The applicant has made several adjustments in the proposed sign program reducing the area requested from the initial proposal of 209 square feet to approximately 145 square feet. Staff has been working with the applicant to determine a reasonable amount of signage for this project, which includes a mini mart, gas station, car wash and lube bay. Applicant has not submitted a letter of justification for the added signage, but believes that Council is receptive to a sign program in the range of 150 square feet. Background: On November 18, 1998, a request for a Minor Modification to establish a sign program at the Mobile gas station currently under construction at the northwest corner of Los Angeles Avenue and Liberty Bell Road was reviewed by City Council and referred to staff for additional study. Also requested was an increase in the height of the proposed monument sign from 4 feet as limited by conditions of project approval to five (51) feet as allowed by the Municipal Code. The applicant also requested approval to allow gas pricing signs on the monument sign rather than placing them on the gas island canopy as required by Condition No. 50 of Resolution 97- 1409, which approved the project in 1997. After discussion on the main issues included in the agenda report, City Council by consensus determined that: • Gas pricing signage would be allowed on the monument sign and was not required on the canopy; • The monument sign could be allowed to a maximum of 5 feet in height and allow the sign area requested for the monument sign at 18.75 square feet (area excludes 10 square feet of pricing information as allowed under Section 17.40.080 of the Zoning Ordinance); • The marquee for the car wash should comply with Code requirements. • Directed staff to bring back a resolution for approval of a sign program consistent with Council direction. While the City Council arrived at several conclusions relating to the amount, size and location of certain signage proposed for this project not all of the details of the request were discussed or treated as consensus issues. Council did not address the issue of the total amount of sign area that may be acceptable for this project. Since the Council's action staff has been working with the applicant to understand their proposed sign program and identify any similarities with prior approved signage for service station /mini- market facilities. Staff has reviewed three nearby gas station facilities, only two of which have signage in excess of the 100 square foot limit currently identified in the Municipal Code. Staff also requested that the applicant provide the justification or reasons that they thought would support the request for sign area beyond the 100 square foot code limitation. The three service stations /mini -marts noted below are in close proximity to the subject site, two of which have signage in excess of the 100 square feet limit that was adopted in 1994 (area calculation excludes 10 square feet of gas pricing information as allowed by the Municipal Code: • Shell Oil at the northwest corner of Los Angeles Avenue and Park Lane. Sign Area is 169.6 square feet. The permit was issued October 28, 1993, prior to adoption of a new sign ordinance in 1994. (Site includes mini mart and car wash) • Summit (formerly Arco AM /PM) at the southwest corner of Los Angeles Avenue and Moorpark Avenue. Sign area is 72 square feet. The initial permit was issued on November 16, 1994 after adoption of the new sign ordinance. (Site includes a mini mart). • Chevron USA at the southeast corner of Los Angeles Avenue and Spring Road. Sign area is 138.37 square feet. The permit was issued October 4, 1995. (Site includes a mini mart) Although two of the three service station /mini -marts noted above have signage in excess of the 100 square foot limit currently in the code, only one (Shell Oil) has a car wash. This information may provide some foundation for decision making, however there remains a lack of the justification for the specific sign program proposed for this service station facility. Staff currently has no information that would lead to an analysis and conclusion that more than 100 square feet of sign area is needed for this project. The applicant is currently proposing 145.15 square feet of overall signage, a reduction from the 209 square feet proposed when Council reviewed the request on November 18, 1998. This amount of signage though not allowed under current code provisions related to service stations may be reasonable. However, if the Code criteria that one G►O UI:j The Honorable City Council Gharabaghi Sign Program January 11, 1999 Page 4 of 4 sign per frontage is allowed and that total sign area per frontage shall be a maximum of twenty square feet, then a sign program with a total maximum sign area of one hundred (100) square feet would result. In the current proposal this would require consolidation and reduction of signs #2 and #3 into one sign, not to exceed twenty square feet, and signs #6 and #7 into one sign, not to exceed twenty square feet. This would result in a reduction of approximately 51 square feet and a total sign area of approximately 95 square feet. Applicant has verbally noted that uses other than gasoline sales occur at this site and more signage is necessary and believes City Council is receptive to allowing total sign area as they have requested in the modified proposal attached. The current proposal noted by the attached facsimile identifies all of the services available on the site, in some cases more than once. The options for City Council consideration are: 1. Direct applicant to develop a Sign Program with a total area not to exceed a maximum of 100 square feet for all signs on site; 2. Modify the resolution for approval of a Sign Program as presented by the applicant, which exceeds the 100 square foot maximum sign area for the site; 3. Provide additional direction relating to individual signs on site and total maximum sign area to be allowed. The attached draft resolution would delete the conditions of the Commercial Planned Development relating to height of the monument sign and the requirement for under canopy price signs. Recommendation: Adopt Resolution No. 99- , approving Minor Modification No. 1 to Commercial Planned Development Permit No. 97 -1. Attachments: 1. The signs (except for the monument) are between 50' and I50' back from Los Angeles Ave. There have been studies done by Oil Companies and the sign industry showing how critical the location, size, color, letter style, and layout are for effective readibility. Effective readibility allow the public to read and make quick decisions in order to minimize confusion and reduce salty hazards. WHEREAS, the Director of Community Development referred the matter to the City Council on January 20, 1999; and M:\CMa1in\M\mm41cpd97-1reso.doc C 0 Q I�.9 Commercial Planned Development No. 97 -1 Minor Mod 1 Gharabaghi January 20, 1999 Page 2 WHEREAS, at its meeting of January 20, 1999, the City Council considered the application filed by Eddie Gharabaghi, requesting approval of Minor Modification No. l; and WHEREAS, at its meeting of January 20, 1999, the City Council after review and consideration of the information contained in the staff report dated January 20, 1999, reached a decision on this matter. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. Based upon the information and findings presented in the staff report and accompanying documents, and public testimony, the City Council finds that: a. The project is Categorically Exempt from California Environmental Quality Act requirements as a Class 1 exemption for the operation or alteration of private structures; b. The Minor Modification is consistent with the intent and provision of the City's General Plan and of the City Zoning Ordinance; C. The Minor Modification is compatible with the character of surrounding development; d. The proposed Minor Modification would not be obnoxious or harmful, or impair the utility of neighboring property or uses; e. The Permit would not be detrimental to the public interest, health, safety, convenience, or welfare; f. The proposed signs, as conditioned, are similar to the signs at service stations /mini mart facilities along Los Angeles Avenue and are not out of scale with the Building elevations and proposed uses; g. Approval and adoption of this resolution is shall delete Conditions 50e and 50f of City Council Resolution No. 97 -1409, allowing the monument sign to have a maximum height of five (5) feet and to allow �OU129 Commercial Planned Development No. 97 -1 Minor Mod 1 Gharabaghi January 20, 1999 Page 3 fuel pricing signs to be placed consistent with the provisions of the Zoning Ordinance. SECTION 2. The City Council conditionally approves Minor Modification No. 1 to Commercial Planned Development No. 97 -1 for adoption of a sign program. SECTION 3. Approval of Minor Modification No. 1 to Commercial Planned Development Permit No. 97 -1 is hereby approved subject to the following conditions: 1. All signage to be placed on this site shall be in conformance with the pertaining provisions of the Zoning Ordinance including a maximum size limitation of 100 square feet. 2. Approval of a Sign Permit is required prior to installation of any sign. 3. The sign program, site plan and elevations shall not be revised to reflect any additional modifications, unless an appropriate modification permit is approved by the City. 4. Sign letters shall not exceed 18" in height. 5. Neon trim shall not be allowed on the buildings or signs. 6. All lettering on the monument sign, with the exception of the gasoline prices, shall utilize push- through letters as required in Section 17.40.050 of the Municipal Code. 7. All signs on the building shall utilize individual channel letters. 8. All signs on the site which are to be illuminated, whether on the building or on the monument sign shall utilize interior illumination. 9. Any change of occupancy or use shall require approval of an additional permit and revised sign program prior to the installation of any sign. (AC 121. All exterior building materials and paint colors shall be as submitted and shall match those approved for the overall center. 11. Prior to issuance of a Sign Permit for construction of the signs, applicant shall pay all applicable fees and all outstanding case processing costs. SECTION 4.
