Cole, Senior Management Analyspv BY• X Department of Administrative Services DATE: May 21, 1998 (CC Meeting of June 3, 1998) SUBJECT: Consider a Resolution Determining and Levying the Special Tax in Community Facilities District 97-1 (Carlsberg Business Park Public Improvements) for Fiscal Year 1998/1999 BACKGROUND In compliance with the procedures contained in Chapter 2.5, Part 1, Division 2, Title 5 of the Government Code of the State of California (the Mello-Roos Community Facilities Act) and other provisions of applicable law, the City Council, via passage of Resolution 97- 1347 (the Formation Resolution) on July 16, 1997, formed Community Facilities District 97-1/Carlsberg Business Park Public Improvements (CFD 97-1). Pursuant to the formation of CFD 97-1, the City Council, acting as the governing board of the District, did authorize the issuance of Special Tax Bonds to finance the purchase of certain public improvements (streets, sidewalks, etc.), all as more particularly described in the Official Statement dated July 24, 1997. The bonds have varying maturity dates ranging from September 1, 1998 to September 1, 2027. In accordance with Section 9 of the Formation Resolution, the Finance Director of the City of Moorpark has prepared a current roll of special tax levy obligations by assessor's parcel number. Said roll shall be submitted to the appropriate officer of the County of Ventura for collection of said special tax and transmission of the collected special tax to the City for forwarding to the Fiscal Agent, all in accordance with applicable law and documents governing the operation of CFD 97-1. The adoption of the proposed resolution is an annual administrative requirement of CFD 97-1. RECOMMENDATION It is recommended that the City Council adopt the attached proposed resolution determining and levying the special tax in Community Facilities District 97-1 (Carlsberg Business Park Public Improvements) for Fiscal Year 1998/1999. RESOLUTION NUMBER 98 - RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK DETERMINING AND LEVYING THE SPECIAL TAX IN COMMUNITY FACILITIES DISTRICT NO. 97-1 FOR FISCAL YEAR 1998-1999 WHEREAS, the City Council (the "City Council") of the City of Moorpark is the legislative body of Community Facilities District No. 97-1 (the "District), which District was established pursuant to the provisions of the Mello-Roos Community Facilities Act of 1982, as amended, being Chapter 2.5, Part 1, Division 2, Title 5 of the Government Code of the State of California (the "Act"); and, WHEREAS, on February 19, 1997, the City Council adopted Resolution No. 97- 1280 stating its intention to establish the District; and, WHEREAS, on July 16, 1997, the City Council adopted Resolution No. 97-1347 establishing the District; and, WHEREAS, the City of Moorpark has heretofore received a report relating to the 1998-99 special tax levy for the District as attached as Exhibit "A." NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MOORPARK: Section 1. The preceding recitals are true and correct. Section 2. The City of Moorpark hereby determines to levy the special taxes to be levied in Fiscal Year 1998-99 for each parcel in the District, as provided in Resolution 97-1280. Section 3. The special tax rate utilized in the preparation of the levy does not exceed the amount previously authorized, and is not in excess of that approved by the qualified electors of the District. Section 4. The proceeds of the special tax shall be used to pay, in whole or in part, the approved costs of the District. Section 5. The Auditor-Controller of the County of Ventura is hereby requested and authorized to prepare a real property tax statement for each parcel of the District for the 1998-99 fiscal year listing the special tax due opposite each lot or parcel of land affected, in a line item designated "CFD 97-1 special tax," or any other suitable designation, in accordance with this resolution. Section 6. All special taxes collected will be deposited in the applicable special tax fund upon receipt by the City of Moorpark from the Auditor-Controller pursuant to the terms of the Indenture of Trust. 000211101 : Resolution 98 - Page 2 of 2 Section 7. The Auditor-Controller shall, at the close of the tax collection period, render to the District a detailed report showing the amount of the special tax installment, penalties, interest, and fees collected, and from which properties collected. Any expenses to be paid to the Auditor-Controller for carrying out the foregoing responsibilities shall be in accordance with a contract, if any, entered into between the District and the Auditor-Controller, pursuant to Section 29304 of the Government Code of the State of California or as otherwise provided by law. Section 8. This resolution shall take effect immediately upon its passage and adoption. PASSED, APPROVED AND ADOPTED this 3rd day of June, 1998.
