DISCUSSION an Easement Deed upon between Tierra Rejada the Ventura County the water main serving the Road the One of the conditions of approval for the development of the Mountain Meadows Planned Community was the conveyance to the City of the Arroyo Vista Community Park property (and access road) , complete with all utilities. In addition to conveying the park property to the City, the developer constructed the park access road. That project included the extension of all utilities to the east end of the park access road. In that the park access road is not a public street (it is an appendage of the park) the typical utility franchise provisions for the placement and maintenance of utilities within the street right - of -way, do not apply. All of the utilities within the park access road require easements. The City was recently advised that the developer did not grant a water easement to VCWWD #1 prior to the conveyance of the park access road to the City. It is necessary, therefore, for the City to grant such an easement. The developer, with the assistance of the County of Ventura, has prepared the subject easement for execution by the City.
