SUBJECT: CONSIDER CITY COUNCIL RESOLUTION NO. 99- , RECITING
THE FACT OF THE SPECIAL MUNICIPAL ELECTION HELD ON
JANUARY 12, 1999, AND DECLARING THE ELECTION RESULTS AND
SUCH OTHER MATTERS AS REQUIRED BY LAW
BACKGROUND
A City Special Municipal Election was held on January 12, 1999. The
City Council by adoption of Resolutions No. 98 -1520 and No. 98 -1526
authorized the Board of Supervisors to direct the County Clerk to
canvass the election returns of the City's Special Election.
DISCUSSION
The County Clerk has completed the canvass of the election returns,
and the County Clerk's certification of the election results is
included as an exhibit to the attached draft resolution. Section
10262 of the Elections Code requires that upon the completion of
the canvass, the governing body of the city shall pass a resolution
reciting the fact of the election and such other matters as are
enumerated in Section 10264. Section 10264 requires that as soon as
the result of the election is declared, the elections official of
the governing body shall enter on its records a statement of the
result, which must include:
(a) The whole number of votes cast in the city.
(b) The measures voted upon.
(c) The number of votes given at each precinct for and against
each measure.
(d) The number of votes given in the city for and against each
measure.
The attached resolution recites the fact of the Special Municipal
Election held on January 12, 1999, and declares the election
results and such other matters as required by law. The resolution
declares that Measure "S" was adopted by a majority of the voters
and shall go into effect ten days after adoption of the resolution.
No additional action is required for Measure "T ", because the
referendum resulted in the Council approved Ordinance No. 246 not
becoming effective. Since Measure "T" did not receive a majority

"Yes" vote, the Elections Code states that the ordinance shall not
again be enacted by the legislative body for a period of one year
after the date of its disapproval by the voters.

RESOLUTION NO. 99-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MOORPARK, CALIFORNIA, RECITING THE FACT OF
THE SPECIAL MUNICIPAL ELECTION HELD ON JANUARY
12, 1999, AND DECLARING THE ELECTION RESULTS
AND SUCH OTHER MATTERS AS REQUIRED BY LAW.
WHEREAS, a Special Municipal Election was held and conducted
in the City of Moorpark, California, on Tuesday, January 12, 1999;
and
WHEREAS, notice of the election was duly and regularly given
in time, form and manner as provided by law, voting precincts were
properly established, election officers were appointed, and in all
respects, the election was held and conducted and the votes were
cast, received and canvassed and the returns made and declared in
time, form and manner as required by the Elections Code of the
State of California for holding of elections in cities; and
WHEREAS, pursuant to City Council Resolutions No. 98 -1520 and
No. 98 -1526, adopted October 7, 1998, the County Clerk of Ventura
canvassed the returns of the Special Municipal Election held for
the purpose of consideration of certain ballot measures; and the
County Clerk has certified the results to this City Council and the
results are received, attached and made a part hereof as "Exhibit
All;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That Measure "S" voted upon at the General
Municipal Election was as follows:
Shall the ordinance entitled the Moorpark Save Open -Space and
Agricultural Resources be adopted?
SECTION 2. That Measure "T" voted upon at the General
Municipal Election was as follows:
Shall the ordinance entitled an Ordinance of the City Council
of the City of Moorpark, California, adopting a Development
Agreement between the City of Moorpark and Hidden Creek Ranch
Partners (Messenger Investment Company) Related to the
Development of Specific Plan No. 8, Hidden Creek Ranch, be
adopted?

SECTION 3. That the whole number of votes cast in the City,
except absent voter ballots, was 3,521. That the whole number of
absent voter ballots cast was 1,800, making a total of 5,321
ballots cast.
That the number of votes given at each precinct, the number of
votes given in the City for and against the Measures, were as
listed in Exhibit A, attached.
The City Council does declare and determine that:
Measure "S" was adopted by a majority of the voters, voting on the
proposed ordinance, and shall go into effect ten (10) days after
adoption of this resolution.
SECTION 4. That the City Clerk shall certify to the passage
and adoption of this Resolution and shall enter it into the book of
original Resolutions.
PASSED AND ADOPTED this 3rd day of February, 1999.
