Lindley, Director of Community Services Pk DATE: June 4, 1998 (City Council Meeting of June 17, 1998) SUBJECT: Consider Ventura Regional Sanitation District Property Tax Transfer and Adopt Resolution No. 98- BACKGROUND On May 20, the City Council approved the attached Agreement for the transfer of property taxes (see Attachment A) from the Ventura Regional Sanitation District (VRSD) to the cities and the County. Following that action, the City of Oxnard raised a concern about the need to conduct a public hearing to consider the property tax transfer and the adoption of a resolution. Based on Section 99.1 (subdivision e) of the Revenue and Taxation Code, the County's legal counsel is recommending that each jurisdiction follow the above prescribed course of action. Additionally, subdivision (f) of Section 99.1 states that VRSD must affirm that the transfer of property taxes will not cause the District to increase fees. To that end, VRSD has provided a letter verifying that landfill fees will not be increased due to the transfer of property taxes. The Agreement provides that cities will receive a permanent transfer of 98% of the VRSD property tax collected within their boundaries over a two -year period. The County will receive a permanent transfer of 100% of the VRSD property tax collected in the unincorporated area and 2% of the VRSD property tax generated within each city, including the former VRSD tax revenue in Simi Valley and Moorpark. When the cities of Moorpark and Simi Valley detached from VRSD they received 50 % of the property tax allocated to the District, the other 50 % was allocated to the County. Under the Agreement, the County will transfer to Moorpark and Simi Valley an equivalent of 98 % of the tax its currently collects within the boundaries of those two cities. This is consistent with the transfer results in place for the eight (8) remaining VRSD member cities. Staff has noticed the Public Hearing and the Council is asked to open the Hearing, accept any public testimony offered, and close the Hearing. Additionally, the Council is being asked to adopt the attached resolution which approves the Agreement for the Transfer of Property Taxes and Unitary Taxes. Recommendation Staff recommends that the City Council open the Public Hearing to accept testimony on the Agreement for the Transfer of Property Taxes and Unitary Taxes, and adopt Resolution No. 98 - C:\D0CS \S0L1DWS1\VRSDPH.AGD 000004 RESOLUTION NO. 98 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK APPROVING THE AGREEMENT FOR TRANSFER OF PROPERTY AND UNITARY TAXES WHEREAS, the Ventura Regional Sanitation District ( "VRSD ") wishes to transfer property taxes to the cities of Camarillo, Fillmore, Port Hueneme, Ojai, Oxnard, San Buenaventura, Santa Paula, Thousand Oaks, and the County of Ventura in accordance with Revenue and Taxation Code 99.1; WHEREAS, the County of Ventura wishes to transfer property taxes to the cities of Moorpark and Simi Valley; WHEREAS, the attached Agreement for the Transfer of Property Taxes and Unitary Taxes ( "Agreement ") has been negotiated to effectuate such a transfer and other objectives; and WHEREAS, in accordance with subdivision (f) of Section 99.1 of the Revenue and Taxation Code, VRSD has affirmed that the transfer of property taxes pursuant to said Agreement will not increase the ratio between the amount of its revenues from regulatory licenses, use charges, user fees or assessments and the amount of its revenues used to finance services provided by it. The approval of said Agreement is conditioned upon all other parties to the Agreement approving the Agreement without change and executing the same. When such agreement has been executed by all of the parties except the County, the Chairperson of the Board is authorized to execute the Agreement on behalf of the County. All such approvals must be completed prior to June 30, 1998. PASSED, APPROVED AND ADOPTED this day of _ , 1998.
