Lindley, Director of Community Service�� DATE: January 28, 1999 (CC Meeting of February 3, 1999) SUBJECT: Consider Adoption of a Resolution Initiating the Proceedings for the Formation of a Parks and Recreation Maintenance and Improvement District SUMMARY The City Council is being asked to consider the adoption of Resolution No. 99- , initiating proceedings for the formation of a parks and recreation maintenance and improvement district. If approved, it is proposed that ballots would be mailed to property owners on April 30, and 45 days after that date the City would hold a public hearing to tabulate the ballots. If approved by a majority of the voters returning ballots, the district would take effect in FY 1999/2000. DISCUSSION On November 4, 1998, the City Council authorized staff to proceed with the formation of a parks and recreation maintenance and improvement district, and to secure the services of a consultant, Shilts Consultants. Staff has been working with the consultant for the past month and efforts are proceeding towards the target date of late April for the release of the mail ballot. Consistent with the action taken by the City Council on January 20, regarding the City's Street Lighting and Parkway /Median Landscaping Assessment (AD 84 -2), the Council is being asked to adopt Resolution No. 99- (Exhibit A) . The resolution authorizes the preparation of an Engineer's Report and is required by Article XIIID of the California Constitution, and M: \MLindley\ Assessment \districtresol.agd.doc UOOU2Z Park Maintenance and Improvement District 01/28/99 Page 2 the Landscape and Lighting Act of 1972 of the Streets and Highway Code. With the adoption of the resolution, the consultant will draft the engineer's report, which sets forth the services and activities proposed to be funded by the district and the methods to be used to distribute the cost of those services and activities to all of the affected property owners. Once completed, the City Council will be asked to consider and approve the report along with the mail ballot. It is anticipated that this will take place in April. The following is a tentative identifying when staff would perfer the various steps in the process take place: TENTATIVE SCHEDULE Council Approves Engineer's Report /Ballot April 7 Ballots Mailed April 30 Public Hearing June 16 The Council should be advised that the consultant is recommending that the City delay the mailing of the ballot until May 6. This means that the public hearing could not be schedule prior to June 21. The consultant believes that this later schedule provides then necessary time to plan and conduct public educational efforts that will be important to the success of the assessment district measure. M:\NII.indley\ Assessment \districtresol.agd.doc 000023 RESOLUTION NO. 99- A RESOLUTION OF THE CITY OF MOORPARK, CALIFORNIA INITIATING PROCEEDINGS FOR THE FORMATION OF A PARKS AND RECREATION MAINTENANCE AND IMPROVEMENT DISTRICT AND ORDERING THE PREPARATION AND FILING OF AN ENGINEERS REPORT WHEREAS, the City Council of the City of Moorpark, at its meeting on November 4, 1998, directed staff to proceed with efforts to form a Parks and Recreation Maintenance and Improvement District; and WHEREAS, the Lighting and Landscape Act of 1972 requires the adoption of a resolution initiating proceedings related to the formation of an assessment district and the preparation of an engineer's report. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The Council hereby proposes the formation of a landscaping and lighting district pursuant to Article XIIID of the California Constitution, and the Landscaping and Lighting Act of 1972 (the "Act "), Part 2 of Division 15 of the California Streets and Highways Code (commencing with Section 22500 thereof). SECTION 2. The purpose of the landscaping and lighting district shall be for the installation, maintenance and servicing of improvements, to the City of Moorpark described in Section 3 below. SECTION 3. Within the landscaping and lighting district, the existing and proposed improvements to be undertaken by the Parks and Recreation Maintenance and Improvement District are described as installation, maintenance and servicing of public parks and park facilities, including but not limited to, landscaping, irrigation systems, grounds, sports fields and courts, amenities, trees, playground equipment, and hardscape areas, as applicable, for public park property owned and maintained by the City of Moorpark. Maintenance means the furnishing of services and materials for the ordinary and usual maintenance, operation and servicing of said improvements, including repair, removal, or replacement of 9MO24 all, or part of any improvement; providing for the life, growth, health and beauty of landscaping; and cleaning, sandblasting and painting of walls and other improvements to remove or cover graffiti. Servicing shall also mean the furnishing all necessary utilities for maintaining park improvements including, but not limited to, electricity for lighting, timers, and irrigation clocks, and water for irrigation of all landscaping, park restroom service, and general maintenance requirements for all park improvements. SECTION 4. The landscaping and lighting district proposed in this resolution is hereby given the distinctive designation of the "City of Moorpark Parks and Recreation Maintenance and Improvement District," which proposed landscaping and lighting district is primarily described as all of the park lands within the current boundaries of the City of Moorpark. SECTION S. Shilts Consultants, Inc. is hereby designated as Engineer of Work for the purposes of these proceedings and is hereby authorized to prepare an Engineer's Report in accordance with Article 4 of Chapter 1 of the Act and Article XIIID of the California Constitution. Upon completion, the Engineer shall file the Engineer's Report with the Clerk of the City Council for submission to the Council. SECTION 6.
