BACKGROUND: At the July 6 and September 8 meetings, the Parks and Recreation Commission reviewed the City documents governing park rentals and made several recommendations for City Council consideration. This report serves to summarize and explain the Commission's recommendation. The City Council is being asked to adopt an ordinance (Attachment A) which amends the Municipal Code as it relates to the use of City Parks. Council is also being asked to rescind and replace Resolution No. 86 -351 (Rules and Regulations Governing the Use of Facilities in the Public Parkland) and Resolution No. 93 -950 (Adopting a Park Reservation Fee Schedule). The proposed resolution (Attachment C) reflects recommended updates to the Parks Rules and Regulations, group classifications and fee schedule. DISCUSSION: The Municipal Code Revisions The Parks and Recreation Commission and staff have reviewed the sections of the Municipal Code related to parks (Chapter 12.16) along with current park rental issues, and developed some recommendations for an amendment to the Code. The recommended amendments to the Municipal Code are presented in legislative format in Attachment B. These amendments are described below. In some cases, these large drop -in gatherings impact permitted gatherings, organized activities and maintenance operations. Occasionally these gatherings result in property damage and /or require excessive cleanup by City staff. Requiring large groups to obtain a rental permit would assist in two ways: 1) It would serve to notify the City when a large group plans to hold a gathering in a park so that any necessary arrangements or adjustments can be made, and 2) The City would collect a nominal fee that would go to offset wear and tear of park amenities. Therefore, it is recommended that the Municipal Code be amended to require that groups of over seventy -five (75) people obtain a permit. Require Permits for Attractions: Currently, the Municipal Code is silent on the issue of using attractions in City parks. However, attractions, in conjunction with a park rental, create particular problems and require special handling. For example, dunk tanks, moonbounces and mechanical rides can damage the turf. Pony rides can result in unsanitary conditions. Often attraction vendors ignore City cautions about driving across the grass, resulting in damaged irrigation systems and turf. Therefore, it is proposed that permits be required for individuals planning to include special attractions at their events. The permit to use an attraction at a City Park would be combined with the Park Rental Permit and would address any restriction that may be imposed. Additionally, insurance may be required for some attractions. Clarification Amendments: In addition to the aforementioned Code amendments, there are several minor Code changes being presented for Council consideration. The proposed changes include adding language to the section that addresses park hours, indicating that the public shall not enter or remain in a park after hours without authorization; adding hazardous waste to the items that are prohibited in parks; and striking language concerning alcoholic beverages, which is consistent with State law. Staff further recommends amending Section 12.16.120 for the purposes of clarification. The recommended change takes the existing section and splits it in two, establishing a section which addresses fireworks and weapons and creating a separate section which addresses other prohibited activities. Resolution Restructuring The City's Park Rules and and outline guidelines an, Recreation Commission and Regulations and recommend adopting a new resolution HCC Park Rules Review Page 2 of 4 Regulations are established by Resolution i fees for the use of parks. The Parks and staff reviewed the Park Rules and rescinding Resolution No. 86 -351 and (Attachment C). The new resolution serves to .,r�hAr's c, restructure and make amendments to the Park Rules and Regulations, update group classifications and revise the fee schedule. These amendments are described below. Administrative Revisions: Administrative changes recommended to the Park Rules and Regulations include adding language that limits the ability to rent a City Park to individuals 21 years of age and older; amending the advance rental window from 60 to 90 days prior to the event; extending the City Manager's period to review a refund deductions, permit revocation or additional fees from three (3) to five (5) days; citing City Council as the mediation authority; and requiring a $100 deposit for groups of over seventy -five people to offset additional maintenance demands created by large groups. Furthermore, staff is recommending adding a section referencing year -end school parties. Each year the City is contacted by teachers and classes from Moorpark schools to reserve park space to hold year -end parties. Currently there is no policy for handling these requests, and it is proposed that one be established. Staff recommends setting a fee of $5 per hour for each 40 persons attending. Currently the City is charging $5 per hour regardless of the number of students. Staff also recommends that the schools should be required to provide a supervision ratio of no less than 1:20, and ensure that the facility is cleaned after use. Because of size, limited parking and other constraints, it is also recommended that permitted attractions be restricted to certain parks. It is proposed that the use of attractions be limited to Arroyo Vista Community Park, Peach Hill Park, Griffin Park and Poindexter Park parking lots. Ponies should be restricted to the Arroyo Vista Community Park parking lot. Classification of Groups: Staff is proposing changes in the classification of groups to provide better consistency between the park rental and the facility (building) rental classifications. The proposed reclassification provides for park rentals by other government agencies as well as residents within the MUSD boundaries. A classification for for - profit activities is also proposed. These recommendations reflect a broadening of the park rental classifications. In the current fee schedule, groups are further classified by the intended size of the gathering in increments of 50. This proposal simplifies the procedure by levying a fee for large groups that reflects the increased maintenance demands generated by larger groups. The amended classifications are outlined in legislative format in Attachment D. Fee Schedule Revision: Staff is proposing a number of changes to the fee schedule including updating the fees for softball lights, HCC Park Rules Review Page 3 of 4 v®o22 b diamond preparation, tennis court rental, multipurpose court rental and the rental of amenities such as the softball bases, soccer goals and horse shoes. The fee schedule was also updated to include a listing of required deposits and additional charges. Attachment E is a matrix that compares the proposed fees with the current fees. The recommended fee changes are consistent with the rental fees charged in surrounding communities for similar park amenities. RECOMMENDATION: The Parks and Recreation Commission and staff recommend that the City Council introduce for the first reading Ordinance No. amending Chapter 12.16 Parks of Title 12, Streets, Sidewalks & Public Places in the Municipal Code and approve Resolution No. 98- adopting revised Park Rules and Regulations Governing the Use of the Facilities in Public Parkland, group classifications and fee schedule. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MOORPARK AMENDING CHAPTER 12.16, PARKS OF TITLE 12, STREETS, SIDEWALKS & PUBLIC PLACES, OF THE MOORPARK MUNICIPAL CODE WHEREAS, Chapter 12.16, Title 12 of the Moorpark Municipal Code set forth the requirements for City Parks; and WHEREAS, the City Council determined that Sections 12.16.010 (Hours of operation), 12.16.030 (Littering prohibited), 12.16.040 (Alcoholic beverages prohibited) and 12.16.120 (Fireworks and weapons prohibited)of the Moorpark Municipal Code should be amended to clarify the Municipal Code; and WHEREAS, the City Council determined that Sections 12.16.140 (Requirement and enforcement of park rental permits), 12.16.150 (Requirement and enforcement of attraction permits) and 12.16.160 (Other prohibited activities) should be added to refine park rental procedures and further clarify the Municipal Code; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Section 12.16.010 (Hours of operation), 12.16.030 (Littering prohibited), 12.16.040 (Alcoholic beverages prohibited) and 12.16.120 (Fireworks and weapons prohibited) of the Moorpark Municipal Code are hereby amended in their entirety to read as follows: 12.16.010 Hours of operation. No person shall enter or remain in any public park, open space or recreation grounds during the hours of ten (10:00) p.m. to six (6:00) a.m. without the authorization of the City Manager or his /her designee. 12.16.030 Littering prohibited. No person shall drop or deposit refuse, trash, hazardous waste, contaminants or litter in any public park, open space or recreation grounds, except in receptacles provided therefor, nor place in said receptacles any refuse brought from private property. No person shall consume any alcoholic beverages in any public park, open space or recreation grounds, except as permitted within the Community Center Building with the issuance of appropriate city permits. 12.16.120 Fireworks and weapons prohibited. No person shall discharge any firearm, airguns, slingshots firecrackers, rockets, torpedoes or other fireworks in any public park, open space or recreational grounds except in areas specifically designated for such purposes. SECTION 2. Sections 12.16.140 (Requirement and enforcement of park rental permits), 12.16.150 (Requirement and enforcement of attraction permits) and 12.16.160 (Other prohibited activities)shall be added to the Moorpark Municipal Code to read as follows: 12.16.140 Requirement and Enforcement of Park Rental Permits. The City rents portions of its parks and park facilities. The City has the ability to deny and enforce park and facility rental permits. No person shall interfere with an authorized permitted rental of a City park or park facility. No person or group shall hold a gathering at a City park which exceeds seventy -five (75) people in attendance without first obtaining a permit for said gathering from the City. 12.16.150 Requirement and enforcement of attraction permits. No person or group shall locate attractions on City property without obtaining a City issued permit. Attractions include, but are not limited to, pony rides, dunk tanks, mechanical rides and moon bounces. 12.16.160 Other prohibited activities. No person shall engage in the activities of golf, archery, motor driven model airplane flying or rocketry in any public park, open space or recreation grounds except in areas specifically designated for such purposes. SECTION 3. If any section, subsection, sentence, clause, phrase, part or portion of this Chapter is for any reason held to Ordinance: Park Rules & Regulations Page 2 of 4 (J®023 AN be invalid or unconstitutional by any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Chapter. The City Council declares that it would have adopted this Chapter and each section, subsection, sentence, clause, phrase, part or portion thereof, irrespective of the fact that any one or more section, subsections, sentences, clauses, phrases, parts or portions be declared invalid or unconstitutional. No person shall engage in boisterous, threatening, abusive, insulting or indecent language or engage in any disorderly conduct or behavior tending to a breach of the peace and interfering with the enjoyment or other persons in any public park, open space or recreation grounds. 12.16.070 Duplicating keys prohibited. No person shall duplicate keys used by the city for padlocks, door locks or locks of any type. 12.16.080 Camping and lodging prohibited. No person shall loiter, camp or lodge in any public park, open space or recreation grounds. 12.16.090 Vending prohibited. No one shall vend any food, merchandise or product in any public park, open space, or recreation grounds without having authorization of the city manager or designated representative and secured his consent thereto in writing. 12.16.100 Fire control. No person shall make or kindle a fire for any purpose, except in places designated therefor, in any public park, open space or recreation grounds. A person starting a fire in an authorized place shall be responsible for assuring that the fire is thoroughly extinguished. 12.16.110. Damaging of property prohibited. No person shall cut, break, injure, tamper with, deface, remove or disturb any tree, shrub, plant, rock, building, wall, fence, bench, sign structure, apparatus or property in any public park, open space or recreation grounds. 12.16.120 Fireworks and weapons prohibited. No person shall Municipal Code Page 2 of 3 00023fa operate, ride or drive an automobile, bicycle, motorcycle, truck, trailer, wagon, motor scooter, animal or other conveyance on other than roads or paths designated for that purpose in any public park, open space or recreation grounds. Only city- authorized vehicles are allowed to use the maintenance roads in city parks and properties, unless the road is designated for that purpose. A bicyclist may wheel or push a bicycle over any grassy area, or trail or path reserved for pedestrian use. No motor vehicle, animal or other conveyance shall be parked or fastened in other than an established or designated parking or hitching area in any public park, open space or recreation grounds. No person shall roller- skate, roller -blade or skateboard on other than sidewalks or paths designed for pedestrians. No person shall roller- skate, roller -blade or skateboard on court surfaces intended for other sport activities designated and posted by the city for that purpose. All conveyances shall at all times be operated, driven, or ridden with reasonable regard to the safety of others in any public park, open space or recreation grounds, and furthermore engage in the activity at their own risk. 12.1.6.140 Requirement and Enforcement of Park Rental Permits. Municipal Code Page 3 of 3 000237 Attachment C RESOLUTION NO. 98- A RESOLUTION OF THE CITY OF COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA RESCINDING RESOLUTION NO. 86-351 (RULES AND REGULATIONS GOVERNING THE USE OF FACILITIES IN THE PUBLIC PARKLAND) AND RESOLUTION 93 -950 ADOPTING A PARK RESERVATION FEE SCHEDULE; AND ADOPTING REVISED RULES AND REGULATIONS GOVERNING THE USE OF THE FACILITIES IN PUBLIC PARKLAND, GROUP CLASSIFICATIONS AND FEE SCHEDULE. WHEREAS, a Parks and Recreation Commission Ad Hoc Committee has recommended revisions to the Rules and Regulations Governing the Use of the Facilities in Public Parkland, group classifications and fees; and WHEREAS, at its meeting of October 21, 1998 the City Council considered and concurred with the Parks and Recreation Ad Hoc Committee recommendations; and WHEREAS, City Council Resolution No. 86 -351 (Rules and Regulations Governing the Use of Facilities in the Public Parkland) and Resolution No. 93 -950 (Adopting a Park Reservation Fee Schedule) shall be rescinded and replaced with the Resolution herein; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA DOES RESOLVE AS FOLLOWS: SECTION 1. City Council Resolution No. 86 -351 (Rules and Regulations Governing the Use of Facilities in the Public Parkland) and Resolution No. 93 -950 (Adopting a Park Reservation Fee Schedule) are hereby rescinded and replaced with the Resolution herein. SECTION 2: The general provisions of the Rules and Regulations Governing the Use of the Facilities in Public Parkland shall read as follows: 2.1 Purpose The purpose and intent of the City Council in adopting the within Rules and Regulations Governing the Use of the Facilities in Public Parkland shall be to provide directory guidelines for staff and the public relating to the use and rental of City park facilities. In the event of any non - compliance with, or violation of, any provision herein, such shall not be deemed to affect the validity of any action taken, unless otherwise specifically provided by law. 2.2 Enforcement Parkrules.reso Page 1 of 10 ,rlk&-.W-A.'�r , The City Manager or his/her designee is hereby authorized to implement and administer the policies and regulations contained herein. 2.3 Hours All parks and park facilities operated by the City are available for public use from 6:00 am to 10:00 pm. Softball, basketball or other field lights are not available after 10:00 pm. The parks are closed from 10:00 pm to 6:00 am. Parks and park restrooms shall be closed in the event of inclement weather. 2.4 Rental Applications Park facilities are available for the reservation and use of individuals or groups subject to the issuance of a permit and payment of fees. All applications must be signed by an adult of 21 years or older who shall agree to be responsible for said use. Permits are immediately revocable if false statements are made in reserving a facility or if an individual or groups willfully violates any rule or regulation established by the City. Fees shall be retained in the event the activity is terminated due to the violation of any rule or regulation, or the falsification of the application. Applications may be made up to 90 days prior to the event. Groups of over seventy -five people are required to obtain a permit and make a deposit to cover damage caused by the rental. 2.5 Deposits A refundable deposit may be required for an activity to be held in a public park facility. The deposit may be retained for clean up of facilities, any damage to the premises and any additional staffing not included in the fees paid. Should charges exceed the amount of deposit, the permittee shall be billed for the difference and allowed thirty (30) days in which to make payment. 2.6 Additional Charges Additional charges may be levied beyond the basic rental rate if staff is needed to set up or clean up, or if the facility is damaged. Additionally, permittee must provide liability insurance for certain types of attractions such as pony rides or moonbounces. 2.7 Refunds and Credits Park permit fees are non - refundable except for cancellations due to inclement weather. Such conditions include rain, fog, wind, or temperatures below 55 ° Fahrenheit or above 95 ° Fahrenheit. In the event of illness, unexpected absence or accidental overbooking, permittees are eligible for a credit for a future rental up to the amount paid. It is the responsibility of the permittee to contact the City of Moorpark to cancel the reservation Parkrules.reso Page 2 of 10 00023 and request a credit before the rental date. Failure to do so will negate any consideration for a credit or rescheduling. 2.8 Requesting a Reduction or a Waiver Of Fees A non - profit organization may request a reduction or a waiver of fees for the use of City park facilities by forwarding the request in a letter form to: Director of Community Services 799 Moorpark Avenue Moorpark, CA 93021 All requests should include the organization's non - profit number as well as the name of the organization, purpose of the gathering, expected attendance, requested facility, time and date. All requests will be considered on a case by case and a first - come /first- served basis and depend upon facility availability. Teachers or classes within Moorpark Unified School District may request the use of park facility for a year -end party provided the responsible party guarantees a supervision ratio of no less than 1:20, and ensures that the facility is cleaned after use. The fee for such a use is $5 per hour for each 40 persons attending. Waivers or reductions in fees cannot exclude clean up or repair costs. A deposit may be required. All other park rules and ordinances apply. The City reserves the right to deny any such request. 2.9 Right of Appeal A permittee has the right to appeal the decision by City staff to revoke a permit, levy additional charges and/or deduct a portion of a deposit. An appeal must be filed in writing to the City of Moorpark, 799 Moorpark Avenue within five (5) days of receiving your notification. The City Manager or his/her designee will affirm or deny the appeal in five (5) days. Any further appeal must be made in writing to the City Council within ten (10) days upon notification of the decision on the appeal. Such appeal shall be considered at the next regularly scheduled meeting of the City Council. 2.10 Liabili In order to rent a City facility, the permittee must agree in writing to hold the City harmless and indemnify the City from liability for injury to persons or property occurring as a result of the activity. The permittee also agrees to be liable to the City for damage to the park, equipment, buildings or facilities caused by any person at the activity. The City reserves the right to deny any such request. 2.12 Use of Special Attractions Activities that create loud or distracting noises are not permitted. Activities that include amplified sound require a special permit. Moonbounces and other such inflatable attractions are only allowed at Arroyo Vista Community Park, Peach Hill Park, Griffin Park and Poindexter Park. Such devices are restricted to the parking lot and may not be placed on the turf. Violators may be fined for damage to landscaping, sprinklers and/or turf as applicable. The City requires that a Certificate of Insurance be filed in advance. Pony rides are only allowed at Arroyo Vista Community Park, and are restricted to the parking lot. Ponies are not allowed on the turf. Violators may be fined for damage to landscaping, sprinklers and/or turf. Pony rides may be restricted during certain seasons. The City requires that a Certificate of Insurance and a deposit of $100 be filed in advance. Persons planning to have such an attraction at their event MUST notify the City of Moorpark before the event. 2.13 Complaints Your complaints and comments are welcome.
