SUBJECT: Consider Request From the Moorpark Unified School District
for Park and Facility Use Fee Reduction
SUMMARY
The City is in receipt of a letter from Thomas Duffy, Moorpark
Unified School District (MUSD) Superintendent, requesting a
reduction in the use fee charged for the High School's use of the
Arroyo Vista Recreation Center (AVRC) gym and the Arroyo Vista
Community Park (AVCP) soccer fields. The City Council is being
asked to approve action to reduce the previously established use
fees by half and to adopt additional policies for MUSD's use of City
facilities.
BACKGROUND
Use fees for the use of City parks and facilities is established by
City Council resolution. Moorpark non - profit agencies, such as
MUSD, qualify for the lowest use fee category. Based on the most
recent fee schedules approved by the City Council, the Moorpark non-
profit hourly rate for use of the AVRC gym is $35, and the hourly
rate for use of a AVCP soccer field is $8.
Last year, MUSD used only the AVRC gym at the amount established on
the facility use fee schedule. This year they are requesting use of
the gym for a total of 68 hours, through February 8, 2000, which is
an increase over the number of hours they used the gym last year.
Additionally, MUSD used the two soccer fields at AVCP for a total of
62 hours, from October 1 through November 15.

DISCUSSION
The letter from MUSD Superintendent Duffy requests that the City
reduce the fees charged for the High School's use of the AVRC gym
and a soccer field at AVCP. It is recommended that the Council
consider reducing the hourly rate for the gym to $15 and the hourly
rate for the soccer fields to $4. The total estimated cost to MUSD,
based on the hours requested to date, would be $1,268. The reduced
rate would apply to Moorpark High School only for fiscal year
1999/2000, and for physical education only. No games or activities
involving players from non Moorpark High School teams would be
included in the reduced rate.
At the recommended rate of $15 per hour, the fee proposed for the
gym only covers utilities and minor wear and tear. To ensure that
MUSD's use of the gym does not create a financial burden on the
City, the High School would be required to dry mop the floor and
pick up any trash after each use. This will mitigate the need for
additional City staff hours to prepare the gym for late afternoon
(JBL practices) and evening (adult basketball and MBA)use. If the
City is required to expend staff time to clean the gym after the
High School's use, it is recommended that the High School be charged
an additional hourly clean up fee of $12. This is similar to a
provision in the City Agreement with the Boys and Girls Club for use
of the gym for MBA.
Additionally, it is recommended that MUSD be required to sign a hold
harmless agreement (language to be approved by the City Manager and
City Attorney), provide adult staff supervision at all times,
enforce the City's rules as they pertain to the use of the gym and
park facilities, and pay for any damage that results from its use.
Consistent with the City's current use policy, all use fees will be
paid in advance of use, and the City reserves the right to use the
gym and soccer fields upon five days written notice to MUSD.
STAFF RECOMMENDATION
Staff recommends that the City Council approve a reduction in the
hourly rate charged to MUSD for the AVRC gym ($15) and AVCP soccer
fields ($4) for fiscal year 1999/2000 for the purposes stated in the
Agenda Report, and direct staff to prepare an agreement that
documents all of the use provisions outlined in the Agenda Report.
