Subject: Consider Requests from the Moorpark Unified School
District (MUSD) for the City to Administer the
Caltrans /MUSD Project for the Construction of a Traffic
Signal and Related Improvements at the Intersection of
Casey Road and Walnut Canyon Road (State Route 23)
DISCUSSION

Background
On September 16, 1998, the City Council approved a request from
the Moorpark Unified School District (MUSD) that the City act
on behalf of MUSD with regard to execution of documents
required for approval of partial Caltrans funding of the
subject project. In order for MUSD to receive State funding it
is necessary for the City to execute the required Cooperative
Agreement with Caltrans. The City Council authorized the
preparation of that Cooperative Agreement, provided a) all of
the work necessary to undertake and complete this project
(design, right -of -way acquisition, bidding, construction,
contract administration and inspection) be done by MUSD; b)
that any and all direct (out -of- pocket) City costs be
reimbursed by MUSD; and, c) that a separate City /MUSD Agreement
be prepared documenting this arrangement.
Request
The City is in receipt of a letter from MUSD (Exhibit 1)
requesting that the City take over the bidding, construction
and construction management efforts related to this project.
MUSD is in the final stages of efforts necessary to complete
the following:
a) acquisition of all necessary street rights -of -way on both
Walnut Canyon Road and on Casey Road;

b) preparation of a Project Study Report (PSR)
Caltrans approval of same; and,
c) preparation of the plans and specifications
project and the receipt of Caltrans approval

the project by undertaking the following tasks:
a) submit the Caltrans Encroachment Permit Application to
Caltrans and obtain said permit;
b) advertise the subject project for receipt of bids;
c) manage the bidding process, open the bids, evaluate the bids
and award the construction contract;
d) provide for contract administration services and project
inspection services as required.
D. Cooperative Agreement [City /Caltrans]
As previously discussed, it will be necessary for the City to
enter into a Cooperative Agreement with Caltrans relative to
receipt of partial project funding from Caltrans. MUSD and City
staff are working with Caltrans to finalize the language in
that document. When the draft document is completed, it will be
necessary that it be approved by Caltrans Headquarters in
Sacramento.
D. Memorandum of Understanding [MOU]
In order to avoid the delay of the project which would result
from waiting for final Caltrans approval of the Cooperative
Agreement, MUSD, City staff and Caltrans are also working on
the development of an MOU for this project. The purpose of the
MOU is to document the mutual intent of all parties to seek and
obtain (via the Cooperative Agreement) partial Caltrans funding
of the project subsequent to receipt of Caltrans' authorization
to advertise for bids. In addition to Caltrans and the City,
MUSD may also be a signatory to the MOU.

E. City / MUSD Agreement
Consistent with past City Council direction, it will also be
necessary for the City and MUSD to develop, approve and execute
a separate Agreement between the City and MUSD relative to
these matters. The primary purpose of this Agreement is to
clearly state that all City project costs will be paid by MUSD.
MUSD and City staff are working on the development of the
language to be included in that Agreement. It is the intent of
staff to seek and obtain the City Attorney's approval of the
form and content of that Agreement prior to submitting the
Agreement to the City Council for consideration. This Agreement
must be finalized and approved on or prior to the date the City
Council authorizes staff to advertise for receipt of bids for
the construction of the project.
RECCV=NDATION
Staff recommends that the City Council approve the request from the
Moorpark Unified School District that the City undertake the
construction of the Casey Road Signal Project, provided all City
costs for said project are paid by MUSD.
