Subject: Consider Minor Modification No. 4 to Residential Planned
Development Permit No. 89 -3 for two (2) expanded
classroom buildings (13950 Peach Hill Road, Moorpark
Presbyterian Church, Dan Varnum).
SUMMARY
Minor Modification No. 4 to Residential Planned Development Permit
No. 89 -3 is for the construction of two (2) church facility
buildings. The two buildings were approved by the City on July 25,
1990, as Phase Number 2 of a three (3) phase development. The
approval identified these buildings as classrooms with a total
square footage of 5,750 square feet and with approximately 1,900
square feet identified as future classrooms, which was not included
as part of the approved entitlement. This proposal is requesting
an increase in building area of 2,796 square feet for
classroom /office construction in excess of building area approved
on the approved plans. Staff has recommended conditions and
measures appropriate to mitigate potential impacts.
BACKGROUND
On July 25, 1990, the City Council approved Resolution No. 90 -699
to allow the construction of a 23,161 sq.ft. church facility. On
April 17, 1991, Minor Modification No. 1 was approved for minor
alterations to the building plans. On November 6, 1991, Minor
Modification No. 2 was approved to modify the project phasing,
parking lot design, landscape plan, and for the placement of two
(2) portable classroom buildings. These portable buildings were
conditioned to be removed within five years of approval by November

6, 1995. On September 21, 1995, the City Council approved Minor
Modification No. 3 to allow the placement of a third portable
building to be used as a temporary classroom and to extend the
deadline for removal of the portable buildings from its original
date of November 6, 1995, to five (5) years from the date of
approval of this modification requesting more time to September 21,
2000.

PROJECT DESCRIPTION
This Minor Modification request is for the following site
improvements:
1) The construction of two church facility buildings to be used as
classrooms and offices. The "L" shaped building will be 3,672
square feet and building adjacent to Spring Road will be 4,874
square feet.
The initial development request identified the uses for the then
requested construction as classroom uses. The current request
identifies these buildings as classroom and office uses. The change
in uses, size of the buildings, and the amendment of the parking
regulations, will slightly alter the requirements for parking for
this project.
DISCUSSION
Approved Site
This site was originally approved for up to 23,161 square feet of
total building area, however, only 22,995 square feet is identified
on the approved site plan. The approved facility includes 8,725
square feet for the sanctuary use, 2,320 square feet for the office
uses, 6,200 square feet for the fellowship Hall (4900 sq.ft.
constructed), 5,750 square feet for the classrooms. In addition to
the approved site, three (3) temporary classroom buildings were
conditionally approved.
Staff has added a condition that the existing modular buildings be
removed within ninety (90) days of occupancy of the two (2)
classroom buildings approved in this Minor Modification No. 4 or by
September 21, 2000, whichever is sooner.
Existing Site
The site currently consists of a 4,900 sq.ft. fellowship hall and
three (3) temporary classroom buildings. The three (3) temporary
classroom buildings are located in an area identified as Phase No.
3 on the approved site plan.

Proposed Site
This proposal is for the construction of Phase No. 2 of the
approved entitlement, which was approved for the construction of
5,750 square feet of building area. The size of the now requested
construction is 8,546 square feet, which is 2,796 square feet above
the approved plan. This exceeds the criteria for a Permit
Adjustment (10% or 2,316 sq.ft.) that may be approved by the
Director of Community Development. Although not a significant
change to the proposed buildings or their architectural style this
proposal includes the incorporation of a gable roof structure to
the west elevation. Also included is the submittal of elevation
drawings for the additional building area.
Due to the nature of this request concerning the size of the
proposed addition, the alteration to the approved west elevation,
and the submittal of elevation drawings for the additional building
area, this item has been referred to the City Council for review
and determination.
Parking Requirements for Approved Site
The approved entitlement, which includes office areas, a sanctuary,
a fellowship hall, and classrooms, was required to provide one
hundred and sixty -five (165) parking spaces based on the Code
requirements for parking in effect at the time of approval. This
calculation was based on one (1) space for every four (4) fixed
seats for the sanctuary use; one (1) space per three hundred (300)
square feet of gross floor area for the office uses; one (1) space
per thirty -five (35) square feet for the fellowship Hall; and one
(1) space per classroom. The plan then identified a total parking
of 184 spaces proposed for the site upon completion of the project.
Parking Requirements for Existing Site
The site currently has three (3) temporary classroom buildings and
a fellowship hall that is 4,900 square feet. Based on the current
Code requirements for parking of one (1) space per fifty (50)
square feet for the fellowship hall and two (2) spaces per
classroom use, these uses require a total of 104 parking spaces.
There are currently 131 parking spaces provided.

Parking Requirements with This Request
This request will include the construction of 8,546 square feet of
classrooms and office uses and the removal of the three (3)
temporary classroom buildings. Based on the current parking
requirements, this proposal, which includes eleven (11) classrooms,
approximately 1,700 square feet of office uses, and the removal of
the temporary classrooms, will require 120 parking spaces (with the
4,900 sq.ft. fellowship hall). This is based on two (2) spaces per
classroom, one (1) space per 300 square feet for the office uses,
and one (1) space per fifty (50) square feet for the fellowship
hall. The site currently has 131 space available.
Parking Required for the Site at Build -out
The site is approved for 23,161 square feet of building area. The
approved site plan identifies 22,995 square feet of proposed
building area, with 166 square feet of the approved building area
not identified. Based on the current parking requirements for the
identified uses, including this request, this site will be required
to provide 260 parking spaces at build -out. The proposed plan
identifies a total of 189 spaces provided upon completion of the
development. However, a condition in the original approving
resolution stated that: `Occupancy of both the fellowship hall and
the sanctuary shall not exceed the parking capacity for the
existing 184 spaces provided under the entitlement permit." Based
on the new parking criteria, this condition, and the amount of
parking identified for build -out, the site would satisfy the
parking requirements.
Staff has added a condition that the occupancy of both the
fellowship hall and the sanctuary shall not exceed the parking
capacity for the existing 189 spaces provided in this entitlement
permit.
Architecture (Attachment 7)
The applicant proposes to incorporate a gable roof to the west
elevation of the building located adjacent to Peach Hill Road. The
intent of this roof structure is to break up the building mass and
add an architectural treatment to the structure. This was not a
part of the approved elevations for this building, however, this
modification to the roof line is consistent with the overall
architecture of the building.

CONCLUSION
The requested modifications as described in this staff report are
consistent with the intent of the original approval (Residential
Planned Development Permit No. 89 -3).
ENVIRONMENTAL DETERMINATION
A Negative Declaration was previously prepared for this project and
no greater or significantly different environmental impacts are
anticipated.
STAFF RECOMMENDATION
Adopt Resolution No. 99- approving Minor Modification No. 4 to
Residential Planned Development Permit No. 89 -3.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, APPROVING MINOR
MODIFICATION NO. 4 TO RESIDENTIAL PLANNED
DEVELOPMENT PERMIT 89 -3 ON THE APPLICATION OF
MOORPARK PRESBYTERIAN CHURCH FOR, 13950 PEACH
HILL ROAD (APN 500 -0- 350 -360).
WHEREAS, on January 19, 1999, the applicant applied
for Minor Modification No. 4 to Residential Planned
Development Permit No. 89 -3; and
WHEREAS, the Director of Community Development
referred the matter to the City Council on February 3,
1999; and
WHEREAS, at its meeting of February 3, 1999, the City
Council considered the application filed by Moorpark
Presbyterian Church, requesting approval of Minor
Modification No. 4 to Residential Planned Development No.
89 -3; and
WHEREAS, at its meeting of February 3, 1999, the City
Council, after review and consideration of the information
contained in the staff report dated January 21, 1999,
reached a decision on this matter.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. Based upon information in the Staff Report
and accompanying information and information from the
public testimony, the City Council finds that:
1. The proposed project is generally consistent with the
previously approved project, no greater or
significantly different environmental impacts are
anticipated and the previously prepared Negative
Declaration adequately examined the effects of the
project;
2. The proposed project, as conditioned, would not have a
substantial adverse impact on surrounding properties;

3. The Minor Modification is consistent with the intent
and provisions of the City's General Plan and of the
City's Municipal Code;
4. The Minor Modification is compatible with the
character of surrounding development;
5. The proposed Minor Modification would not be obnoxious
or harmful, or impair the utility of neighboring
property or uses; and
6. The Modification would not be detrimental to the
public interest, health, safety, convenience, or
welfare.
SECTION 2. The City Council conditionally approves
Minor Modification No. 4 to Residential Planned Development
No. 89 -3 for:
The addition of 2,796 square feet of building area to
two (2) approved classroom buildings.
SECTION 3. Approval of Minor Modification No. 4 to
Residential Planned Development No. 89 -3 is hereby approved
subject to the following conditions:
1. The permit is granted for the land and project as
shown on the submitted plot plan, elevations, floor
plans, and other exhibits displayed at the City
Council meeting on February 3, 1999. The location and
design of all site improvements shall be as shown on
the plans, except or unless otherwise indicated
herein.
2. All facilities and uses other than those specifically
approved, are prohibited unless a modification
application has been approved by the City of Moorpark.
3. The existing modular buildings shall be removed within
ninety (90) days of the occupancy of the two (2)
classroom buildings approved in this Minor
Modification No. 4 or by September 21, 2000, whichever
is sooner.
4. The continued maintenance of the landscaping, permit
area, and facilities shall be subject to periodic

inspection by the City. The permittee shall be
required to remedy any defects in ground maintenance,
as indicated by the Code Enforcement Officer within
thirty (30) days after notification.
5. Applicant shall meet all permit requirements of the
Fire Prevention and Building and Safety Department.
6. Any roof mounted equipment or screening shall require
an additional permit.
7. Parking shall occur in designated parking spaces only.
8. The Occupancy of both the fellowship hall and the
sanctuary shall not exceed the parking capacity for
the existing 189 spaces provided in this entitlement
permit.
9. Parking spaces shall clearly marked with paint
striping at least two (2) inches wide.
10. Prior to issuance of a Zoning Clearance for
construction, the applicant shall submit a revised
site plan that includes the improvements as modified
by this permit.
11. Applicant and the successors, heirs, and assigns shall
remove any graffiti within five (5) days from written
notification by the City of Moorpark. All such
graffiti removal shall be accomplished to the
satisfaction of the Director of Community Development.
12. A Sign Permit approved by the Director of Community
Development is required for all on -site signs. No off -
site signs are permitted.
13. The Director of the Community Development Department
may declare a development project that is not in
compliance with the conditions of approval or for some
other just cause, a "public nuisance." The applicant
shall be liable to the City for any and all costs and
expenses to the City involved in thereafter abating
the nuisance and in obtaining compliance with the
conditions of approval or applicable codes. If the
applicant fails to pay all City costs related to this
action, the City may enact special assessment

proceedings against the parcel of land upon which the
nuisance existed (Moorpark Municipal Code Section
1.12.080)
14. All lighting shall comply with Section 17.24.090 F of
the Zoning Code.
15. All Conditions of Approval for Residential Planned
Development Permit No. 89 -3 and prior approved Minor
Modification Permits apply to this project, except as
modified by this Minor Modification No. 4.
16. The permittee's acceptance of this permit and /or
commencement of construction shall be deemed to be
acceptance by the permittee of all conditions of this
permit.
SECTION
4. The City

shall certify to the
adoption of
this Resolution
and
shall cause a certified
resolution to
be filed in the
book
of original resolutions.
