This referenced memo (see attached) provided dates that the developer anticipated final retrofit of the light fixtures for City Council review for compliance with Council direction on the matter. Staff contacted Marketplace Properties on November 22, 1999, the anticipated date of receipt of retrofit materials, however, as of November 22, 1999, the needed items (louvers, opaque glass and cut- offs) had not been received and the supplier had not responded to an inquiry about a revised shipping date. Although at this time the shipping date is unknown, it is pointed out that installation requires only two days. Therefore, a shipment received by December 1 could allow retrofit of the light fixtures to be completed by December 3, 1999. Attachments: 1. October 1, 1999 Status Memo 2. DATE: October 1, 1999 SUBJECT: STATUS OF LIGHTING ISSUES AT THE MARKETPLACE PROPERTIES CENTER - RITE AID /KINDERCARE The attached correspondence was received on August 23, 1999, concerning efforts by Marketplace Properties to complete resolution of the parking lot lighting problems at the Rite Aid /Kindercare center at the northwest corner of Tierra Rejada Road and Spring Road. As Council may recall several tests have been conducted at the site on a limited basis using opaque glass lenses, cut -off attachments which screen light completely and louvers which channel light at a 45- degree angle. For those who have viewed these changes at various times and commented to staff, it seemed that the attachments served to soften the light to some extent, at least where a minimum of two of the three attachments were used. However, because of the limited application of the attachments at the time, the results were inconclusive. The most westerly parking lot area, (west side of Rite Aid) was most effectively treated using opaque glass and cut- offs or louvers on the five light standards in the area. As a result of these efforts by the developer, staff received positive comments from several Council members and several residents nearby who have provided input to staff concerning this issue. The developer, in the attached letter, was requesting that Council view the site again with the information as to how each light fixture on site has been modified. Although, visually differences in light pattern and brightness can be observed, it is the opinion of Staff that a decision can not be made as to the acceptability of applying the various modifications to the light fixtures to achieve the results desired by Council and Staff. The proposed solution involving the three modifications noted above of opaque glass, cut- off and louvers, may achieve the desired results, however, this conclusion can only be verified after the proposed modifications are installed. Many of the fixtures will receive all three of the attachments depending on the location of the light standards. As noted, all fixtures along Spring Road and Tierra Rejada Road have been fitted with cut -offs to eliminate light spillage onto the 00035Y Honorable City Council Marketplace Properties September 22, 1999 Page 2 of 2 right -of -way, however, not all of the fixtures adjacent to Spring Road currently have opaque glass lenses. Reference to Exhibit B of the attached letter from Marketplace Properties will note that only the parking lot light fixtures directly adjacent to Tierra Rejada Road have opaque glass inserts, however, all but one fixture on the Rite Aid building has been outfitted with the opaque material. Louvers have not been installed on most of the building fixtures at this time, but are in place on the west side of the Rite Aid. Staff has requested that the developer complete the modifications to all light fixtures necessary to resolve the lighting issue. On Wednesday September 27, 1999, the developer contacted staff and agreed to install the balance of the light fixture modifications needed to resolve the lighting problems. It was indicated that the parts would be ordered immediately and installation would take place as quickly as possible after receipt of the parts. The developer indicated that it could take up to 45 days before the installation was complete for viewing. The City continues to retain appropriate financial surety to guarantee completion of this project consistent with acceptable standards for lighting and direction from the City Council. There is currently a $10,000 cash deposit and a $15,000 bond (after reduction by Council if approved on 10- 06 -99) to provide for resolution of this issue. In order to simplify the review, I have enclosed a site plan (Exhibit "A ") that identifies all of the parking lot lights and the lights on the Rite Aid building by number. Also enclosed is a list (Exhibit "B ") that summarizes the mitigation measures taken during the first test completed in April of 1999 and the second test recently completed in July of 1999. We were requested by staff and the City Council to direct our mitigation efforts towards the satisfaction of conditions No. 64(c), (f) and (g) of our C.P.D. 95 -1. Condition of approval No. 64 dealt with all of the items involving the exterior lighting plan for the project. Specifically, No. 64(c), required sharp cut -off qualities with a maximum of one foot candle illumination at or beyond our property lines which has been achieved by the installation of metal cut -offs directly behind the light bulb and which are installed in all of the light fixtures that front onto Tierra Rejada and Spring Road (fixture #'s - 1, 2, 3, 4, 5, 6, 7, 8, 9). The cut -off's effectively screen the light illumination a full 180 degrees blocking any glare to the street. Next, No. 64(f) required that no light shall be emitted above the 90- degree or horizontal plain and that no direct light source shall be visible from the street. This mitigation has been accomplished by installing the circular metal louvers which are installed directly over and cover the entire light bulb and which direct the light from the light bulbs directly down on a 45 degree angle so that the light source from the bulb itself is not directly visible from off -site. Also the light fixtures already have a solid top closure piece which forces the light down. Finally, No. 64(g) requires that the parking lot lights be shielded and directed downward to avoid light and glare on neighboring properties. This mitigation is also accomplished by the installation of the full metal louvers which direct the light on a 45 degree angle straight down and the opaque glass inserts that have been installed on all of the test fixtures which reduce the glare by well over 50% and totally conceal the source of the light within the fixture itself. 000359 Member of International Council of Shopping Centers Mr. Wayne Loftus August 20, 1999 Page Two We are confident that the mitigation measures we have implemented in both test No. 1 and test No. 2 not only solve the lighting intensity issues and the spillage of light beyond the perimeter of the property, but also bring this lighting system into full compliance with the conditions of approval for C.P.D. 95 -1. However, we do need to point out that these mitigation measures have reduced the lighting level within the customer and employee parking and driveway areas to a minimal acceptable level for Rite Aid, KinderCare, our liability insurance carrier and for Marketplace Properties, as owner of the project, to accept as sufficient to provide the appropriate level of night -time lighting to ensure the security and well -being of all of our customers and employees. Any further reduction in illumination levels is not in the best interests of all concerned and should not be considered viable. We respectfully request that both staff and members of the City Council visit the location to view first hand the corrective measures that have been implemented. We then would appreciate receiving the final approval that these mitigation measures are acceptable in order that we may proceed to order the balance of the material to complete the installation of the cut -off's, louvers and opaque glass panels on all of the remaining light fixtures in the project. In the referenced memo, based upon verbal and written communications from the project developer, a 45 day window (week of November 15) was identified. This anticipated time frame, however, will not be achieved based upon the latest contact with the developer. A representative of Marketplace Properties (Don Howard) responded to an inquiry by staff on November 9, 1999, that a new time schedule had been created that should see the fixture modifications in place by November 26, 1999. This schedule is based upon receipt of the materials from the east coast manufacturer on November 22, 1999, and subsequent installation on November 24, 1999. Following modification of the remaining fixtures, which will involve installation of opaque glass in all fixtures, cut -off attachments in all fixtures at the property line and louvers in all fixtures, Council will be invited to view the site. At this time a number of surety agreements are in place to guarantee completion of this project including a cash deposit of $10,000, and a Performance - completion bond for building and site work in the amount of $15,000. Following acceptance of the lighting solution by the City Council and payment of any outstanding processing fees the surety agreements /documents will be released.
