SUBJECT: Consider the Status of Virginia Colony Park -bY : o�f' p=rj2,P--
Background
During the FY 1998/99 budget process, the City Council considered the closure of various City
parks. Virginia Colony Park was one of the parks discussed by the Council for closure. In lieu of
closing the park, the Council considered a proposal to transfer the responsibility to operate and
maintain Virginia Colony Park to the Moorpark Unified School District (MUSD). Under the
proposal considered, MUSD would be responsible for the park, including, but not limited to,
landscape maintenance, utilities, and maintenance of park amenities. While the park would be
used by Moorpark Community High School and for other MUSD purposes, the intent was that it
would continue to be open to the public.
At the time the FY 1998/99 budget was adopted, discussions were underway between the City
and MUSD, regarding the transfer of the park. As a result, the City Council allocated funds to
perform basic operations and repairs for Virginia Colony Park; it was anticipated that the
discussion would take about two months. Additionally, staff was directed to report back to the
Council by the first meeting in September if the MUSD declined the offer to transfer the park, or
if transfer discussions had not been concluded. As of the date of this Agenda Report, there is no
resolution to the issue of transferring the park; however, discussions between the City
(represented by Councilmember Wozniak) and MUSD are still in process. As a result, staff is
requesting an additional month's time to finalize a potential agreement.
If the Council elects to continue discussions with MUSD for one more month, it will need to
provide operations and maintenance funding for the park at a cost of $1,400. This action will
fund the park through October 9, 1998. Monthly costs include landscape maintenance, water
(water usage is high in the summer and fall), electricity, and repair and maintenance expenses.
Any allocation of additional funding to keep Virginia Colony Park open will come from the City's
General Fund.

If MUSD declines the City's offer, or if an agreement between the City and MUSD has not been
reached by October 7, it is recommended that the City Council approve the park's closure.
Closing the park would include the installation of a chain link fence (rental) and closure signs, and
annual weed abatement costs at a total cost of $1,800 through the end of the fiscal year.
Funds to close the park would also have to be allocated from the City's General Fund.
Pending final resolution of the status of Virginia Colony Park, staff will prepare a resolution
amending the FY 1998/99 budget to incorporate the additional allocations to the Park
Maintenance Budget for the City Council's October 7, 1998 meeting.
Recommendation
Staff recommends that the City Council:
1) Direct staff to continue operating and maintaining Virginia Colony Park for one
more month through October 9, 1998, and
2) Direct staff to close the park, as outlined in the staff report, if an agreement with
MUSD to operate and maintain the park is not reached by October 7.
