SUBJECT: Consider the Design and Construction Specifications
for the AVCP Lighted Tennis Courts and Authorize
Retention of Picon for Project Management

On May 29, 1998, the City Council approved the conceptual design
for the eight lighted tennis courts at AVCP. Additionally, the
Council approved a construction phasing plan that was intended
to insure that the minimal improvements necessary to make the
tennis court functional, were constructed within the budget
allocated to complete the project. The City Council is now
being asked to approve the plans and construction specifications
(a full set was provided to the City Council under a separate
memo), authorize the distribution of the bid document, and
authorize the retention of Picon for construction management.
As the Council may recall, to date a total of $352,000 has been
committed towards the construction of the tennis courts;
$176,000 from both the City and the Moorpark Unified School
District. Of that amount, the City entered into a contract with
a landscape architect to design the courts at a cost of $10,000.
An additional $2,000 was spent on a soils test, leaving $340,000
to construct the courts.
The conceptual plan approved by the City Council places the
courts in sets of four, divided by the existing mature black
walnut tree (Attachment A). The initial cost estimates for the
Plan, including all improvements and amenities such as hardscape
(concrete walk ways), landscaping, fencing, court lighting,
shelters, bleachers, benches, two drinking fountains, and
security lights is approximately $471,000.

To meet the existing budget, the Council approved a construction
phasing plan (Attachment B). Phase I ($328,066) includes only
work that is necessary to initiate play on the courts including:
construction of the courts, installation of lights and fences,
court striping, and grading and drainage work. Additionally,
Phase I would include some minimal preparation work for items
that are to be constructed in Phase II when doing so will save
future costs such as plumbing for electrical and water. Phase
II ($142,851) includes additional hardscape, landscape and other
amenities desirable at a tennis court complex including:
drinking fountains, bleachers, concrete walkways, court wind
screens, and security lighting. Copies of the plans and
specifications were provided to MUSD and the Moorpark Tennis
Club for review and comments.
The bid document developed by staff identifies Phase I as the
base bid, and breaks Phase II down further into three bid
alternates: Alternate #1 includes drinking fountains, seat
walls, and concrete paving; Alternate #2 includes picnic tables,
bleachers and trash receptacles; and Alternative #3 includes
landscaping and irrigation. Breaking out the various
components of Phase II provides the City with the flexibility to
add components depending on the final costs.
The bid document will be advertised and distributed to
interested contractors. Completed proposals will be due to the
City four weeks after the bid document is made available. A
complete bid document was distributed to the City Council under
a separate memo.
Construction Management
As with other public works projects, the City needs to retain
qualified construction management services. To that end, the
City received a proposal from Picon to provide construction
management services for the tennis court project. Picon, headed
by Mr. Phil Vein, has performed similar services for the City on
a number of projects; e.g., AVCP and Recreation Center, and
Poindexter Park, and is qualified to provide management services
for the construction of lighted tennis courts. The proposal was
submitted at a cost not to exceed $13,995 (approximately 4% to
the total project cost) and includes, but is not limited to, the
administration of the construction contract, attendance at the
pre -bid conference, field visits during construction, review and
approval of construction contract payments, and the preparation
of any change orders.

Picon charges $65 per hour, which is considerably less than
Abbott's hourly rate and the hourly rate charged by the
landscape architect firm that is designing the courts. Staff
recommends that the City secure the services of Picon for
construction management of the tennis court project. If the
City were to spend up to the maximum for construction management
($13,995), the total estimated cost of the project (Phase I) to
date would be $351,995. This amount is broken down as follows:
project design, $10,000; Phase I construction, $328,000; and
construction management, $13,995. To date, $352,000 has been
committed to the project ($176,000 from both the City and MUSD).
Recommendation
Staff recommends that the City Council approve the plans and
specifications for the construction of the eight lighted tennis
courts at AVCP; authorize staff to proceed with distribution of
the bid documents; and authorize the City Manager to sign an
agreement with Picon, at a cost not to exceed $13, 995, for
construction management services.
