SUBJECT: Consider Resolution Exonerating Grading and Improvements Bonds
for Meridian Hills Tract 5187 Water Tank Access Road
BACKGROUND
Grading and Improvements for the access road related to a new County Water Tank
and other infrastructure serving Tract 5187 have been completed by K. Hovnanian at
Meridian Hills, LLC. The surety bonds were issued in February 2016.
DISCUSSION
This road was required to support the construction and operation of a water tank above
the development. The bonds were required to guarantee completion. The City oversees
grading while the County oversees water work. The County required that the water tank
work be separately bonded. That work was accepted by the County, the tank is in
service, and the related bond has been exonerated by the County. The access road and
related infrastructure have been inspected and accepted by both the County Water and
Sanitation Department and City Engineer for more than a year. The County has agreed
to the exoneration of the City bonds. Staff recommends that the bonds described below
be exonerated in accordance with Moorpark Municipal Code § 16.36.010.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MOORPARK, CALIFORNIA, EXONERATING
GRADING AND IMPROVEMENTS BONDS FOR WATER
TANK ACCESS ROAD AND STORM DRAIN PLANS BY K.
HOVNANIAN AT MERIDIAN HILLS, LLC IN TRACT 5187,
MERIDIAN HILLS
WHEREAS, the City Council approved the construction of a County water tank,
access road and related infrastructure, which allowed K. Hovnanian at Meridian Hills,
LLC, to construct grading and related improvements within the City of Moorpark;
and
WHEREAS, the County Water and Sanitation Department and the City
Engineer/Public Works Director have determined that the work has been completed and
the water system has been in service for more than a year, and now recommend
that the City Council exonerate the grading and improvements bonds.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of Moorpark hereby
exonerates the Improvement and Payment Bond No. 1134432 and Grading Bond No.
1134433 for the water tank access road and storm drain plans for Tract 5187.
SECTION 2. The City Clerk shall certify to the adoption of this
resolution and shall cause a certified resolution to be filed in the book of original
resolutions.
