EXECUTIVE SUMMARY
This report presents a petition filed by a party representing the
subject neighborhood (see map which is part of the Resolution
attached as Exhibit 1), requesting that overnight parking be
prohibited upon the streets within that neighborhood.
DISCUSSION
A. Resolution 93 -970
The subject request was made pursuant to the provisions of City
Council Resolution No. 93 -970 (copy of Resolution is attached
as Exhibit 2). Said Resolution provides for the establishment
of "No Overnight Parking Zones" in any residential neighborhood
in the City, when requested by the residents of that
neighborhood. Resolution No. 93 -970 also identifies the
boundaries of contiguous neighborhoods which could be
considered for this type of parking restriction.
The purpose and intent of the program established by Resolution
No. 93 -970 is to allow residents to seek a solution to problems
they believe to be associated with the parking of an excessive
number of vehicles in their neighborhood. Upon receipt of a
request filed in accordance with the procedures set forth by
the Resolution, a Public Hearing is Scheduled before the City
Council to consider whether or not a No Parking (between the
hours of 2:00 a.m. and 6:00 a.m.) zone should be established
upon all of the streets in the affected neighborhood.

B. Request
As required by Resolution No. 93 -970, requests for this type of
parking restriction must come from either the Homeowners
Association (HOA), or from the sponsor of a petition signed by
at least ten percent (10t) of the residents within the affected
neighborhood. The subject request was submitted by Mr. Victor
Gutierrez of 350 Harry Street. That request was accompanied by
a petition signed by at least ten percent (10 ) of the
residents within the affected area. That Petition is on file
with the City Clerk. The petition was also accompanied by the
required filing fee of $202.00.
C. Neiahborhoods
Resolution No. 93 -970 identifies the boundaries of specific
neighborhoods which could be considered for this type of
parking restriction. In order to provide for clarity in the
"signing" and enforcement of these parking restrictions, all of
the streets within any of the neighborhoods identified in that
Resolution, would have to be included in these parking
restrictions.
D. Public Hearin
A Public Hearing on this matter has been scheduled for March
17, 1999. Public Hearing Notices, in both English and Spanish,
have been mailed to all property owners and residents within
the affected area. A copy of the Public Hearing Notice is
attached as Exhibit 3. Subsequent to the receipt of all written
and oral testimony on the request, the City Council may act to
approve or deny the request.
E. Implementation / Fiscal Impact
If the subject request is approved by the City Council, it is
recommended that the City Council adopt a Resolution (see
Exhibit 1) establishing the parking restrictions and directing
the installation of appropriate No Parking signs. The estimated
cost of sign fabrication and installation is as follows:
• Signs (180 ea.): $ 2,160.00
• Poles (134 ea.): $ 3,790.00
• Concrete: $ 90.00
• New core bit: $ 300.00
• Sub -Total $ 6,340.00
• Equipment (180 hrs x $5) $ 900.00
• Labor (180 MH x $23.55): $ 4,240.00
• Total $ 11,480.00

If the request is approved, it is recommended that the City
Council adopt a Resolution (Exhibit 4) increasing the budget
to cover out -of- pocket costs related to the required
installation of new signs.
F. Impacts
It is anticipated that the adoption of the requested parking
restrictions will eliminate or reduce the number of cars parked
on the affected streets. The establishment of these parking
restriction may also have certain "side effects" including:
1. Code Enforcement: Some may choose to park their vehicles in
the front yard;
2. Migration: Some may choose to park their vehicles on
another street not subject to the parking restriction:
3. Illegal Parking: Some may choose to park their vehicles in
public or private parking lots without permission; and,
4. Property (Vehicles) Crimes: Vehicles parked on streets or
on private property removed for the owner's residence may be
more subject to theft or damage.
G. Parking Enforcement
It should be noted that the ability of the City to enforce
parking restrictions between the hours of 2:00 A.M. and 6:00
A.M. is very limited. This could erode the effectiveness of the
proposed parking restrictions. A Memo on this and related
matters, prepared by Captain Lewis, Moorpark Police Chief, is
attached as Exhibit 5.
H. Permits
Resolution No. 93 -970 provides for the issuance of Parking
Permits exempting certain vehicles from the subject parking
restriction. Such permits may only be issued when there are
more than four (4) vehicles registered to individuals residing
at a single address. In such event the fifth vehicle may be
issued a Parking Permit, at no charge, exempting it from the
parking restrictions. A fee of $25 is required for a permit for
the sixth vehicle. No more than two Permits may issued to a
given address. In addition, one Guest Permit may be issued to a
given address, no more than four times per year, for periods
not exceeding fourteen (14) days.

SECTION 5. That the said parking restriction shall not apply
to vehicles displaying a permit issued by the City exempting said
vehicles from this parking restriction.
SECTION 6. That the City Manager shall establish and maintain
policies, procedures and guidelines for the designation of PERMIT
ONLY parking zones and for the administration of the issuance of
PARKING PERMIT exempting certain vehicles ,from said parking
restrictions.
SECTION 7. That said policies, procedures and guidelines shall
include certain provisions including, but limited to, the
following:
a. The pre- designation of areas or neighborhoods to be
considered for such parking restrictions.
b. Criteria and procedures for submitting petitions to the City
requesting that this program be made applicable to any such
area.
c. Except for Guest Permits, no parking permit shall be issued
to any vehicle which is not registered to an individual
residing at a residence within a PERMIT ONLY parking zone.
d. A Parking Permit may only be issued to a vehicles when the
registered owner of said vehicle demonstrates that there are
in excess of four (4) vehicles registered to individuals
legally residing at the domicile of the applicant.
Exceptions shall be made for residences which cannot
accommodate four (4) vehicles in the garage and driveway as
originally approved and constructed.
e. The payment of a Parking Permit fee to recover all or a
portion of the administrative costs of the program.
f. Criteria for the waiver of any such fee due to demonstrable
economic hardship.

For the Issuance of Parking Permits
to Vehicles Registered to Residents of a
Designated PERMIT ONLY Parking Area
PURPOSE
To establish guidelines and procedures for 1) the designation of
PERMIT ONLY parking zones; and, 2) the issuir}g PERMITS exempting
certain vehicles from the parking restrictions established in any
such zone.

A. The City Council of the City of Moorpark has adopted Resolution
No. 93 -970 which states the intent of the City Council to
establish PERMIT ONLY parking zones in specified areas of the
City. Said Resolution directs the City Manager to develop and
maintain these policies, procedures and guidelines for the
administration of that program.
B. Resolution No. 93 -970 states that PERMIT ONLY parking shall be
made applicable to certain specified areas or neighborhoods
upon adoption of a Resolution of the City Council. It is the
intent of the City Council to only enact such restriction upon
receipt of a request to do so from the residents of the area to
be affected, unless otherwise determined necessary for the
public health, safety or welfare of the Community. In order to
be considered, any such request shall be in the form and shall
meet the minimum requirements of the applicable Procedures set
forth herein.
C. Whenever a PERMIT ONLY parking zone is
resolution of the City Council, the parking

2. Said Resolution provides for the pre - designation of the
areas or neighborhoods to be considered for PERMIT ONLY
parking. Those areas [hereinafter referred to as "area(s)]
are identified on the map attached hereto as Exhibit 'A'.
3. Upon receipt of a request that an area be designated a
PERMIT ONLY parking zone, the City Council may consider
adoption of a Resolution so designating said area. In order
to be considered, such request must have been presented by
a group duly representing the owners and residents of said
area. For the purposes of these Procedures, a group deemed
to be duly representing the owners and residents of an area
shall be defined as one of the following:
• the Board of Directors of the Homeowners Association for
the area; or,
• the holder(s) of a petition signed by the owners and /or
residents of at least ten percent (10 %) of the lots
within said area.
4. Upon receipt of any such request, City staff shall prepare
a mailing list of all of the property owners and residents
within the area. A public hearing shall be scheduled before
the City Council to consider any such request and to
consider adoption of a Resolution designating the area in
question a PERMIT ONLY parking zone. Public Hearing Notices
shall be mailed to all of the owners and residents within
said area, advising them of the proposed action.
5. In order to be considered, any such request must be
accompanied by a fee equal to the number of lots in the area
multiplied by fifty cent ($0.50) to cover the cost of
evaluating the application and the administering the public
hearing. Any such application filed within sixty (60) dais
of the date of the adoption of Resolution No. 93 -970 shall
be exempt from said fee.
Public Hearing administrative costs may include, but may are
not limited to the following:
• compiling the public hearing mailing list;
• preparation of the Public Hearing Notice; and,
• postage, paper and envelopes.
6. Subsequent to the receipt of written and /or oral testimony
at or prior to the public hearing, the City Council may take
action to adopt, or not to adopt, a resolution designating
the subject area as a PERMIT ONLY parking zone.

7. Whenever any such resolution is adopted, the City Manager
shall place signs giving notice of the parking restriction
established by Resolution No. 93 -970, and advising that
vehicle properly displaying PARKING PERMITS are exempt from
said parking restrictions.
B. Issuance of Parking Permits
1. Whenever a PERMIT ONLY parking zone [hereinafter referred to
as "zone(s)] is established pursuant to applicable
provisions set forth herein, property owners and /or
residents of said zone may apply for one or more Parking
Permits to exempt their vehicle(s) from the parking
restrictions applicable to said zone.
2. Whenever a parking permit is issued pursuant to these
provisions, the vehicle to which said permit is issued shall
be exempt from the parking restrictions set forth in
Resolution No. 93 -970, and /or any amendment thereto.
Whenever the term "permit(s) is used in these policies and
procedures, said term shall mean a permit issued to a
particular vehicle for the permit period as defined herein.
Said term shall not apply to Guest Permits.
3. Permits shall only be issued to vehicles registered to the
owner or resident of property located within a zone.
4. Permits shall only be issued subsequent to the City's review
and approval of the information set forth in a Parking
Permit Application [hereinafter referred to as
"Application(s)].
5. In order to be approved, an Application must state, contain
or be accompanied by the following information:
a. the license number of the vehicle to be exempt;
b. documents which sufficiently prove that the address of
the registered owner of the vehicle is within a zone;
c. documents and /of information which clearly demonstrates
that there are at least four ( 4 ) other vehicle registered
to individuals residing at the address of the registered
owner of the vehicle to be issued a permit.
d. a permit application fee equal to twenty -five dollars
($25.00) per permit.

6. A permit may only be issued to a vehicle when and if there
are at least four (4) other vehicle registered to
individuals residing at said address.
Exceptions: The requirement that there must be at least
four ( 4 ) other vehicles registered at the subject address
may be reduced when it is demonstrated that the
dimensions of the garage and driveway at said address, as
originally approved and constructed, are not large enough
to accommodate four (4) vehicles. In such case the
number of other vehicles registered to said address may
be reduced to the number of vehicles which can be
accommodated by the garage and driveway as originally
approved and constructed, provided that said number shall
not be less than two (2).
7. No more than two (2) permits may be issued to* any one
address.
8. Permits may only be issued to specific vehicles. The
Application shall clearly indicate the license number of the
vehicle to be issued a permit. Permits are non - transferable
and shall be affixed to the vehicle at the left rear bumper
of the vehicle, or at another suitable location subject to
the approval of the City.
9. At the sole discretion of the City, an applicant may be
required to present documents which clearly verifies the
information required by the Application (i.e. vehicle
registration, proof of residency, etc.).
10. Permits shall be valid for the period specified on the
approved Application. The permit expiration date shall be
30th day of June of the permit period stated on the
Application. Applications for permit renewal should be
submitted to the City by April 30 of said year, in order to
allow adequate time for the processing and issuance of
renewed permits.
11. A Permit issued pursuant to these procedures shall not be
effective unless said permit is attached to the left rear of
the vehicle.
12. Issuance of a Permit to a vehicle shall not exempt said
vehicle from any provision of any other City regulation or
any provision of the California Vehicle Code.

13. Permits shall not be issued to any over weight vehicle as defined by City
Ordinance or the California Vehicle Code. Permits shall not be issued to

14. Prior to issuance of any permit, the applicant shall pay a $25.00 permit fee for
each permit issued, except that there shall be NO CHARGE for the first permit
issued to the subject address.
15. The permit fee may be waived upon documentation of economic hardship by the
applicant. The applicant shall qualify for said fee waiver upon demonstration that
his or her family income is equal to or less than two - thirds of the current figure
for the median family income for the County of Ventura, for his/her family size.
16. The procedures for the issuance of Guest Permits is as follows:
a. All of the requirements of Paragraph B -6 shall apply.
b. No more than one (1) Guest Permit may be issued for any given period of
time.
C. The length of time approved for a Guest Permit shall not exceed fourteen
(14) days.
d. The number of times per year a Guest Permit may be issued to any one
address shall not exceed four (4).

Dear Property Owner and /or Resident:
Public Hearing
A Public Hearing has been scheduled before the City Council for 7:00 p.m., Wednesday,
March 17, 1999, in the City Council Chambers, at City Hall, 799 Moorpark Avenue,
Moorpark, CA 93021. You are welcome to provide any written comments to the City
Clerk on or before that time. You are also welcomed to be present and to present oral
testimony at the Public Hearing.
Purpose
The purpose of the Public Hearing is to allow the City Council to consider the
establishment of a "Permit Only" parking zone on all of the streets in your neighborhood.
The streets which would be affected by this action are all of the streets south of the
railroad, north of Los Angeles Avenue, east of Moorpark Avenue and west of Spring
Road. If the City Council takes action to approve this proposal, signs will be posted on
your street prohibiting parking between the hours of 2:00 am and 6:00 am. Under certain
restrictive circumstances described below, Parking Permits may be issued exempting
certain vehicles from these parking restriction.
Background: Permit Only Parking Zones
The City has a program which allows for the establishment of "No Overnight Parking
Zones" in any residential neighborhood in the City. This program was created to
empower residents to address problems they believe to be associated with the parking of
an excessive number of vehicles in their neighborhood. When such problems are believed
to exist in a particular neighborhood, an organization or individual representing that
neighborhood may request that the City Council schedule a Public Hearing to consider
the establishment of a No Parking restriction between the hours of 2:00 a.m. and 6:00
a.m. on all of the streets in that neighborhood. If the request is approved, signs will be
installed, enacting the parking restrictions.

The City has received a request from a resident of your neighborhood that the above
described No Parking restriction be established in your neighborhood. That individual
circulated a Petition describing the proposed action, and received signatures in support
from at least ten percent (10 %) of the residents of your neighborhood.
Proposed Action
The City Council will consider this request at the subject Public Hearing. If the City
Council determines that the public interest would be served by enacting these parking
restrictions, a City Council Resolution will be adopted directing that signs be installed to
read: No Parking 2:00 a.m. to 6:00 a.m. Said parking restrictions would be effective
every day.
Exemptions: Parking Permits
In the rare event there are more than four (4) vehicles registered to individuals residing at
a single address, the fifth vehicle may be issued a Parking Permit exempting it from the
parking restrictions. A fee of $25 is required for a permit for the sixth vehicle. No more
than two Permits may issued to a given address. In addition, one Guest Permit may be

Una Audiencia pars el Publico antes de el Consejo Municipal se llevara a cabo el Miercoles, 17 de Marzo,

Solicitud•
La Ciudad recibio un pedido de un residente de su vecindario para establecer una zona que no permita

Accion Sugerida•
El Consejero Municipal va a considerar esta solicitud en la Audiencia para el Publico. Si el Consejero
Municipal determina que el interes de el publico sera servido con promulgando la restricion de
estacionamiento, una Resoluccion de el Consejero Municipal sera adoptada dirigiendo que los anuncios
sean instalados que lean: "No se permite estacionarse de las 2:00 a.m. a las 6:00 a.m.° (los anuncios seran
en Ingles). Estas restricciones de estacionamiento seran efectivas diarias.
Ezencion: Permisos Para Estacionamiento:
En el raro caso que tengan mas de cuatro (4) vehiculos registrados a individuos en la misma residencia, el
quinto (5) vehiculo puede recibir un permiso de estacionamiento que to eximir de la restricion de
estacionamiento. Un honorario de $25.00 es requerido para permitir el sexto (6) vehiculo. No mas de dos
(2) permisos se pueden dar a una direccion. Tambien se puede dar un permiso para un invitado /a a una
residencia, no mas de cuatro (4) veces por ano por periodos que no sean mas de catorce (14) dias.

El objetivo de la Audiencia para el Publico es para recibir testimonios para y en contra de esta proposicion.

RESOLUTION NO. 99 -
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MOORPARK, CALIFORNIA, REVISING THE AMOUNT
OF THE APPROPRIATIONS AND BUDGET FOR
REGULATORY SIGNS (GAS TAX FUND - FUND 240)
WHEREAS, on July 17, 1998, the City Council adopted the Budget
for Fiscal Year 1998/99; and
WHEREAS, a staff report has been presented to the City Council
requesting a budget increase in the aggregate amount of $6,400; and
WHEREAS, Exhibit "A," attached hereto and made a part hereof,
describes said budget amendment and its resultant impacts to the
budget line item(s).
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1: That a Budget amendment in the aggregate increase
of $6,400 as more particularly described in Exhibit "A," is hereby
approved.
SECTION 2: The City Clerk shall certify to the adoption of
this resolution and shall cause a certified resolution to be filed
in the book of original Resolutions.

SUBJECT: Establishment of `No Overnight Parking' in the Millard Neighborhood
In response to the above action being referred to the City Council, I would like to bring to your
attention two areas of concern without actually commenting on the proposed action itself.
As you know, any parking restriction such as this will only be as effective as the enforcement which
accompanies it. A good example of this is the `parking by permit only' areas surrounding the
College. These signs are summarily ignored by the violators (students in most cases) until concerted
coordinated enforcement action takes place by Police Department staff and your Department's
Crossing Guard Supervisor. I would anticipate that the same level of effort would be required on the
13 streets being proposed to receive the `no overnight parking' designation before compliance
became voluntary by the residents of the area. With only 2 patrol deputies working during the
restricted time period (2 a.m. to 6 a.m.) the reality of this situation would be that parking enforcement
of this type would be given a low priority when compared to the calls for service and necessary
proactive patrol or selective enforcement of problem areas.
A second area of concern would be the displacement of the vehicles now parked on the streets in the
proposed no parking area. By necessity these cars would now be moved to the frontyards of the
homes and to surrounding parking areas such as the shopping center or Metrolink. This raises
additional enforcement issues but also now presents a greater crime opportunity for vehicle burglaries
and theft of cars left unattended and unsupervised in a parking lot during the night. You will recall
that this is the exact reason that the Metrolink parking lots were originally posted as prohibited
parking between 2 a.m. and 6 a.m.

intent of this proposed action is to alleviate vehicle overcrowding in this neighborhood.
Within a PERMIT ONLY parking area, signs will be placed prohibiting parking between
