AN ORDINANCE OF THE CITY OF MOORPARK,
CALIFORNIA, AMENDING CHAPTER 2.32, PARKS
AND RECREATION COMMISSION, AND CHAPTER
2.36, PLANNING COMMISSION, OF TITLE 2,
ADMINISTRATION AND PERSONNEL, OF THE
MOORPARK MUNICIPAL CODE
WHEREAS, Chapters 2.32 and 2.36 of Title 2 of the Moorpark Municipal
Code set forth the requirements for the Parks and Recreation Commission and
Planning Commission, respectively; and
WHEREAS, the City Council has determined that Sections 2.32.020 and
2.32.030 of Chapter 2.32 and Sections 2.36.020 and 2.36.030 of Chapter 2.36
should be amended to clarify the nomination and appointment procedure for both
the Parks and Recreation and Planning Commissions; and
WHEREAS, the City Council has further determined that Section 2.32.090 of
Chapter 2.32 should be amended to revise the duties and responsibilities of the Parks
and Recreation Commission;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, DOES ORDAIN AS FOLLOWS:
SECTION I. Sections 2.32.020 and 2.32.030 of Chapter 2.32 of the
Moorpark Municipal Code are hereby amended in their entirety as follows:
"2.32.020 Membership - -Term of office.
A. The parks and recreation commission shall consist of five (5)
members to be appointed by the city council. The mayor shall solicit
suggested nominees from members of the council. The mayor shall
make a motion putting forth a single name to be approved for
appointment. A second shall be required. The council shall vote on
each appointment to the commission individually. The term of the
parks and recreation commissioner shall be for a period of two (2) years.

The appointment, or reappointment, as the case may be, shall occur at
the reorganization meeting of the city council held every even - numbered
year. If a vacancy occurs otherwise than by expiration of a term, it shall
be filed for the unexpired portion of the term of office by the same
nomination process described herein for a new term of office. The term
of the ex officio or advisory members shall correspond to their respective
terms of office.
B. Nothing in this chapter is intended to preclude the
reappointment of any parks and recreation commissioner upon the
expiration of his or her term.
2.32.030 Qualifications.
A. The members of the commission shall be residents and
registered voters of the city. When a person serving on the parks and
recreation commission ceases to be a resident of the city, the mayor shall
declare vacant such person's position on the parks and recreation
commission and shall nominate another eligible person to the unexpired
term of such former member, pursuant to Section 2.32.020.A of this
chapter.
B. No members of the parks and recreation commission shall
hold any other remunerative office or position with the city."
SECTION 2. Section 2.32.090 of Chapter 2.32 of the Moorpark Municipal
Code is hereby amended in its entirety as follows:
"2.32.090 Duties and Responsibilities.
The duties and responsibilities of the parks and recreation
commission are as follows:
A. Act in an advisory capacity and be responsible to the city council in
all matters pertaining to the city's parks and public recreation, which include
the programs that fall under the city's parks and recreation divisions, excluding
senior center and teen programs. When directed by council, work on specific
items cooperatively with other non - elected representatives from governmental
agencies and civic groups in the advancement of sound recreation and parks
planning and programming;
B. Formulate policies on recreation and park services for
consideration and approval by the city council. When directed by the
council, provide recommendations for the best possible joint use of

recreation and park facilities between the school district and/or other
public or private agencies;
C. Advise the city council on the administration and
development of recreation areas, facilities, programs and improved
recreation services. In addition, provide post event evaluation of all
recreation special event and seasonal programs, including review of
expenditure matters. Malce recommendations for consideration by staff
on the means of promoting public recreation programs and services to
stimulate interest therein;
D. Make periodic inventories of recreation services that exist and
may be needed and interpret the needs of the public to the city council.
Consistent with city council direction, interpret the policies and
functions of the recreation division to the public;
E. Identify and act on opportunities to assist and work
cooperatively with the teen council consistent with the teen council's
objectives;
F. Advise the city council in the preparation of the annual budget
request and a long -range recreation and parks capital improvement
program prior to the adoption of the budget;
G. When directed by the city council, consider and recommend
the conceptual design of park and park facility improvements, including
play equipment and other park amenities. When ever possible, solicit
public input on such matters;
H. Prior to consideration of residential subdivisions of 50 lots or
more and rental housing projects by the planning commission, make a
recommendation whether to accept park land dedication or fees in lieu
of park land dedication consistent with applicable city ordinances and
the General Plan. If land dedication is recommended, also recommend a
location for the proposed park site(s);
I. Prior to October 31 and April 30 of each year, conduct a field
review and evaluation, and if determined necessary, a written report to
the city council on the condition of parks and related facilities.
Additionally, periodically perform a review of the city's park rules and

use fees, and provide a recommendation to the city council for
consideration;
J. When directed by the city council, assist and participate with
review and recommendation on the use of dedicated public open space
areas, existing and future green belts, and review and comment on
revisions and updates to the city's Open Space, Conservation and
Recreation Element (OSCAR);
IC Review the city's Park Master Plan and park land dedication
ordinance and park improvement fund zone designations every two
years and recommend to the city council any proposed changes;
L. Consistent with adopted city goals, review and recommend
annual objectives for parks and recreation divisions;
M. Consistent with the city park. naming policy, consider and
recommend to the city council names for city parks;
N. Annually meet jointly with the city council;
O. Perform such other duties as may be requested from time to
time by the city council."
SECTION 3. Sections 2.36.020 and 2.36.030 of Chapter 2.36 of the
Moorpark Municipal Code are hereby amended in their entirety as follows:

2.36.030 Qualifications.

on the basis of special knowledge in the fields of real property,
construction, law, zoning and architecture, or related subjects.
C. No members of the planning commission shall hold any other
remunerative office or position with the city."
SECTION 4. If any section, subsection, sentence, clause, phrase, part or
portion of this Ordinance is for any reason held to be invalid or unconstitutional by
any court of competent jurisdiction, such decision shall not affect the validity of the
remaining portions of this Ordinance. The City Council declares that it would have
adopted this Ordinance and each section, subsection, sentence, clause, phrase, part or
portion thereof, irrespective of the fact that any one or more section, subsections,
sentences, clauses, phrases, parts or portions be declared invalid or unconstitutional.
SECTION 5. This Ordinance shall become effective thirty (30) days after its
passage and adoption.
SECTION 6. The city cleric shall certify to the passage and adoption of this
ordinance; shall enter the same in the book of original ordinances of said city; shall
make a minute of the passage and adoption thereof in the records of the proceedings
of the City Council at which the same is passed and adopted; and shall, within fifteen
(15) days after the passage and adoption thereof, cause the same to be published once
in the Moorpark Star, a daily newspaper of general circulation, as defined in Section
6008 of the Government Code, for the City of Moorpark, and which is hereby
designated for that purpose.
