Gilbert, Director of Public Works DATE: July 9, 1999 (Council Meeting 7- 21 -99) SUBJECT: Consider Deferral of the Establishment of a Zone 12 [Carlsberg Specific Plan] Assessment for'FY1999 /2000. BACKGROUND 1. On June 23 the City Council adopted a Resolution approving the assessment amounts for Assessment District 84 -2 for Fiscal Year 1999/2000. That action left unchanged the zero assessment provided for in prior years. 2. At a prior meeting, on June 16, there was a public hearing to consider the tabulation and certification of Mail Ballots related to possible increasing the Zone 12 assessment to an amount deemed sufficient to fund the maintenance of certain designated medians, parkways and slope areas within Zone 12. On June 2 That matter was continued to June 23. On June 23 the matter was again continued to July 21. The Public Hearing was left open and remains open for the City Council meeting of July 21. TITQMTCCTr)W In early June staff prepared and distributed Mail Ballots to the owners of the properties within Zone 12. Those ballots advised each of the affected property owners of the amount of the assessment required to provide the funding needed for the landscape maintenance. 000003 Zone 12 Assessment July 9, 1999 Page 2 A number of questions were raised by some of the affected property owners regarding the benefit / spread formula. Staff worked with each of the affected property owners in an attempt to reach a consensus or a compromise that was acceptable to all parties. Those efforts failed. Rather than impose assessments considered by some to be unfair, it is recommend that no action be taken at this time to establish a Zone 12 assessment. Discussion of a possible increase to the Zone 12 assessment in Fiscal Year 2000/2001 (and the related transfer of the maintenance responsibility to the City) can be discussed with the affected parties early next year [The Engineer's Report for AD84 -2 for FY 2000/2001 is due to be completed in March 20001. STAFF RECOMMENDATIONS Staff recommends that no action be taken and that the Zone 12 assessment for FY 1999/2000 remain at zero. Carlsberg_ballot4 000004
