SUBJECT: Consider Supporting Legislation Related to
Domestic Violence.
DISCUSSION: Mayor Hunter requested this item regarding
proposed legislation on domestic violence be placed before
the City Council for consideration. The Council Budget and
Finance Committee will be reviewing the matter and
presenting a recommendation at the Council meeting.
RECOMMENDATION: Take such action as deemed appropriate.

Consider Supporting Legislation Related to Domestic
Violence
DISCUSSION:
Penal Code section 13730(a) currently obligates law enforcement
agencies to maintain a system for the recordation of all domestic
violence - related calls for assistance made to the department
including whether weapons are involved.
Penal Code section 13730(c) requires all reports documenting
cases of domestic violence include at least both of the
following:
(1) A notation of whether the officer or officers who
responded to the domestic violence call observed any
signs that the alleged abuser was under the influence
of alcohol or a controlled substance, and;
(2) A notation of whether the officer or officers who
responded to the domestic violence call determined if
any law enforcement agency had previously responded to
a domestic violence call at the same address involving
the same alleged abuser or victim.
Regrettably, law enforcement officers who respond to the scene of
a domestic violence - related incident are not required to
ascertain if firearms or other weapons are present at the
location. Officers are currently obligated to only document in
any report whether a weapon was used in an incident.

In an attempt to prevent an escalation of violence and protect
the victim(s) in domestic violence - related incidents, it is my
belief that an amendment to state law is absolutely necessary.
I recommend that Penal Code section 13730(c) be amended to read
as follows:
(c) Each law enforcement agency shall develop an incident
report form that includes a domestic violence
identification code by January 1, 1986. In all
incidents of domestic violence, a report shall be
written and shall be * * * identified on the face of
the report as a domestic violence incident. A report
shall include at least the following three items:
(1) A notation of whether the officer or officers who
respond to the domestic violence call observed any
signs that the alleged abuser was under the influence
of alcohol or a controlled substance.
(2) A notation of whether the officer or officers who
responded to the domestic violence call determined if
any law enforcement agency had previously responded to
a domestic violence call at the same address involving
the same alleged abuser or victim.
(3) Officers at the scene of incidents involving cases of
domestic violence shall inquire whether a firearm or
other weapon is present at the location and include the
results of this inquiry in any report documenting cases
of domestic violence.
(4) If firearms or other weapons are present at the
location, a reasonable attempt shall be made to
confiscate the weapons pursuant to Penal Code section
12028.5.
I would sincerely appreciate the support of the City Council in
an attempt to address this most critical safety issue in our
community and throughout the state.
RECO1rMNDATION: Authorize the mayor to sign a letter in support
of the proposed amendment.
