From: Nelson Miller, Director of Community Developmeri t-/ Prepared by Craig Malin, Assistant Planner Date: September 2, 1998 (CC meeting September 2, 19198) Subject: Consider Minor Modification No. 1 to Major Modification No. 1 of Commercial Planned Development Permit No. 95 -1 for approval of a sign program for the Rite Aid Drug Store and Kindercare Day Care center, located at the northwest corner of Spring and Tierra Rejada Roads (Marketplace Partners) Summary This proposed Minor Modification is a request for approval of a sign program for the Rite Aid Drug Store and Kindercare day care facility at the northwest corner of Spring and Tierra Rejada Roads. The signage proposed in the sign program is in excess of Zoning Code limitations for sign area, and includes cabinet signs where individual channel letters are required. The applicant has not submitted any information to support the proposed sign program which is inconsistent with the Zoning Code and other provisions established by approval of various aspects of this project. Background Commercial Planned Development Permit No. 95 -1 was approved on June 19, 1996, for the construction of a 27,806 sq.ft. neighborhood commercial center consisting of a single building with several small uses. Major Modification No. 1 to Commercial Planned Development Permit No. 95 -1 was approved by the City Council on June 12, 1997, to modify the approved plans for the construction of a 26,180 sq.ft. commercial center consisting of two buildings including a Rite Aid Drug Store and a Kindercare day care facility. Both buildings in this center are currently under construction. General Plan Designations are: C -1 = Neighborhood Commercial, M = Medium Density Residential, OS -2 = Open Space 40 acre minimum. Discussion Condition No. 48a of Resolution No. 97 -1413 (Exhibit No.4, approving the Major Modification for construction of the center) required submission of a sign program for approval by the Director of Community Development prior to issuance of a Zoning Clearance for construction. This condition required that all signs meet the standards set forth in the sign program and additionally allowed the sign program to supersede the requirements set forth in Section 17.40 of the Moorpark Municipal Code (sign code). The sign conditions were further modified by Condition No. 5 of Resolution No. 98 -1442 (Exhibit No. 5) which approved Conditional Use Permit No. 98 -1 granting the authority to sell beer and wine and limiting signs to one line of copy, with the stipulation that secondary signage advertising available goods and services would not be allowed. A draft sign program was submitted on April 24, 1998, by Collins Signs (as agent for Marketplace Partners) for review by the City. The total amount of sign area in this proposal exceeded the permitted sign area allowed by the code and the application was returned to the applicant for modification. PD95- 1 #1.SR 000Oys CPD 95 -1 Minor Modification 1 Collins Signs Page 3 Minor Modification No. 1 was filed on July 27, 1998, by Collins Signs on behalf of Marketplace Partners, for approval of the sign program. This subsequent submittal is identical to the sign program originally submitted. Because elements of the proposed sign program exceed the code limits and Section 17.40.060 of the Zoning Ordinance prohibits the Director of Community Development from approving any sign or sign program which exceeds requirements in the Zoning Ordinance, referral to the City Council is required. The sign program in this application exceeds the allowed sign area contained in the sign code in the following areas and is inconsistent with other code provisions or criteria established for this project as noted in the next section. A precedent has been set prohibiting sign programs to exceed the allowed sign area in Section 17.40 of the Zoning Code. American Stores Properties applied for Minor Modification No. 3 to CPD 90 -2 for approval of a sign program for Mountain Meadows Plaza. The applicant requested a total sign area exceeding the code requirement (including two Major Tenants with signs of 180 sq.ft. each, including secondary signs). This application was denied by the Council on January 15, 1997 with the direction that the sign program must meet all sign code requirements, including a limit of 80 sq.ft. for Major Tenants and 20 sq.ft. for Minor Tenants, and prohibiting secondary signs as well. Minor Modification No. 4, a request to modify the Mountain Meadows Plaza sign program was approved by the Council on April 2, 1997, to allow a secondary sign for Bank of America (a separate business within Luckys Market), but also denied a request for additional secondary signs (Deli and Bakery for Luckys, Pharmacy and Liquor for Sav -On Drugs) for all tenants within the center, major or minor. PROPOSED SIGNAGE: Kindercare Signs: Two wall signs are proposed. Each sign measures 9' x 3' (27 sq. ft . per sign) , for a total of 54 sq. ft . for both signs. Section 17.40.040.D allows Major Tenants (over 10,000 sq.ft. of building area) to have a maximum of 80 sq.ft. of sign area PD95- 1 #1.SR 00009b CPD 95 -1 Minor Modification 1 Collins Signs Page 4 with 20 sq.ft. of sign area allowed for Minor Tenants (structures under 10,000 sq.ft. in area) . Kindercare will have 9,450 sq.ft. of building area, but has 18,000 sq.ft. of playground area which is an integral part of a daycare facility. California State Law requires day care centers to provide seventy -five (75) sq.ft. of outdoor play area per child. Based upon the somewhat unique nature of a day care center operation, and state law requiring provision of an outdoor play area, it may be appropriate to recognize this use as a Major Tenant. If recognized as a Major Tenant, their proposed signage of 54 sq.ft. would be consistent with the area allowed for Major Tenants. The signs are proposed to be cabinet style, which is not allowed by Section 17.40.040.D.9 of the Zoning Ordinance, which requires signs to be compatible with the architectural design of the building. In addition, cabinet signs are not allowed in accordance with Section 17.40.050.E which requires individually illuminated channel or push through letters. Rite Aid Signs: Wall sign. One wall sign is proposed to be located on the diagonal corner cut off of the building, which faces both Spring and Tierra Rejada Roads. This sign measures 1717" x 3' (52.75 sq.ft.) with individually illuminated red acrylic channel letters. Secondary signs. A total of four separate secondary signs are proposed as follows: 1 Hour Photo; Drive Thru Pharmacy; Foodmart and Pharmacy. Three of these signs will be located on the building wall elevation: "l Hour Photo" facing Tierra Rejada Road; " Foodmart" and "Pharmacy" facing Spring Road; and the fourth sign, "Drive Thru Pharmacy" will face Spring Road and is located on the canopy above the drive thru area of the building. Each of these internally illuminated red acrylic cabinet signs measures 1013" x 2' (20 % sq.ft. each), for a total of 82 sq.ft. for all secondary signs. Condition No. 5 of Resolution No. 98 -1442 (Exhibit No. 5) prohibits signs PD95- 1 #1.SR UO X97 CPD 95 -1 Minor Modification 1 Collins Signs Page 5 advertising available goods /and or services. This provision applies to three of the four secondary signs (1 Hour Photo, Foodmart and Pharmacy). The fourth sign (Drive Thru Pharmacy) serves the function of a directional sign to the pharmacy drive thru and could be allowed resulting in a total sign area of 73.25 sq.ft. when combined with the building wall sign. In addition, the code requires all signs to be illuminated with channel or push thru letters, not cabinets signs as proposed. Total sign area: The total sign area of all proposed Rite Aid building signs, including the main sign of 52.75 sq.ft. and the four secondary signs of 20.5 sq.ft. each, results in a total of 134.75 sq.ft., exceeding the limit of 80 sq.ft. of sign area for Major Tenants, as set forth in Section 17.40.040.D.b. of the Zoning Code. Removal of the secondary signs would bring the sign area into the range (80 sq.ft. maximum) allowed by code. Conditional Use Permit 98 -1, which authorized beer and wine sales included a condition of approval (No. 5) which prohibited these secondary signs. Elimination of the three signs advertising services and keeping only the main sign and the pharmacy drive thru sign yields a total of 73.25 sq.ft., which is within the maximum 80 sq.ft. allowed. Monument Signs: Two monument signs, as allowed in Section 17.40.040.B of the sign code, advertising Kindercare and Rite Aid are proposed, one facing Spring Road and one facing Tierra Rejada Road, adjacent to each driveway entrance. Each sign measures 4' in height by 912" in length, with a sign area of 3' x 6' (meeting the allowable size area of 30 square feet). The signage area is proposed to be an internally illuminated acrylic panels (cabinet) . Section 17.40.050.E of the code requires all monument signs to have individually illuminated push through or channel letters. The proposed method of illumination for the monument signs does not comply with the code requirements. PD95- 1 #1.SR OOUL98 Conclusion The elements of this request which are not in compliance with the sign code or other criteria established for this project as follows: 1) Cabinet signs proposed for Rite Aid and Kindercare are not allowed by the code. 2) Cabinet signage within the monument signs are not allowed by the code. 3) Secondary signs advertising goods and services was restricted by conditions of Conditional Use Permit No. 98 -1. 4) Cabinet style secondary signs are not allowed by the code, and, 5) Total signage exceeds the allowable sign area for Major Tenants. Based upon these deficiencies, and the lack of any information from the applicant concerning justification for the request, staff is unable to support this request. Environmental Determination This project is Categorically Exempt from CEQA requirements as a Class 1 exemption, for the operation or alteration of private structures. Recommendation Adopt Resolution 98- denying Minor Modification No. 1 to Commercial Planned Development Permit 95 -1. PD95- 1 #1.SR 0000yy RESOLUTION NO. 98- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA DENYING MINOR MODIFICATION NO. 1 TO MAJOR MODIFICATION NO. 1 OF COMMERCIAL PLANNED DEVELOPMENT PERMIT NO. 95 -1 WITHOUT PREJUDICE (MARKETPLACE PARTNERS) WHEREAS, on December 12, 1997, the City Council adopted Resolution No. 97 -1413 approving Commercial Planned Development Permit No. 95 -1 Major Modification No.l; and WHEREAS, on February 18, 1998, the City Council adopted Resolution No. 98 -1442 approving Conditional Use Permit No. 98 -1; and WHEREAS, on July 27, 1998, the applicant applied for Commercial Planned Development Permit No. 95 -1 Minor Modification No. 1 for approval of a sign program; and WHEREAS, staff conduced an environmental review of the proposed application and determined that the project is Categorically Exempt from the California Environmental Quality Act requirements as a Class 1 exemption for the minor alteration of private structures. WHEREAS, the Director of Community Development recommended denial of Commercial Planned Development Permit No. 95 -1 Minor Modification No. 1 on September 2, 1998; and WHEREAS, the City Council after review and consideration of the information contained in the Staff Report and testimony which was received at the September 2, 1998, meeting reached a decision on this matter; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council hereby denies Commercial Planned Development No. 95 -1 Minor Modification No. 1 without prejudice based on the findings set forth in section 2 and on information in the Staff Report dated September 2, 1998, which report in incorporated herein by reference as though fully set forth: PD95- 1 #1.SR EXHIBIT 1 0001.00 Reso 98- Collins Signs Page 2 SECTION 2. The City Council adopts the following findings: 1. The Minor Modification is not consistent with the intent and provisions of the City's General Plan; the City's Zoning Ordinance; and conditions of approval for this development. 2. The Minor Modification is not compatible with the character of surrounding development. 3. The conditionally permitted use is not compatible with existing and planned land uses in the general area where the development is to be located. SECTION 3. Wall Signs (Major and Minor Tenants). 1. Size. a. Minor Tenants. For minor tenants, the wall signs may not exceed a maximum sign aces of twenty (20) square feet per building tenant. b. Major Tenants. For major tenants, the wall signs may not exceed a maximum sign area of eighty (80) square feet per building tenant. c. Single Parcels, Under Ten Thousand (10,000) Square Feet. Single parcels under ten thousand (10,000) square feei shall be subject to the same signage allowed for a minor tenant. 2. Height, for Minor and Major Tenants. Wall signs, for all tenants, may not extend beyond the roof line. 3. Length. Sign length may not be greater than seventy- five percent (75%) of the linear frontage of a building. In the case of multiple tenants, the sign may not be greater than seventy-five percent (75%) of the linear frontage of the space occupied by the applicant. 4. Number of Signs. a. One (1) wall sign per tenant may be allowed For single out parcel tenants, two (2) wall signs per parcel may be allowed, with a maximum wall sign area of twenty (20) square feet of signage per wall sign. b. A single tenant with mote than tat thousand (10,000) square feet of retail space may be allowed three (3) wall signs, with a maximum wall sign area of ten (10) square feet of signage per wall sign. c. Comer tenants which are attached to a center may have an additional wall sign which either fronts the street or the parking lot. 5. Location. a. Signs on the Front Elevations. Signs on the front elevations are allowed as provided herein. b. Side and Rear Elevations. A second sign may be. allowed provided that the sign is no more than fifty percent (50%) of the sign area of the sign on the front elevation. No building shall have more than two (2) sips per building. 6. Illumttnation. Wall signs may be illuminated, consis- tent with illumination policies as outlined within Section 17.40.050E. External and indirect lighting is not allowed 7. Letter Size. For minor tenants the minimum letter height may be fourteen (14) inches and the maximum letter height may not exceed eighteen (18) inches. For major tenants the maximum letter height may be forty -eight (48) inches. For industrial developments the maximum letter height may not exceed twenty-four (24) inches. 8. Mounting. All wall signs shall be mounted parallel to the wall and shall not project more than eight (8) inches from the wall, and shall not project into the public right -of- way or over the property line. 17.40.040 9. Design. Wall signs shall exhibit an architectural design which is compatible to the design of the building in which the business that the sign identifies is located. 1. Permit Not Required. Window signs are allowed without obtaining a sign permit. 2. Size and Location. Window signs may not exceed twenty-five percent (25%) of the total window area, per window, on any single frontage of the building fronting a street to be displayed in conjunction with sales or special events for an indefinite period of time. 3. Illumination. Window signs shall not be illuminated except for signs made of neon. 4. In -Lieu of Wall Signs. If window signs are used in -lieu of wall signs, no temporary window signs are allowed for those windows having permanent window signs. F. Under - Canopy Signs. 1. Size and Height. The sign area for an under canopy sign may not exceed twenty (20) square feet. Under canopy sign may be allowed in a hanging fashion if it maintains a clearance of not less than eight (8) feet from the bottom of the sign to the walkway. 2. Illumination. Under canopy signs shall not be illuminated. 3. Lester Size. The maximum letter size may not exceed fourteen (14) inches in height. 4. Mounting. Under-canopy signs may be mounted using a flexible device such as a chain or cable. 5. Design. Under- canopy signs shall exhibit an architec- tural design which is compatible to the design of the building in which the business that the sign identifies is located. 6. Other. Under-canopy signs are not allowed to project beyond the canopy. G. Clocks and Thermometers. Time and temperature devices may not exceed a maximum area of twenty-four (24) square feet and shall not display commercial advert=- ment on the clock or thermometer. No permit is required for clocks and thermometers which do not function as an advertising copy. H. Directory Signs. 1. Size and Height. Directory signs are required in multitenant residential. or industrial complexes. Directory signs may be required in commercial office buildings as required by the director of community development. All directory signs may not exceed a maximum of five (5) feet in height and three (3) feet in width. 2. Letter Size. Time maximum letter sine for all directory signs may not exceed six (6) inches in height. 3. Mounting. No signs, regulated by this chapter, are allowed within the public E. Illuminated Signs. 1. Location. Illuminated signs are not allowed in open space, agricultural and residential zones. Illuminated signs are allowed in other zones, subject to compliance with other sign requirements as set forth in this chapter and approval of a sign permit. 2. Illumination. a. Illuminated signs in nonresidential zones shall not exceed the brightness of a diffused light panel having slim - line cool white fluorescent four hundred thirty (430) milli- ampere lights spaced at least twelve (12) inches on center. Sign illumination shall not result in glare being directed toward surrounding properties. The source of illumination shall not be visible from a walkway or street. b. Unless otherwise authorized by the director of community development, internally illuminated signs which use the technique known as "push through" as well as individually illuminated channel lettering or halo lighting is required. The director may allow a modification of this requirement in the interest of aesthetics or compatibility. Illumination of industrial monument signs shall not occur by the use of internally illuminated signs; externally Mumi- nated monument signs are preferred, see Section 17.40.040B. No existing tree shall be trimmed, pruned or removed from a city right -of -way to increase the visibility of any sign, unless such work is first approved.by the director of community services. G. Tracking for Wall Signs. All individual letter or channel letter wall signs shall be installed using a track system. (Ord. 199 § 1 (8110 -3), 1994) 17.40.060, Sign permit administration A. Permit Requirements. 1. Application. a. Except as expressly allowed by this chapter, no person shall authorize, erect, construct, remove (except as outlined within Section 17.40.080), alter, change, place, suspend or attach any sign within the city without first obtaining an approved sign permit from the department of community development b. The application for such sign permit should be made on the form provided by the department of community development A fee, as established by city council resolution is required to accompany each application for a sign permit 2. Consistency Review. a. An application for a sign permit will be reviewed by the director of community development or a designee for consistency with the requirements of this chapter and 365 17.40.050 " the criteria of this section. The director may approve, or conditionally approve any sign which meets the standards of this chapter. The director of community development may not approve any sign that does not meet the standards of this chapter. b. No sign permit of any kind will be issued for an existing or proposed sign unless such sign is consistent with the requirements of this chapter in every respect or is consistent with any master sign program in effect for the subject property. Any decision made by the director of community development may be appealed in accordance with the provisions of this chapter. 3. Sign Permit Tags. Every sign requiring a sign permit is required to have the permit number placed on the ap- proved sign. At the time of permit issuance, the city will issue a permit tag which is required to be permanently affixed to the lower right corner of the sign. The tag should state the permit number assigned by the city for the sign. B. Computation of Sign Area and Sign Height. 1. Individual Signs. The sign area will be measured by drawing a rectangle mound the perimeter of the lettering and/or the pictorial symbol and calculating the area of the rectangle. 2. Multifaced Signs. The sign area for a sign with more than one (1) face shall be computed by counting only one (1) face of the sign, provided the sign meets the double - sided sign requirements. If this is nof met, the face of the square footage of each side of a sign will be calculated when determining the total sign square footage for a build- ing. 3. Sign Height The height of a sign will be computed as the distance from the base of the sign at normal grade to the top of the highest attached component of the sign. Normal grade will be construed to be the lower of (a) existing grade prior to constriction; or (b) the newly estab- lished grade after construction, excluding any filling, berming, mounding or excavating solely for the purpose of locating the sign. 4. Double -Sided Signs. Any sign erected on the back of another sign must have the same exterior dimensions as the existing sign. If this is met, the sign area will be calculated based upon the square footage of one (1) side of the sign. (Ord. 199 § 1 (8110 -4). 1994) 17.40.070 Sign construction and maintenance standards. All signs should be designed, constricted and maintained (see definition in Section 17.40.020) in accordance with the following standards: A. Construction. 1. All signs are required to comply with applicable provisions of the Uniform Building Code, the Underwriters if () (- 411:1. Resolution No. 97 -1413 Page 15 but not limited to, the payment of traffic mitigation fees, which the City may implement or adopt, to fund public street improvements affected by the development. Calleguas Municipal Water District Release 45. Prior to issuance of a Building Permit, the developer shall demonstrate by possession of a District Release from the Calleguas Municipal Water District that arrangements for payment of the Construction Charge applicable to the proposed project have been made. Applicant shall be required to comply with Ventura County Waterworks Rules and Regulations, including payment of all applicable fees. 46. Prior to the issuance of a Building Permit, the applicant shall pay all school assessment fees levied by the Moorpark Unified School District, if applicable. Code Enforcement Costs 47. The Director of Community Development may declare a development project that is not in compliance with the Conditions of Approval or for some other just cause, a "public nuisance ". The applicant shall be liable to the city for any and all costs and expenses to the city involved in thereafter abating the nuisance and in obtaining compliance with the Conditions of Approval or applicable codes. If the applicant fails to pay all city costs related to this action, the City may enact special assessment proceedings against the parcel of land upon which the nuisance existed (Municipal Code Section 1.12.080). Note: Other fees may be found in the City Engineer's Conditions of Approval, further, not all fees due are listed in these conditions of approval. 48. Prior to the issuance of a Zoning Clearance, a comprehensive sign program for the entire project site shall be submitted for approval of the Director of Community Development. The sign program shall be designed to provide for a uniform on site sign arrangement and design. a. All proposed signs shall conform to the approved sign program, prior to issuance of a sign permit by the EXHIBIT 4 0oC.a: Resolution No. 97 -1413 Page 16 Director of Community Development or his designee. b. No off -site signs are permitted. C. The approved sign program for the location shall supersede the City's Zoning Ordinance. Utility Room A utility room with common access to house all meters. 49. Use of Asbestos No asbestos pipe or construction materials shall be used. 50. Utility Lines 51. All proposed utility lines within and immediately adjacent to the project site including those located on Tierra Rejada Road shall be placed underground to the nearest off -site utility pole. All existing utilities shall also be undergrounded to the nearest off -site utility pole with the exception of 66 KVA or larger power lines. This requirement for undergrounding includes all above - ground power poles on the project site'as well as those along the frontage of the site. The developer shall indicate in writing how this condition will be satisfied. Any above grade utility fixtures shall be placed adjacent to landscaped areas and screened on three sides. 52. Address numbers, a minimum of 6 inches in height, shall be installed prior to occupancy, shall be of contrasting color to the background, and be readily visible at night. Where structures are set back more than 250 feet from the street, larger numbers will be required so that they are distinguishable from the street. In the event the structure(s) are not visible from the street, the address number(s) shall be posted adjacent to the driveway entrance. 53. Address numbers will be placed on all buildings, in an obvious sequenced pattern, to be reviewed by the Police Department prior to installation. 54. If required by the Moorpark Police Department, addresses shall also be displayed on the roof in florescent orange with the numbers and street in letters a minimum of three feet in height. 00011: Resolution No. 98 -1442 Marketplace Properties Page 3 _ noise or disturbances relating to this use shall be grounds for the initiation of proceedings for revocation of this Conditional Use Permit. 5. Approval of a Sign Permit is required prior to the installation of any sign. Signs shall be limited to one line of copy. Secondary signage advertising available goods and /or services shall not be allowed. 6. The alcohol beverage display and sales area shall not occupy more than a total of 500 square feet of the gross floor area of this store which is used for sales, display an4 customer services.
