Nowak, Assistant City Manager DATE: 21 May 1998 (Special Council meeting of 05- 27- 98) SUBJECT: Approve Joint Resolution of Agreement for Allocation of Property Tax from the Dissolution of the Moorpark Mosquito Abatement District Discussion: The City of Moorpark has submitted an application to the Ventura County Local Agency Formation Commission (LAFCO) for the dissolution of the Moorpark Mosquito Abatement District. The responsibility for providing the vector control services of the former District would be divided between the City of Moorpark and the County of Ventura, each servicing their respective jurisdiction. State law requires that the City and County reach an agreement on how future property taxes from the District will be apportioned between the two governmental entities. The Council's Special Committee on the Moorpark Mosquito Abatement District Dissolution has been meeting on this matter for a number of months. Based on negotiations with the County, its recommendation is that the City accept the agreed upon distribution in which the County would receive $47,500 from the property taxes that previously went to the District and that the City receives the balance of the funds. In all subsequent years, the County would receive all of the tax revenues that would result from assessments in the unincorporated areas and 20.89211 % of the revenue from the assessments within the City of Moorpark boundaries. The City would receive the remaining 70.10789°x6 of the tax revenues. The same percentage allocations would apply to unitary taxes and the tax increment pass - through that previously went to the District. Staff has evaluated the proposal and has determined that it will provide the City with sufficient revenues to maintain the vector control services levels currently provided within the City of Moorpark. Recommendation: (ROLL CALL VOTE) That the City Council adopt the Joint Resolution of Agreement regarding the allocation of property taxes from the dissolution of the Moorpark Mosquito Abatement District. Attachment: Joint Resolution of Agreement JOINT RESOLUTION OF AGREEMENT BETWEEN THE CITY OF MOORPARK AND THE COUNTY OF VENTURA REGARDING ALLOCATION OF PROPERTY TAX FROM THE DISSOLUTION OF THE MOORPARK MOSQUITO ABATEMENT DISTRICT Whereas, the Moorpark Mosquito Abatement district (hereafter the District) receives an allocation of the countywide one percent (1%) property tax levy in accordance with Revenue and taxation Code Section 95 et seq.; and Whereas, the District Board of Directors has voted to dissolve the District; and Whereas, dissolution of the District would effect a jurisdictional change for vector control, in that the City of Moorpark (City) and the County of Ventura (County) will assume responsibilities for vector control within the former territory of the district that is within their respective jurisdictional areas; and Whereas, Section 99 of the Revenue and Taxation Code authorizes the negotiated exchange of property tax revenues upon the dissolution of a District; and Whereas, any negotiated agreement affecting an independent special district shall be approved by the County Board of Supervisors; and Whereas, it is necessary that the provisions of this agreement be included in the resolution adopted by the Local Agency Formation Commission (LAFCO) and filed with the State Board of Equalization and local officials. NOW, THEREFORE, THE COUNTY OF VENTURA BOARD OF SUPERVISORS AND THE CITY COUNCIL OF THE CITY OF MOORPARK, HEREBY RESOLVE AND AGREE AS FOLLOWS: Section 1. In Fiscal Year 1998 -99, the District shall pay $47,500 to the County and all property tax revenues received in excess of the $47,500 shall be paid to the City of Moorpark. Section 2. In the first year of dissolution approved by The State Board of Equalization the County Auditor shall perform the necessary calculations to implement the following: a. In the unincorporated portion of the District located outside the City of Moorpark, 100% of the property taxes shall be transferred from the district to the County General Fund. b. Within the City limits of Moorpark, 79.10789% shall be transferred from the District to the City of Moorpark and 20.89211 % shall be transferred to the County. Section 3. The amount allocated to the District pursuant to Revenue and Taxation Code Section 100 shall be redistributed on a proportionate basis to the County and City by dividing the total amounts transferred to the City and the County by the total transfer amount. Section 4. All transfers shall be performed on the amounts deemed allocated in the prior fiscal year prior to the distribution of the annual tax increment and in accordance with Section 96.5 of the Revenue and Taxation Code with reference to growth in the same manner as other existing transfers and agreements. Section 5. The amounts transferred will be added to the current allocations of the County General Fund and the City of Moorpark and will increase the County and City's proportionate share of the annual tax increment in accordance with Section 96.5 of the Revenue and Taxation Code.
