DATE: September 18, 1998 (For Special Meeting of September 23, 1998) SUBJECT: CONSIDER DESIGNATION OF VENTURA COUNTY LOCAL AGENCY FORMATION COMMISSION ( LAFCO) AS THE FINAL CONDUCTING AUTHORITY FOR THE REQUEST FOR ANNEXATION OF PROPERTY CONTAINED WITHIN SPECIFIC PLAN 8 (HIDDEN CREEK RANCH) On July 23, 1998 applications were made to the Ventura County Local Agency Formation Commission ( LAFCO) for the amendment to the City Sphere of Influence and to Annex properties within the Hidden Creek Ranch Specific Plan (SP -8) into the City of Moorpark On September 16, 1998 LAFCO conducted the public hearing to consider the Sphere of Influence change, and granted the sphere change by unanimous vote of Commissioners attending (6 -0). A hearing before LAFCO on the annexation request is scheduled for October 21, 1998. The City has received letters from 100% of the property owners within the Hidden Creek Ranch Specific Plan boundary requesting and consenting to the annexation of their properties to the City of Moorpark. With one hundred per cent consent from all the property owners, the City Council may request LAFCO to be the final conducting authority for the annexation. This would save the time and expense of having additional hearings and notice to property owners by the City. If the City Council wishes to request LAFCO to be the final conducting authority, Council should authorize the Mayor to execute a letter with that request. A draft letter is attached for Council consideration. This letter would (1) certify that 100% of the property owners consent to and request annexation, and (2) designate LAFCO as the final conducting agency for the annexation proceedings. 000025 Annexation Staff Report September 18, 1998 Page 2 The two options for the City Council consideration are: 1. Authorize the letter requesting that LAFCO be the final conducting authority, in which case their action would be final. 2. Take no action, in which case following LAFCO approval of the annexation, their action will be officially transmitted to the City, after which the City will be Annexation required to provide notice of a hearing and conduct a hearing to approve the annexation. It is hereby certified to LAFCO, that the City of Moorpark has received from 100% of the property owners within the Hidden Creek Ranch Specific Plan boundaries, their request and consent to annex their properties into the City of Moorpark. The City Council requests that LAFCO be designated as the final conducting authority for the annexation request, and requests you take appropriate actions, under governing statutes, to effect the requested annexation.
