SUBJECT: Consider Adopting Three Resolutions Providing for
Enforcement of the California Vehicle Code on Privately
Owned Streets and Parking Facilities Located at 6190
Condor Drive [J &L Industrial Investments, LLC - Lot 1,
Tract 3492], 6176 Condor Drive and 6144 Condor Drive
[F&A Industrial Investments, LLC - Lots 2 and 3, Tract
3492], and 14500 White Sage Road [Special Devices
Incorporated, Vesting Tentative Map No. 50041
EXECUTIVE SUMMARY
This presents for consideration at a public hearing, a resolution
making the future privately owned streets and parking facilitates
located at 6190 Condor Drive [J &L Industrial Investments, LLC - Lot
1, Tract 3492], 6176 Condor Drive and 6144 Condor Drive [F &A
Industrial Investments, LLC - Lots 2 and 3, Tract 3492], and 14500
White Sage Road [Special Devices Incorporated, Vesting Tentative
Map No. 50041 subject to certain provisions of the California
Vehicle Code (CVC).
DISCUSSION
A. Authority
The City enforces the CVC on a number of privately owned streets
and parking areas on commercial /industrial property and multi-
family residential developments. Enforcement of the CVC on
private property requires adoption of a resolution by the local
agency at the request of the property owner.
B. Request
The City is in receipt of a request from Felsenthal Property
Management, Inc. (Exhibit A) and Ball Properties (Exhibit B)

that the Vehicle Code be enforced on future streets and parking
lots on their respective properties. These facilities have not
yet been constructed, but will contain privately owned and
maintained roads and off street parking facilities in the
future.
C. Notice
As required by the CVC, a notice of this Public Hearing was sent
to all affected property owners.
RECOMENDATION
Staff recommends that the City Council take the following actions:
1. Adopt Resolution No. 98- (Exhibit 1) making the CVC
applicable to certain private roads and parking facilities upon
the future industrial property located at 6190 Condor Drive [J &L
Industrial Investments, LLC - Lot 1, Tract 3492].
2. Adopt Resolution No. 98- (Exhibit 2) making the CVC
applicable to certain private roads and parking facilities upon
the future industrial property located at 6144 Condor Drive and
6176 Condor Drive [F &A Industrial Investments, LLC - Lots 2 and
3, Tract 34921.
3. Adopt Resolution No. 98- (Exhibit 3) making the CVC
applicable to certain private roads and parking facilities upon
the future industrial property located at 14500 White Sage Road
[Special Devices Incorporated, Vesting Tentative Map No. 5004].

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, FINDING AND DECLARING
CERTAIN FUTURE PRIVATE ROADS AND PARKING
FACILITIES LOCATED AT 6190 CONDOR DRIVE [J &L
INDUSTRIAL INVESTMENTS, LLC - LOT 1, TRACT
34921, SUBJECT TO PROVISIONS OF THE CALIFORNIA
VEHICLE CODE
WHEREAS, Section 21107.6 of the California Vehicle Code (CVC)
allows for the enforcement of said Code upon privately owned and
maintained roads generally held open to the public for purposes of
vehicular travel to serve commercial/ industrial establishments;
and,
WHEREAS, Section 21107.8 of the CVC allows for the enforcement
of CVC Section 22350, 23103, 23109 and Division 16.5 (Section 38000
et. seq.) upon privately owned and maintained off street parking
facilities which are generally held open for use by the public for
vehicular parking; and,
WHEREAS, the owner(s) of the property located at 6190 Condor
Drive, as generally depicted on Exhibit '1', attached hereto and
made a part hereof, has requested that the provisions of the CVC be
enforced upon the future privately owned roads and parking
facilities; and,
WHEREAS, pursuant to the requirements of said Code, a public
hearing has been held on the matter and the owner of the affected
property was notified of said hearing at least ten (10) days prior
to the date thereof.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That, pursuant to CVC Sec. 21107.6, the privately
owned and maintained access roads to be constructed at 6190 Condor
Drive as generally shown on Exhibit '1', which are generally held
open to the public for the purpose of vehicular travel to serve
industrial establishments, shall be subject to the provisions of
the CVC.
SECTION 2. That, pursuant to CVC Sec. 21107.8, the privately
owned and maintained parking facilities to be constructed at 6190
Condor Drive as generally shown on Exhibit '1', which are generally
