FROM: Dirk Lovett, Assistant City Engineer Prepared by Matt Gaspar, Engineering Department DATE: March 5, 1999 (City Council meeting of March 17, 1999) SUBJECT: Consider the approval of Final Map - Tract 5004 (Special Devices Incorporated) BACKGROUND On August 21, 1996, the City Council adopted Resolution No. 96- 1222 approving General Plan Amendment No. 95 -1, Vesting Tentative Tract Map No. 5004, and Industrial Planned Development Permit No. 95 -2. On August 28, 1996, a Development Agreement between the City of Moorpark and Special Devices, Inc. was executed. At the request of the Developer, the City Council approved Minor Modification No. 1 to IPD 95 -2 on October 9, 1998, for a modification to Condition 143. The approved modification states that the Developer shall have complied with all development conditions except those conditions requiring recordation of the Final Map prior to Certificates of Occupancy. The Developer has satisfactorily completed the requirements of all conditions prior to the request for the recordation of the Final Map. As part of the Final Map condition of approval, the Subdivider is required to define an additional lot (Lot D) to divide proposed Lot 4 into areas within the floodway and outside the floodway. The floodway is considered to be an area within the 100 year flood plain as shown in the latest Federal Insurance Rate Map. The boundary between Lot 4 and Lot D shall be parallel to the centerline of the Moorpark County Sanitation District Easement, as shown on the Vesting Tentative Map, such that Lot 4 shall have a minimum of ten acres. The area within the floodway shall be the HONORABLE CITY COUNCIL FINAL MAP APPROVAL (SDI) MARCH 17, 1999 PAGE 2 new Lot D. The approved Vesting Tentative Map does not show Lot D. The Development Agreement states that the Developer agrees to dedicate Lot 4 and Lot D, in fee simple interest to the City concurrently with the recordation of the Final Map. These lots are to be used for public benefit as determined by the City in its sole discretion. Under the Owner's Certificate on the Final Map title sheet there is an offer to dedicate Lot 4 and Lot D, in fee simple. Under the City Council's Certificate on the Final Map Title Sheet, there is an acceptance of the offer of dedication of Lot 4 and Lot D. Work on the entire project is generally complete. Certificates of Occupancy have been issued for all the buildings except building 600. The Engineering Department has several minor slope drainage issues. It is expected that work on the entire project will be completed in several weeks. RECOMMENDATION 1. Approve Final Tract Map No. 5004. 2. Authorize the Mayor and City Clerk to sign the Final Map Title Sheet. 3. Direct the City Clerk to record the Final Map through the Ventura County Recorder's Office. 00616$
