QQ� -i51(o , 49-1 51� qP -! 518 BY: d(. ez SUBJECT: Consider Adopting Three Resolutions Providing for Enforcement of the California Vehicle Code on Privately Owned Streets and Parking Facilities Located at 4241 Tierra Rejada Road [American Stores Properties, Inc. — Lucky Store #121 -5581, 555 -561 New Los Angeles Avenue [Moorpark Caymus Properties, LLC Blockbuster/ Starbucks Building], and 550 West Los Angeles Avenue [G & S Corporation, CPD Permit No. 97 -11 EXECUTIVE SUMMARY This presents for consideration at a public hearing, a resolution making the privately owned streets and parking facilitates located at 4241 Tierra Rejada Road [American Stores Properties, Inc. — Lucky Store #121 -558] and 555 -561 New Los Angeles Avenue [Moorpark Caymus Properties, LLC Blockbuster/ Starbucks Building], and future privately owned streets and parking facilitates located at 550 West Los Angeles Avenue [G & S Corporation, Commercial Planned Development Permit No. 97 -1] subject to certain provisions of the California Vehicle Code (CVC). DISCUSSION A. Authority The City enforces the CVC in a number of privately owned streets and parking areas on commercial/industrial property and multi - family residential developments. Enforcement of the CVC on private property requires adoption of a resolution by the local agency at the request of the property owner. B. Request The City is in receipt of a request from American Stores Properties, Inc. (Exhibit A), Moorpark Caymus Properties (Exhibit B), and G & S Corporation (Exhibit C), that the Vehicle Code be enforced in streets and parking lots on their property. The and G & S Corporation facility has not yet been constructed, but will contain privately owned and maintained roads and off street parking facilities in the future. 6QGOW4 C. Notice As required by the CVC, a notice of this Public Hearing was sent to all property owners. RECOMMENDATION Staff recommends that the City Council take the following actions: Adopt Resolution No. 98- (Exhibit 1) making the CVC applicable to certain private roads and parking facilities upon the commercial property located at 4241 Tierra Rejada Road [American Stores Properties, Inc. — Lucky Store #121 -558]. 2. Adopt Resolution No. 98- (Exhibit 2) making the CVC applicable to certain private roads and parking facilities upon the commercial property located at 555 -561 New Los Angeles Avenue [Moorpark Caymus Properties, LLC Blockbuster/ Starbucks Building]. 3. Adopt Resolution No. 98- (Exhibit 3) making the CVC applicable to certain private roads and parking facilities upon the future commercial property located at 550 West Los Angeles Avenue [G & S Corporation, Commercial Planned Development Permit No. 97 -1]. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That, pursuant to CVC Sec. 21107.6, the privately owned and maintained access roads located at 4241 Tierra Rejada Road, as generally shown on Exhibit '1', which are generally held open to the public for the purpose of vehicular travel to serve commercial establishments, shall be subject to the provisions of the CVC. SECTION 2. That, pursuant to CVC Sec. 21107.8, the privately owned and maintained parking facilities located at 4241 Tierra Rejada Road, as generally shown on Exhibit '1', which are generally held open for use by the public for vehicular parking, shall be subject to Section 22350, 23103, 23109 and Division 16.5 (Section 3800 et. seq.) of the CVC. �0G'U25 Resolution No. Page 2 SECTION 3.
