OF CERTAIN PROPERTY INTO THE CITY OF MOORPARK;
AND CONSIDER RESOLUTION NO. 98- MAKING
APPLICATION TO LAFCO TO UNDERTAKE PROCEEDINGS FOR
AMENDMENT TO THE CITY'S SPHERE OF INFLUENCE; AND
CONSIDER RESOLUTION NO. 98- AMENDING THE
CITY'S OPERATING BUDGET TO FUND APPLICATION COSTS
TO LAFCO.
BACKGROUND: In March 1996 the City of Moorpark entered
into a Cooperative Agreement with the County of Ventura for
the installation of a temporary traffic control signal
system at the intersection of Tierra Rejada Road and
Moorpark Road. As part of that signal project the City of
Moorpark acquired some land that was outside the City's
corporate limits. The Agreement required the City to
initiate proceedings to bring all of the affected land
within the city limit line.
DISCUSSION: To fulfill the Agreement with the County of
Ventura for the installation of the traffic control signal
system at Tierra Rejada Road and Moorpark Road, the City
must make application to the Ventura Local Agency Formation
Commission ( LAFCO) for both an annexation of the affected
property into the City and for an extension of the City's
Sphere of Influence to include the property. A notice of
intent to file these resolutions has been submitted to the
County of Ventura.

The property in question totals 0.4187 acres and is located
in the southwest corner of the intersection. All of the
land is part of the Tierra Rejada Road right -of -way. LAFCO
requires a formal application from the City for both
actions (see attached map). The first step is for the City
Council to adopt the two resolutions that are being
presented to initiate the process. A formal application
form with required map and fees will be ready to submit to
LAFCO at the end of January. (The time is required to
obtain the required environmental clearance.)
There will be fees totaling $1,250 required for the
applications. In addition, staff estimates $500 will be
needed for preparation of maps and other application
materials. The proposed resolution will appropriate $1,750
from the Tierra Rejada /Spring Road Area of Contribution
Fund for these costs.
STAFF RECOMMENDATION: That the City Council: (1) Adopt
Resolution No. 98- making application to the Ventura
Local Agency Formation Commission to take proceedings for
the annexation of certain property into the City of
Moorpark; (2) Adopt Resolution No. 98- making
application to the Ventura Local Agency Formation
Commission to take proceedings for the amendment of the
City of Moorpark's sphere of influence; and (3) Adopt
Resolution No. 98- amending the FY 1998 -99 Operating
Budget to appropriate $1,750 from the Tierra Rejada /Spring
Road Area of Contribution Fund. (ROLL CALL VOTE REQUIRED)

RESOLUTION NO. 98-
A RESOLUTION OF THE CITY OF MOORPARK, CALIFORNIA,
MAKING APPLICATION TO THE VENTURA LOCAL AGENCY
FORMATION COMMISSION TO TAKE PROCEEDINGS FOR THE
ANNEXATION OF CERTAIN PROPERTY INTO THE CITY OF
MOORPARK.
WHEREAS, the City of Moorpark acquired certain land
for the construction of Tierra Rejada Road, some of which
was located outside the corporate boundaries of the City
of Moorpark; and
WHEREAS, pursuant to a Cooperative Agreement with the
County of Ventura in March 1996 the City agreed to
commence proceedings to adjust the city limits to
incorporate the right -of -way south of Tierra Rejada Road;
and
WHEREAS, the 0.4187 acres of property to be annexed
is totally within the right -of -way of Tierra Rejada Road
and impacts no developable land; and
WHEREAS, the City of Moorpark desires to initiate
proceedings pursuant to the Local Government
Reorganization Act of 1985, commencing with Section 56000
of the California Government Code, to annex said property
into the City of Moorpark; and
WHEREAS, notice of intent to adopt this resolution of
application has been given to each interested and subject
agency; and
WHEREAS, the Council certifies that the proposed
annexation is categorically exempt from the State of
California Environmental Quality Act (CEQA) pursuant to
Categorical Exemption, Class 19; and
WHEREAS, the proposed annexation is consistent with
the City's General Plan.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
MOORPARK DOES HEREBY RESOLVE AS FOLLOWS:

SECTION 1. The City Council of the City of Moorpark
requests the Ventura Local Agency Formation Commission to
undertake proceedings pursuant to the California
Government Code for the annexation of certain property
indicated on the map attached hereto and made a part
hereof into the corporate boundaries of the City of
Moorpark.

RESOLUTION NO. 98-
A RESOLUTION OF THE CITY OF MOORPARK, CALIFORNIA
AMENDING THE FY 1998/99 BUDGET TO APPROPRIATE
FUNDS FROM THE TIERRA REJADA /SPRING ROAD AREA OF
CONTRIBUTION FUND FOR APPLICATIONS COSTS
PERTAINING TO ANNEXATION OF A CERTAIN PARCEL
WITHIN THE CITY.
WHEREAS, on June 17, 1998 the City Council adopted the
Budget for Fiscal Year 1998 -1999; and
WHEREAS, a staff report has been presented to said
Council describing the costs associated with annexing a
certain parcel at Tierra Rejada Road and Moorpark Road into
the City; and
WHEREAS, Exhibit "A" hereto describes said budget
amendment and resultant impacts to the current budget.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
MOORPARK DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. A budget amendment in the amount of
$1,750 be appropriated from the Tierra Rejada/ Spring Road
Area of Contribution Fund to the Administrative Services
Department - Other Contractual Service (Division 500), as
more particularly described in Exhibit "A" attached hereto
and made a part hereof.
