Fees Single family dwelling: $83.58 times the total number of dwelling units Multi - family dwelling: $54.16 times the total number of dwelling units Mobile home: $55.54 times the total number of dwelling units Non - residential: $ .05 per square foot These fees have not been adjusted to reflect the increase in construction costs since the adoption of the fees. Staff has not been able to obtain the original calculations of costs made by the county in 1983. A new engineering study would merely increase the costs and decrease the funds available to fund a police station. Absent the actual architectural, landscape and site design along with an engineer's estimate of the cost to purchase the property and construct a police facility, staff is recommending the use of an index annually to adjust the construction cost of a police station. As a comparison, the Fire Facility Fees as amended in 1992 for a less costly structure illustrate that the present fees require adjustment. The County fees are: Fire Facility Fees Single family dwelling: $232.15 times the total number of dwelling units Multi- family dwelling: $170.95 times the total number of dwelling units Mobile home: $139.07 times the total number of dwelling units Non - residential: $ .11 per square foot Mean's Square Foot Costs 1995, which is a standard construction industry reference, was used to compare the average per square foot construction costs and percentage change from 1983. The index in 1983 for Santa Barbara which is the closest referenced city was 88.8. The January 1995 index is 119.1. There has therefore been an increase of 134 percent. Staff also reviewed the index for Riverside which was 152 percent, but has selected the Santa Barbara index because of the similar characteristics to the Moorpark region. Applying the indexed increase (134 %) to the construction cost calculated and adopted by the county in 1983 results in a new cost of $6,454,000. When combined with the projected 34,000 population of the City in 2010, (which does not include SP8 Messenger) and the expected construction of 9,989,000 square feet of non - residential construction, the following new fees are recommended: (Preceding figures were rounded to nearest 1,000) updated 3/17/95 pdfacfee.rpt 00073 Recommended Police Facilities Fees Single family dwelling: 5392.40 times the total number of dwelling units Multi - family dwelling: $254.29 times the total number of dwelling units Mobile home: $260.74 times the total number of dwelling units Non - residential: $ .19 per square foot Projected Funds from Recommended Fees Single family dwelling units: 5,320 x $392.40 = $2,087,568 Multi- family dwelling: 2,242 x $254.29 = $ 570,118 Mobile home: It is estimated that there will be no increase. Non - residential: 4,805,780 sf x $.19 = $ 913,098 Total Collected $3,570,784 Thus far, only $450,000 has been collected in police facilities fees and when combined with the projected funds the City will have $4,020,784 to construct a facility which is estimated to cost $6,454,000. This represents sixty -two percent of the projected cost. In order to keep the fees current, it is suggested that the Mean's Index be used each year to update the fees. Annual updating using the Mean's Index would avoid the need to make a significant increase in any one year to catch up to the trend index. Administration Fee Section 6 authorizes the City Council to amend the fee charged for administration of the building permit fee. It is estimated that this fee requires approximately twenty minutes to process. Based on the composite rate of $78 per hour the recommended administration fee established by the resolution would be $25. Recommendation Introduce the Ordinance for first reading. 2. "Fire station" means a building (including furnishings and fixtures), site and appurtenant equipment (including vehicles) which are designed, developed and used to provide the full spectrum of fire protection services (excepting central administration services, air unit services, hand crew services, dispatch services, repair shop services and central training services). "Floor space" means "floor area," as the latter term is defined in the applicable section of the most recent version of the Uniform Building Code. "New construction," when applied to the construction of residential buildings or the installation of mobilehomes, means construction or installation which increases the (Moorpark 7 -95) 46 number of dwelling units on a given lot or parcel. "New construction," when applied to the construction or installa- tion of nonresidential buildings, means construction cr in- stallation which ir--reases the amount of door nonresidential building purposes on a liven lot. "Overextended" means a fire station or group of fire stations is overextended when, as determined by resolution of the city council, the estimated population of the station's or group's service area exceeds, or the projected population of the service area will at any time within the following eight (8) years exceed, the maximum number of people which the station or group of stations can adequately serve. The "service area" for a given fire station or group of fire stations is that geographical area within the fire district, including both incorporated and unincorporated territory, within which the station or group of stations is located and to which the station or group of stations is the primary provider of fire protection services. The precise boundaries of a given service area shall be determined by resolution of the city council based upon information provided by the fire district. "Standard fire station" means a fire station designed to the fire district's specifications, containing five thousand seven hundred (5,700) square feet of floor space, and having as appurtenant equipment one (1) primary fire engine and one (1) reserve fire engine. Within the incorporated city limits any service area for which the existing fire station or group of fine stations is overextended, a fire protection facilities fee computed pursuant to this article shall be imposed upon the issuance of any building permit for new construction. Except as otherwise provided by Government Code Section 66007, the fee shall be paid prior to issuance of the building permit, or in the case of a mobilehome, prior to the issuance of a mobilehome set -up permit. All fire protection district facilities fees established pursuant to the Municipal Code Chapter 3.36, Article I shall be set by resolution of the city council. The amount of the fire protection facilities fee to be paid pursuant to Section 3.36.020 of this article with respect to the construction of residential buildings or the installation of mobilehomes shall be the dollar amount equal to "X" in the following formula: X = ACD B Where: "A" equals the estimated cost of acquiring a standard fire station. excluding land acquisition costs but including site preparation and landscaping costs; "B" equals the maximum number of people who can be served adequately by a standard fire station; "C" equals the estimated average number of people who will reside in each dwelling unit in the buildings or mobilehomes for which the permit is issued multiplied by a number equal to the number of dwelling units which will be contained in such buildings or mobilehomes after con- struction minus, in cases where the construction is the replacement or modification of existing buildings or mobilehomes, the number of dwelling units contained in such buildings or mobilehomes immediately prior to con- struction; and "D" equals the estimated portion, expressed as a decimal, of the standard fire station needed to provide service to residential buildings and mobilehomes, as opposed to nonresidential buildings. The specific number values to be assigned to "A," `B" and "D" in the foregoing formula and the estimated average number of people per dwelling unit for the purpose of com- puting the value "C" in the foregoing formula, shall be determined by resolution of the city council from time to time on the basis of evidence submitted to it. B. With respect to residential buildings or mobilehomes constructed or installed within a subdivision for which the tentative map was approved subject to the condition that the subdivider donate fire protection facilities, as determined by the city council, a credit may be given against the fee on account of such donated facilities which are accepted by the fire district. For the purposes of this section, unfin- ished facilities shall be deemed to have been "accepted" by the fire district if such facilities are to be completed pursuant to a secured improvement agreement made in accordance with Section 66462 of the Government Code. The amount of the credit shall be determined as follows: 1- The fair market value of the donated and accepted facilities, excluding the land therefor, as of the date on which the final or parcel map was recorded shall be de- termined by written agreement of the chief of the fire district and the subdivider or applicant or, if they should fail to agree, by an independent appraiser selected by the chief of the fire district and paid for by the subdivider or applicant. 2. The estimated number of people who will reside in the entire subdivision when it is fully developed will be determined by multiplying the number of dwelling units 3.36.030 proposed for the subdivision by the estimated average num- ber of people who will reside in each unit and then adding the products, The estimated average number of people who will reside in each dweilin� unit shall be the same as that used to calculate the value of "C" in the foregoing formula. 3. A fair market value as determined pursuant to subdivision I of this subsection shall then be divided by the estimated number of people who will reside in the entire subdivision as determined pursuant to subdivision 2. 4. The estimated number of people who will reside in the unit to be constructed or installed shall be multiplied by the quotient determined pursuant to subdivision 3 of this subdivision. A credit for that unit shall be the dollar amount equal to the product; provided, however, that the amount of the credit shall not exceed the amount of the fee. (Ord. 156 § 1 (part), 1992: Ord. 8 § 3, 1983) 3.36.040 Computation of fee — Nonresidential construction. A. The amount of the fire protection facilities fee to be paid pursuant to Section 3.36.020 of this article with respect to the construction of a nonresidential building shall be the dollar amount equal to " , in the following formula: y = AFG E Where: "A" equals the number value assigned to "A" for the purpose of Section 3.36.030 of this article; "E" equals the maximum square footage of nonresidential building floor space which can be served adequately by a standard fire station; "F" equals the number of square feet of floor space in the buildings for which the permit is issued minus, in cases where the construction is the replacement or modification of an existing building, the number of square feet of floor space in such existing building immediately prior to such replacement or modification; and "G" equals the number one (1) minus the number value assigned to "D" for the purposes of Section 3.36.030 of this article. The specific number values to be assigned to "E" in the foregoing formula shall be determined by resolution of the city council from time to time on the basis of evi- dence submitted to it. B. With respect to buildings constructed for use pursu- ant to a development permit, conditional use permit or other entitlement that was approved subject to the condition that the permittee donate fire protection facilities, as determined by the city council, a credit may be given against the fee on account of such donated facilities which are accepted 47 (Moorpark 7 -95) 3.36.040 by the fire district. The amount of any such credit shall be determined as follows: 1. The fair market value of the donated and accepted facilities, excludinL, the land therefor, as of the date on which the conditional use permit or other similar entitlement was approved shall be determined by written agreement of the chief of the fire district and the permittee or applicant or, if they should fail to agree, by an independent appraiser selected by the chief of the fire district and paid for by the permittee or applicant; 2. A fair market value as determined pursuant to subdivision 1 above shall then be divided by the estimated number of square feet of floor space in all existing and proposed buildings that will be used pursuant to the condi- tional use permit or other similar entitlement; 3. The value of "F' in the foregoing formula computed with respect to the building for which the building permit is issued shall be multiplied by the quotient determined pursuant to subdivision 2 above. A credit for that building shall be the dollar amount equal to the product; provided, however, that the amount of the credit shall not exceed the amount of the fee. (Ord. 156 § 1 (part), .1992: Ord. 8 § 4, 1983) 3.36.050 Use of fire protection facilities fee. All fire protection facilities fees collected pursuant to Section 3.36.020 shall be forwarded to the fire district by the city no less than on an annual basis. All fees so forward- ed shall be deposited in a restricted account of the fire district with the county treasury and all moneys deposited in such account together with any interest earned thereon shall be used only for the purposes of acquiring or improv- ing fire stations serving the service area, or portions thereof, from which the fees were collected, subject to the refund provisions of Section 3.36.070. (Ord. 156 § 1 (part), 1992: Ord. 8 § 5, 1983) 3.36.060 Administration fee. An administration fee shall be collected by the city for each residential and nonresidential project. The fee will be retained by the city for costs associated with administer- ing the fire protection facility fee. The amount of said administration fee shall be as set by resolution of the city council. (Ord. 156 § 1 (part), 1992: Ord. 8 § 6, 1983) 3.36.070 Refund of fee. Any fire protection facilities fee collected pursuant to Section 3.36.020 plus any interest accrued thereon, shall be refunded to the payor if the building permit to which it relates is canceled or expires prior to commencement Of construction pursuant thereto and if the payor files a written application for the refund with the building official (Moorpark 7 -95) 48 within one hundred eighty (180) calendar days after such cancellation or expiration. In any case where the building official determines that a fee deposited in the county treasury should be refunded pursuant to this section, the -�uildinC of:�cial shall so notify the Fire district and request transmittal of the refund to the city, and the city shall make the refund to the person entitled thereto. Refunds pursuant to this section are in addition to any refunds that may be required by applicable section of state law. (Ord. 156 § 1 (part), 1992: Ord. 8 § 7, 1983) Article H. Police Facilities Fee* * Prior ordinance history: Ord. 9. 3.36.080 Definitions. For the purposes of this article, the following words and phrases shall have the meanings respectively ascribed to them below: "Building official" means community development director. "City" means incorporated city of Moorpark. "City council" means city council of the city of Moorpark. "Floor space„ means "floor area" as the latter term is defined in Section 407 of the Uniform Building Code. "New construction," when applied to the construction of residential buildings or the installation of mobilehomes, means construction or installation which increases the number of dwelling units on a given lot. "New construc- tion," when applied to the construction or installation of nonresidential buildings, means construction or installation which increases the amount of floor space for nonresidential building purposes on a given lot. Overextended. A police station is "overextended" when, as determined by resolution of the city council, the estimat- ed population of the station's service area exceeds, or the projected population of the service area will at any time within the following five (5) years exceed, the maximum number of people which the station can adequately serve. Tolice station" means a building (including furnishings, fixtures and appurtenances) and site which is designed, developed and used to provide the full spectrum of police services for the city. Service area. The "Service area" for a given police station is that geographical area within the city, within which the station is located and to which the station is the primary provider of police services. The precise boundaries of a given service area shall be determined by resolution of the city council. "Standard police station" means a police station designed to the police department specifications containing twenty- eight thousand four hundred (28,400) square feet of floor space, of which six thousand four hundred fifty (6,450) square feet are used solely for custodial purposes. (Ord. 206 § 1. 19951 3.36.090 Police facilities fee. Within any service area for which the existing police station is overextended a police facilities fee computed pursuant to this article shall be paid as a condition precedent to the issuance of any building permit for new construction. (Ord. 206 § 2, 1995) 3.36.100 Computation of fee for residential construction. A. The amount of the police facilities fee to be paid pursuant to Section 3.36.090 with respect to the construction of residential buildings or the installation of mobilehomes shall be the dollar amount equal to "X" in the following formula: X = ACD B Where: "A" equals the estimated cost of acquiring a standard police station, excluding the cost of acquiring that portion to be used solely for custodial purposes, but including land acquisition, site preparation and landscaping costs; "B" equals the maximum number of people who can be served adequately by a standard police station; "C" equals the estimated average number of people who will reside in each dwelling unit in the buildings or mobilehomes for which the permit is issued multiplied by a number equal to the number of dwelling units which will be contained in such buildings or mobilehomes after con- struction minus, in cases where the construction is the replacement or modification of existing buildings or mobilehomes, the number of dwelling units contained in such buildings or mobilehomes immediately prior to con- struction; and "D" equals the estimated portion, expressed as decimal of the standard police station needed to provide service to residential buildings and mobilehomes, as opposed to nonresidential buildings. The specific number values to be assigned to "A, "'B," and "D" in the foregoing formula, and the estimated average number of people per dwelling unit for the purpose of com- puting the value "C" in the foregoing formula, shall be determined by resolution of the city council from time to time on the basis of evidence submitted to it. B. With respect to residential buildings or mobilehomes constructed or installed within a subdivision for which the 3.36.080 tentative map was approved subject to the condition that the subdivider donate police facilities and/or land for such facilities, a credit shall be given against the fee on account of such donated facilities and/or land which are accepted by the city of Moorpark. For the purposes of this section, unfinished facilities and the land therefor shall be deemed to have been "accepted" by the city council if such facilities are to be completed pursuant to a secured improvement agreement made in accordance with Section 66462 of the Government Code. The estimated number of people who will reside in the entire subdivision when it is fully developed will be determined by multiplying the number of dwelling units proposed for the subdivision by the estimated average num- ber of people who will reside in each unit and then adding the products. The estimated average number of people who will reside in each dwelling unit shall be the same as that used to calculate the value of "C" in the foregoing formula. 3. A fair market value as determined pursuant to subsection (B)(1) of this section shall then be divided by the estimated number of people who will reside in the entire subdivision as determined pursuant to subsection (13)(2) of this section. 4. The estimated number of people who will reside in the unit to be constructed or installed shall be multiplied by the quotient determined pursuant to subsection (13)(3) of this section. The credit for that unit shall be the dollar amount equal to the product; provided, however, that the amount of the credit shall not exceed the amount of the fee. (Ord. 206 § 3, 1995) 336.110 Computation of fee for nonresidential construction. The amount of the police facilities fee to be paid pursu- ant to Section 3.36.090 with respect to the construction of a nonresidential building shall be the dollar amount equal to "Y" in the following formula: Y = AFG E Where: "A" equals the number value assigned to "A" for the purpose of Section 3.36.100; 49 (Moorpark 7 -95) 3.36.110 "E' equals the maximum square footage of nonresidential building floor space which can be served adequately by a standard police station; "F" equals the number of square feet of floor space in the buildings for which the permit is issued minus, in cases where the construction is the replacement or modification of existing buildings, the number of square feet of floor space in such existing buildings immediately prior to such replacement or modification; and "G" equals the number one (1) minus the number value assigned to "D" for the purposes of Section 3.36.100. The specific number values to be assigned to "E" in the foregoing formula shall be determined by resolution of the city council from time to time on the basis of evi- dence submitted to it. (Ord. 206 § 4, 1995) 3.36.120 Use of police facilities fee. All police facilities fees collected pursuant to Section 3.36.090 shall be deposited in a restricted account within the city treasury and all moneys deposited in such account, together with any interest earned thereon, shall be used only for the purposes of acquiring or improving police stations serving the service area, or portions thereof, from which the fees were collected. (Ord. 206 § 5, 1995) 336.130 Administration fee. In addition to the police facilities fee imposed by Section 3.36.090, an administration fee shall also be paid as a condition precedent to the issuance of any building permit for new construction within any service area for which the existing police station or group of police stations is overextended. The administration fee shall be in an amount equal to the estimated average cost, as determined by resolution of the city council from time to time, of process- ing such permit in accordance with the provisions of this article. (Ord. 206 § 6, 1995) 3.36.140 Refund of fee. Any fee erroneously collected under color of this article shall be refunded without interest to the payor if, within one (1) year after the date on which such fee was deposited in the city treasury the payor files a written application therefor with the building official and provides proof of such error satisfactory to the building official. Any police facilities fee collected pursuant to Section 3.36.090 shall be refunded without interest to the payor if the building permit to which it relates is canceled or expires prior to commencement or construction pursuant thereto and if the payor files a written application for the refund with the building official within one hundred eighty (180) calendar days after such cancellation or expiration. (Ord. 206 § 7, 1995) (MOMPark 7 -95) 50 RESOLUTION N0, 95-1112 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, RESPECTING POLICE FACILITIES FEES, AND RESCINDING RESOLUTION 83 -46 WHEREAS, Section 1 (d)(e), Section 3, Section 4 and Section 6, of Ordinance No. 9 as amended, contemplates that the City Council will determine from time to time the population to be served by a police facility, the service area, the values of the components used to calculate fees, and the administration* fee for processing the police facilities fee; and WHEREAS, the City Council had previously adopted the formulas contained within the County ordinance and now wishes to remain consistent in the application of the formulas to the determination of the building permit fees respecting the funding of police facilities; WHEREAS, the City Council has received evidence that the current fees are inadequate to fund the construction of a future police facility to serve the residents of the City of Moorpark; NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED as follows: Section 1. Administration Fee. The. administration fee authorized by Moorpark Ordinance No. 9 shall be $25 per fee payment. Section 2. Formula Values. The values assigned to "A ", `B ", "C ", "D ", "E ", "F ", and "G" set forth in City Ordinance No. 9 shall be computed as follows: (A) The value "A" is the number $6,454,000. This number equals the estimated cost in dollars of acquiring a standard police station, excluding the cost of acquiring that portion to be solely for custodial purposes, but including land acquisition, site preparation and landscaping costs. (B) The value `B" is the number 34,000. This number is the total estimated population to be served by the police station in the year 2010. (C) For the purposes of computing the value "C ", the estimated average number of residents per dwelling units is 3.04 for single family residences, 1.97 for multi - family units and 2.02 for mobile home units. This number equals the estimated portion, expressed as a decimal, of the standard police station needed to provide service to residential buildings and mobilehomes, as opposed to non - residential buildings. (E) The value "E" is the number 9,989,000. This number equals the estimated square footage of non - residential building floor space which will be served by a police station in the year 2010. (F) The value "F" is a variable and represents the number of square feet of floor space in the non - residential buildings for which the permit is issued. (G) The value "G" is the number 1 minus the value of "D ".
