Nowak, Assistant City Manager BMW ' 07 October 1998 (Council meeting of 10- 21 -98) SUBJECT: Consider Joint Resolution 98- with the Ventura County Board of Supervisors Agreeing to the Negotiated Exchange of Property Tax Revenues for Transfers of Service Responsibilities and Boundary Changes between the County and the City. Discussion: The California Revenue and Taxation Code requires that before and jurisdictional changes take place the affected agencies reach an agreement on the amount of property tax revenues to be exchanged. The City of Moorpark has not entered into a permanent agreement with Ventura County on this matter, which is required before any annexations can take place. The attached joint resolution presented for the Council's consideration would provide that fourteen and sixty -six hundredths percent (14.66 %) of the property tax collected by the County in any area to be annexed would be allocated to the City beginning with the fiscal year the boundary change becomes effective. This would apply to all future city annexations that may take place and is the same as the agreements with other cities in the County. If any other jurisdictional changes occur concurrently with an annexation, the tax allocations would be negotiated separately. The resolution does allow for the City or County to terminate the agreement if there is a change in State law altering property tax allocations, or for any other reason. 0®02(`y Joint Resolution on Exchange of Property Tax Revenues. Attachment: Resolution No. 98- (x®020 RESOUTION NO. 98- A JOINT RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF VENTURA AND THE CITY COUNCIL OF THE CITY OF MOORPARK AGREEING TO THE NEGOTIATED EXCHANGE OF PROPERTY TAX REVENUES FOR TRANSFERS OF SERVICE RESPONSIBILITIES AND BOUNDARY CHANGES BETWEEN THE COUNTY AND CITY. WHEREAS, Section 99 of the Revenue and Taxation Code (Stats. 1997, ch. 692, Sec 2) requires that, prior to the effective date of any jurisdictional change, all agencies whose service area or service responsibilities would be altered by such change shall determine the amount of property tax revenues to be exchanged between and among such affected agencies, and WHEREAS, it is specified that such jurisdictional change shall become effective only after each affected county and city agrees by resolution to accept a negotiated exchange of property tax revenues; and WHEREAS, in the event a the service area or service special districts, the Board in which such districts are exchange of property tax districts; and jurisdictional change affects responsibility of one or more of Supervisors of the county located shall negotiate any revenues on behalf of the WHEREAS, the adopting agencies shall notify the County Auditor who shall adjust the amount of property tax revenues determined for each local agency whose service area or service responsibility would be altered by such jurisdictional change. NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED as follows: Section 1. For territory annexed to the City of Moorpark a portion of the County's share of property tax revenue shall be transferred to the City; this amount shall be equal to 14.66% of the amount of property tax revenue allocated to the County from the annexation area beginning with the fiscal year the jurisdictional change becomes effective. `V0Q01-1 11 Section 2. This agreement shall apply to all pending and future City boundary changes and shall be in effect until terminated by either party as provided in Section 3 herein. Termination of this agreement shall not affect the percentage share of property tax revenue transferred to the City on any completed annexations at the time of such termination. Section 3. If any state law is enacted or becomes effective after the date of this agreement which would or could alter the percent of property tax allocated to the City in conjunction with jurisdictional changes, or for any other reason, either the City or the County may terminate this agreement upon five (5) days written notice to the other party, provided copies of such notice are concurrently submitted to the Local Agency Formation Commission and the County Auditor - Controller. Section 4. If there are other jurisdictional changes which occur concurrently with the annexation of territory to the City (such as detachments or annexations to special districts not mentioned in this resolution), the exchange of property tax revenues in conjunction with those jurisdictional changes shall be subject to separate tax exchange agreements. Section 5. An executed copy of this resolution shall be submitted to the County Auditor - Controller who shall make appropriate adjustments as provided in subdivision (a) of Section 99 of the Revenue and Taxation Code. Section 6. An executed copy of this resolution shall be submitted to the Ventura Local Agency Formation Commission. Nowak, Assistant City Manager l DATE: 19 October 1998 RE: Modification to Resolution - Join Resolution on Property Tax Exchange At its October 21 meeting the City Council will be considering a joint resolution agreeing to a negotiated exchange of property tax revenues with the County of Ventura (Item #11 K). At the request of the City Attorney, the "resolve clause" has been modified to read "Now, Therefore, the City Council of the City of Moorpark does resolve, determine and order as follows:" All other wording in the resolution remains the same as was in the agenda packages. Since this is a di minimus modification, the City Clerk will substitute the resolution and no specific action is required by the Council to replace the wording.
