SUBnCT: COMPOSITION OF THE VCTC
This morning- the Cities Selection Committee was scheduled to appoint new representatives to
the VCTC. Prior to taking any action the mayors present unanimously agreed that they would
like to change the structure of VCTC to include the following:
One representative from each of the 10 cities
Five members of the Board of Supervisors
One ex- officio non - voting member (Caltrans)
They also agreed that each representative should have one vote and that fiscal matters would
require approval by a 2 /3's vote of those present and voting.
Restructuring VCTC would remove all citizen representatives from the Commission and create a
15 member board, rather than the current seven member board. However, under the existing
VCTC structure, the Commission has a full set of alternates and VCTC frequently meets with 12
or 13 members present, even though only 7 members actually vote. To determine if all of the
cities concur with the recommended restructuring, the Cities Selection Committee
requested that each City Council and the Board of Supervisors schedule an item to discuss
this matter as soon as possible. This matter will also be placed on the January VCTC Agenda
for discussion.
Legislation is required to change the structure of VCTC and the deadline for introducing new
bills is January 22, 1999. (Attached is draft legislation amending. the appropriate section of
Senate Bill 1880, Chapter 1136). If legislation is enacted with an urgency clause and passed by a
2 /3's vote of the legislature, it would go into effect immediately.. If an urgency clause is not
added, the bill would take effect on January 1, 2000.

As an interim step, the Cities Selection Committee voted to move all current VCTC
Commissioners up and appoint Mayor Don Gunderson, Fillmore as Alternate #3. The Selection
Committee also voted to appoint Brian Humphrey as the Citizen Member, but chose not to fill
the vacancy for a Citizen Alternate at this time. That vacancy could be filled later if legislation
to change the structure of VCTC does not proceed. The new composition of VCTC is as
follows:
Jack Tingstrom, San Buenaventura (Chair in 1999)
Bill Davis, Simi Valley
Bob Turner, Port Hueneme
John Wozniak, Moorpark - I" Alternate
Toni Holden, Oxnard - 2 "0 Alternate
Don Gunderson. Fillmore - 31 Alternate
Brian Humphrey - Citizen Representative
VACANT - Citizen Alternate
The Board of Supervisors reorganizes each year in January and their representation to the VCTC
could change. Currently the Board of Supervisors' representation is as follows:

SEC. 1. Section 1' )0054.1 of the Public Utilities Code is amended, to read:

(3) The term of any member serving on the commission as a result of holding another public
office shall terminate when the member ceases holding the other public office and a new member
has been properly seated.

SEC. 2. Section 130102 of the Public Utilities Code is amended to read:
130102. Quorum; majority of member
A majority of the members of the commission shall constitute a quorum for the transaction of
business, and all official acts of the commission, except as otherwise provided in Section
130102.5 (AND 130102.7) shall require the affirmative vote of a majority of the members of the
commission.
SEC. 3. Section 130102.7 of the Public Utilities Code is added as follows:
130102.7. Ventura County Transportation Commission; 2/3's vote.
In. the case of the Ventura County Transportation Commission all fiscal matters shall require a
2/3's affirmative vote of those present and voting.
SEC. 4. This act is an urgency statute necessary for the immediate preservation of public peace,
health, or safety within the meaning of Article IV of the Constitution and shall go into immediate
effect. The facts constituting the necessity are:
In order that the 1998 State Transportation Improvement Program may be implemented as soon
as possible in Ventura County, it is necessary that this act take effect immediately.
