Gilbert, Director of Public Works V June 4, 1999 (Council Meeting 6- 16 -99) SUBJECT: Supplemental report Regarding Final Changes to the Engineer's Report for AD84 -2 and Adoption of a Resolution Confirming the Assessment Amounts for Fiscal Year 1999/2000 EXECUTIVE SUMMARY This is a supplemental report to the June 2 staff report on the subject matter. A copy of the June 2nd report is attached. DISCUSSION A. June 2nd Exhibits The June 2nd staff report included the following Exhibits: Exhibits 1. Engineer's Report (Engineer's Report has been revised to include the changes in Exhibit 2A, discussed below); 2A.Summary of the recommended changes to the May 5, 1999, version of the Engineer's Report (see discussion below); 3. Public Hearing Notice; and 4. Resolution: Setting Assessment Amounts for FY 1999/00. B. Zone 12 Mail Ballots Mail Ballots have been sent to the owners of the properties within the Carlsberg Specific Plan, requesting their vote in favor or against a proposed increase to the Zone 12 Assessment to cover future City costs for the maintenance of certain landscaping within the Carlsberg Specific Plan. Those ballots are to be received, opened and tabulated at 5:00 p.m. on June 16, 1999. The certification of the results of those ballots is the subject of a separate agenda item on June 16. Zone 12 Assessment 1.Areas Maintained: The areas to be maintained by the Zone 12 Assessment are listed as follows: a. General Assessment: All non - exempt properties will be assessed for the maintenance of the following areas: • the medians on Science Drive; • the parkways (within R -O -W) on Science Drive south of the commercial /industrial frontage; • the parkways (within the R -O -W) on Tierra Rejada Road; • the parkways (within the R -O -W) on the east side of Spring Road south of the Presbyterian Church; • certain slopes (beyond the R -O -W) on Science Drive south of the commercial / industrial frontage; • certain slopes (beyond the R -O -W) on Tierra Rejada Road; and • certain slopes (beyond the R -O -W) on Spring Road south of the Presbyterian Church. Note: The slope adjacent to the Institutional Lots is not included. b. Institutional Lot Assessment: In addition to the above General Assessment, the two assessed for the maintenance those lots. Institutional Lots will be of the slope adjacent to 2. Institutional Lot Assessment: The two Institutional Lots pay the General Assessment, plus an assessment for the cost of maintaining the slope adjacent to those lots. Public Hearing Notice: Although the Public Hearing Notice showed the Zone 12 assessments to be those set forth in the approved Engineer's Report, the amount of the assessments cited in the Mail Ballots sent to each affected property owner, were the amounts cited above. Accordingly, the above amounts may be set by the City Council if the majority of the votes cast are in support of the assessments. D. Ballot Support Attached as Exhibit 2A are recommended changes to the Engineer's Report which include the new Zone 12 Assessment described in Section C of this report, plus other changes discussed above in Section F below. If the results of the Mail Ballot are in support of the above described Zone 12 Assessment, it is recommended that the changes to the Engineer's Report described in Exhibit 2A be approved. E. Ballot Resection of Zone 12 Assessments Attached as Exhibit 2B are recommended changes to the Engineer's Report which do not include the new Zone 12 assessment described in Section C of this report, but are limited to only the changes discussed above in Section F below. If the results of the Mail Ballot are opposed to the above described Zone 12 Assessment, it is recommended that the changes to the Engineer's Report described in Exhibit 2B be approved. F. Other Changes The only other recommended changes to the Engineer's Report approved on May 5th are changes to certain of the Boundary Maps set forth in Exhibit 2A and Exhibit 2B. Make the changes to the Engineer's Report listed in Exhibit 2A [if the Zone 12 Ballots are opposed to the assessment, it is recommended that the changes in Exhibit 2B be approved]; 2. Make any other final desired changes to the Engineer's Report and to the proposed assessments for FY 1999/00; and, 3. Adopt the attached Resolution No. 99- (Exhibit 4) making certain changes to AD 84 -2 and confirming the assessments for Fiscal Year 1999/00. Ad84_2000_aprv3 000140 Exhibit 2A Changes to Engineer's Report Approval of Zone 12 Assessment June 4, 1999 Page 1 of The following is a list of the recommended changes to be made to the Engineer's Report approved by City Council Resolution No. 99- 1603, adopted on May 5, 1999. 1. Item 12 (Page 13-4): Language changes: "In addition to the landscape charges in the previous table, lots within the Carlsberg Specific Planned Community are assessed an additional landscape maintenance charge for the maintenance of landscaping within the specific plan area. The additional cost is $224.23: $272.59 per lot which is charged to all residential lots. The assessment for the commercial properties is $1,793.66 $817.77 per acre. The assessment for the institutional lots is $4,166.85 $4,712.01 per acre. The obligation upon these lots is pursuant to a condition of development, and such levy is supported by majority vote of the property owners on Official Ballots mailed to the affected properties pursuant to the requirements of Proposition 218." 2. The Boundary Maps are revised as follows: "Sheet 2 of 2 for Zone 12 is deleted and replaced by a new map of Zone 12 attached hereto as Exhibit 2A, Page 2 through 11." Gilbert, Director of Public Works DATE: May 21, 1999 (Meeting of 6 -2 -99) SUBJECT: Consider Final Review and Changes to the Engineers Report for AD84 -2 and the Adoption of a Resolution Confirming the Assessment Amounts for Fiscal Year 1999/00 EXECUTIVE SUMMARY This presents for approval a Resolution making certain changes to Assessment District AD84 -2 and confirming the assessments for Fiscal Year 1999/00. Certain background information pertaining to this action, including the subject Engineer's Report, is set forth in Exhibits attached hereto. A list of the Exhibits is as follows: Exhibits: 1. Engineer's Report 2. Summary of the recommended changes to the May 5, 1999, version of the Engineer's Report 3. Public Hearing Notice 4. Resolution: Setting Assessment Amounts for FY 1999/00 BACKGROUND A. General Information Assessment District 84 -2 was formed in 1984 pursuant to the provisions of the "Landscaping and Lighting Act of 1972." This assessment district was established to allow for the funding of street lighting and parkway /median landscape maintenance and improvement expenses through the levying of assessments as provided for in the act. The City must annually act to levy the lighting and landscape maintenance assessments. Said assessments have been levied each year since the formation of the district. ad84- 2000.apry .000153 AD84 -2: Approval of Assessments May 21, 1999 Page 2 There are two types of assessments generally described as follows: • Citywide Assessments: assessments applied to all of the lots in the City; and • Zone Assessments: assessments applied to properties within certain zones of benefit to fund maintenance and /or improvements which benefit those properties. B. Citywide Assessments There are two types of expenses funded by two distinct Citywide assessments: street lighting costs and certain parkway and median landscape maintenance costs. 1. Street lighting costs are distributed to all of the properties within the City by means of a formula designed to spread said costs on the basis of benefit. The benefit spread formula identifies a number of factors (including lighting intensity, lighting security, people use, etc.) which are associated with benefits derived, and then weighs those factors by land use as a means to determining benefits derived. 2. Citywide landscape maintenance costs are spread via a People Use formula in which twenty -five percent (25 %) of the total Citywide landscape maintenance costs is allocated to non- residential properties and the remaining seventy -five percent (75 %) is allocated and spread to residential properties. These allocated costs are spread to both non- residential and residential properties by a "people -use" benefit formula based on the land use of each parcel being assessed. C. Zone Assessments Landscape maintenance costs for each Zone of Benefit are spread to each lot within that Zone. Storm debris basin maintenance cost for certain Zones of Benefit, are spread evenly to selected lots within those Zones, deemed to derive benefit from such maintenance. In addition to these maintenance costs, certain Zones may receive an improvement assessment to fund approved improvements to be funded by the assessment for those zones. Except for Zones 7 and 9, the total assessment for each zone is distributed equally between the non - exempt parcels within each zone. The total assessment for the industrial parks covered by Zones 7 and 9, is spread to each non - exempt parcel via a per acre assessment. ad84- 2000.rpt 000154 AD84 -2: Approval of Assessments May 21, 1999 Page 3 D. Prior Actions 1. On January 20, 1999, the City Council adopted Resolution No. 99 -1562, initiating the proceedings for the levy of Assessments for AD84 -2 for FY 1999/2000. On that date the City Council also selected Charles Abbott Associates to provide Assessment Engineering services for said District. 2. On May 5, 1999, the City Council adopted Resolution NO. 99- 1603 approving the Engineer's Report and setting June 2, 1999, as the date of a public hearing to consider the levy of assessments for AD84 -2 for FY 1999/2000. DISCUSSION A. Approved Engineer's Report On May 5 the City Council approved the Engineer's Report for AD84 -2 for FY 1999/00. A copy of that report is attached as Exhibit 1. A summary of some of the information in that report is as follows: 1. Benefit Spread Formula: Provides a description and explanation of the Benefit Assessment Formulas used to calculate and spread the total assessment amounts to all of the affected lots. 2. Assessment Amounts: Sets forth the assessment amount for various land uses. 3. Boundary Maps: Contains the "Boundary Map, City of Moorpark Lighting and Landscaping Maintenance Assessment District No. AD84 -2.11, which show the boundaries of the entire Assessment District as well as the boundaries of each Zone of Benefit. These maps, along with the Ventura County Assessor Maps pertaining to properties within the City of Moorpark, constitute the AD84 -2 Assessment District Boundary Maps. 4. Changes to Report: Certain changes to the Engineer's Report are recommended to be approved by the City Council prior to the adoption of the Resolution setting the assessments for FY 1999/00. Those changes have been incorporated into the copy of the Engineer's Report attached as Exhibit 1. A summary of the changes is discussed below. B. Recommended Changes to Engineer's Report As mentioned above, it is recommended that the City Council approve certain changes to the Engineer's Report. Those changes are listed in Exhibit 2. It should be noted that it will be necessary to further revise the Engineer's Report subsequent to determining the results of ad84- 2000.rpt 000155 AD84 -2: Approval of Assessments May 21, 1999 Page 4 the Mail Ballots for the Zone 12 assessments. Those Mail Ballots are to be received, opened, tabulated and confirmed on June 16, 1999. It is recommended below that action on the Resolution setting the assessments be deferred until that date or a date subsequent thereto. C. FY 1998/99 Carryover Rebate For certain of the assessments for FY 1998/99 the amount placed on the tax bill was less than the amount of the actual assessment. This was done in order to rebate a portion of a prior year carryover surplus. Zones of Benefit 1. General: There are no new Zones of Benefit proposed to be added in FY 1999/2000. Zone Landscape Maintenance Assessment: The properties within each of the Zones of Benefit are assessed for the maintenance of certain designated landscaped areas deemed to be of benefit to the properties within that zone. 3. Storm Drain Debris Basin Maintenance: A portion of Zone 2, 5 and 10 are assessed for the maintenance of debris basins along the south boundary of the City. 4. Improvements: The lots within Zone 2 have in past years been assessed a $10 per lot improvement assessment for a future project to construct parkway landscaping on the north side of Tierra Rejada Road, east and west of Southhampton Road. It is proposed that this improvement assessment be assessed again in FY 1999/2000. With the FY 1999/2000 assessment, the total funds available in FY 1999/2000 for this construction project will be $37,060. H. Zone 12: Carlsberg Specific Plan Two years ago Zone 12 was established encompassing the properties within the Carlsberg Specific Plan. In that the median and parkway landscaping along the arterial streets in and adjacent to this project were only recently constructed, the assessment amount for Zone 12 for the past two years was zero. The landscaping in this area is now or will soon be completed. The developers of the properties within this project have asked that the City assume the maintenance of certain of these facilities. The funding for that maintenance would come from the Zone 12 assessment. ad84- 2000.rpt 00015S AD84 -2: Approval of Assessments May 21, 1999 Page 7 Ballots are being prepared, and will be provided to the owners of the properties within the Carlsberg Specific Plan, requesting a vote on the proposed Zone 12 assessment for FY 1999/2000. It is the intent of staff to have the ballots opened prior to the City Council meeting on June 16, and request the City Council to confirm the results of that ballot at the June 16 meeting. The figures regarding Zone 12, shown in the Engineer's Report and in this staff report, are preliminary and subject to change. More specific information pertaining to the Zone 12 assessments will be provided to the City Council, along with the results of the mail ballot, on June 16. The City Council will be asked to revise the Engineer's Report to reflect the results of the mail ballot. I. Zone 13: Campesina Park It should be noted that the Zone 13 assessment will be decreased to zero if the Parks Maintenance Assessment District is approved. In such case the changes to the Engineer's Report to be considered on June 16, will include such an action. J. Public Hearing The "Landscaping and Lighting Act of 1972" (Streets and Highways Code) requires a public hearing to be held prior to the annual levy of assessments for the purpose of receiving input and to hear any protests to the proposed assessments. Consistent with City Council direction on January 20, public hearing notices were not mailed to each of the affected property owners. This is the first year the City has not mailed notices. It was determined that, since there was to be no change, or at least no increase to the amount of the assessments, the cost of the notices was not justified. Attached as Exhibit 3 is a copy of the Public Hearing Notice for AD84 -2. Said Notice was published and posted as required by law. Said Notice sets the date of the public hearing as June 2, 1999, which is the first City Council meeting in June, as required by law. The Public Hearing Notice cites the assessment amounts set forth in the Engineer's Report. Deferred Action The attached resolution (Exhibit 4) making certain changes to Assessment District AD84 -2 and confirming the assessments for Fiscal Year 1999/00 must be adopted no later than June 30, 1999, in order for the assessments to be levied. In prior years the City Council has adopted such resolutions concurrently with the adoption of the budget. RECOMMENDATION Staff recommends that the City Council take the following actions: 1) open the public hearing, receive testimony and close the public hearing; 2) continue all other matters to the date of the Budget Workshops and /or June 16, which ever occurs first. The District will provide electrical energy for public lighting facilities and for operation and maintenance of public lighting within the city. In addition, the District will provide for installation and/or maintenance of erosion and flood control related public landscaping within the public right - of -way. SECTION 2 DEFINITION OF TERMS Assessment Rate - The assessment rate is the number assigned to each land use category. The assessment rate for a Level 1 Single Family Residential lot (land use code 1) is 1 for lighting assessment and 4 for erosion and flood control related landscape assessment. Assessment rates for other parcels in other land use categories, including publicly owned parcels, a re proportioned to these basic rates. These assessment rates remain unchanged. Methodology - The methodology is the formula used to derive the assessment rates of each land use category. The methodology has not been changed in several years. SECTION 3 METHOD AND RATES OF ASSESSMENT The methodology and assessment rates used for Assessment District No. AD -84 -2 have not changed for the past several years, and are based on how the facilities being maintained provide benefits as part of the system of streets which serve the City of Moorpark. 0001.63 Lighting The benefits of street lighting are for the convenience, safety and protection of people and the security or protection of property, property improvements and goods. The intensity or degree of illumination provided can have a bearing on both. The single family home - Level 1 has been selected as the base unit for the spread of assessments. By definition, the single family home - Level 1 is a single family home located on a street that has existing streetlights. An assessment rate of 1.00 has been assigned to the base unit, which is composed of benefit factors, which correspond to the following types of benefit. People Use - People related benefits 0.50 Security Benefit - Property protection 0.25 Intensity - Degree of illumination 0.25 Assessment Rate: 1.00 Parcels in other land use categories, including publicly owned parcels, were then rated by comparison with the basic unit. (See the following table.) People Use - People related benefits Reduction in night accidents and attendant human misery. 2. Reduced vulnerability to criminal assault during hours of darkness. 3. Promotion of business operations during evening hours. 4. Increased safety on roads and highways. Security Benefit - Property Protection Reduction in vandalism and other criminal acts, and damage to improvements. 2. Reduction in burglaries. Intensity Intensity or degree of illumination provided on streets varies with type of street, date of installation and the use of the property adjacent thereto. 2 000164 Landscaping The landscaping element of the spread formula recognizes that all properties within the City benefit from the maintenance of the landscaping within public rights -of -way and easements. These benefits include improved safety resulting from a regular tree trimming program and improved street sweeping capabilities resulting from trimming trees which may otherwise interface with street sweeping operations. The method of spreading maintenance costs is based upon the assessment rates, and the assessment rates are determined by the "people use" attributed to each land use within the City. This method was chosen because the benefit received is directly proportionate to the number of people generated by each land use. Recognizing that residential land uses within the City derive a higher degree of benefit than non - residential land uses, the formula was subdivided into two main groups, with residential land uses contributing in 75% of the assessment and non - residential uses being assessed for the remaining 25% of the maintenance costs. The single family home has been selected as the base unit for the spread of assessment. An assessment rate of 4 has been assigned by the base unit. Parcels in other land use categories, including publicly owned parcels, were rated by comparison with the basic unit. (See the following table.) The "people use" factors utilized in determining assessment rates and in the assessment district spread formula are shown in Appendix "B ". SECTION 4 DESCRIPTION OF IMPROVEMENTS TO BE MAINTAINED This report covers the period of July 1, 1999 through June 30, 2000. An updated report is prepared each year to reflect updated annual costs and changes in parcelization. The improvements to be maintained in this District include all City-owned and Southern California Edison (S.C.E.) -owned streetlights as well as all medians and street trees within public rights -of- way within the boundaries of the city. Lighting maintenance shall include, but is not limited to, energy costs, removal, repair, replacement or relocation of light standards, poles, bulbs, fixtures and all appurtenances. Servicing of S.C.E. owned lights as defined in Section 22538 of the Streets and Highways Code shall be furnished by the Southern California Edison Company or its successors, or this servicing shall be as authorized by the Public Utilities Commission, State of California. Maintenance of City-owned lighting improvements shall be furnished by the City. Landscape maintenance for erosion and flood control shall include, but is not limited to, watering, fertilizing, mowing, weed control, shrubbery, tree removal and pruning, removal and replacement of dead growth, maintenance of irrigation facilities and other necessary work. 3 000165 In addition, the cost to maintain improved areas within an easement will be borne by owners within that project. These easement areas are: Tract No. 2851 Maintenance costs associated with landscaping in the Ventura County Flood Control Easement and portions of the interior tract entry areas. The obligation upon these 75 lots is pursuant to a condition of development. 2. Tract No. 2865 Cost for maintenance of specific landscape areas and debris basins within the tract, including landscaping at Christian Barrett & Spring Roads; Tierra Rejada landscaping, and Peach Hill Road landscaping on east side between Christian Barrett and Tierra Rejada Roads, and the entry monument sign at Christian Barrett and Spring Road. Also, an additional assessment for the improvement of parkway landscaping on the north side of Tierra Rejada Road east and west of Southhampton Road. The obligation upon the lots within this tract is pursuant to a condition of development. 3. Tract No. 3032 Maintenance costs associated with landscaping an entry monument at Buttercreek Road and Los Angeles Avenue. This cost to be spread to the 265 lots within the tract. 4. Tract No. 3274 Maintenance costs associated with landscape areas along Williams Ranch Road parkway adjacent to Peach Hill drain channel and Edison entries within PC -3. This cost will be borne by the 129 lots within the tract. 5. Tract Nos. 3019, 3525 Maintenance costs associated with debris basins and landscaping the Tierra Rejada Road slope and parkway areas and parkway on the west side of Peach Hill Road between Williams Ranch and Tierra Rejada Roads within Tract Nos. 3019 and 3525. The cost is to be spread to the 217 lots within the tracts. 6. Tract 3306 Cost for maintenance of landscape areas within Tract 3306 at the westerly terminus of Inglewood Street. The cost is to be spread to the 22 lots within the tract. 7. Los Angeles Avenue Parkway 4 OOOIGG Maintenance costs associated with landscaping the parkway on the north side of Los Angeles Avenue between Gabbert Road and Shasta Avenue will be borne by all industrial lots northerly of Los Angeles Avenue, southerly of Poindexter Avenue, easterly of Gabbert Road, and westerly of Shasta Avenue. 8. Home Acres Buffer Area Maintenance costs associated with the buffer area at the west end of the West Ranch area, is to be split 50 -50 between the residential properties within the West ranch area and the area outside the City known as Home Acres. That portion of this Zone of Benefit with the City consists of the residential areas within Tract 4340, 4341, 4792 and a portion of tract 4342. This area is bounded on the north by the Arroyo Simi, on the east by Tierra Rejada Road and the Commercial property at the corner of Tierra Rejada Road and Mountain Trail Street, on the south by Tracts 4637, 4342 -5 and the City boundary and on the west by the City Boundary. 9. Condor Drive Industrial Park Maintenance costs associated with the parkway located at the northwest corner of Los Angeles Avenue and Virginia Colony Place will be borne by the developed parcels within the Industrial park on Condor Drive (Tract 3492). 10. PC -3 Maintenance costs associated with landscaping and debris basins within this area will be borne by all properties within the Mountain Meadows Planned Community (PC -3). The landscaping to be maintained consists of the Peach Hill Wash Linear Park, the slope along the north side of the Peach Hill Wash and the downstream flood control facility located just east of Mountain Trail Street and certain parkways on Tierra Rejada Road. 11. Tract 4174 Colmer Maintenance costs associated with landscaping within this area will be borne by all properties within the tract. 12. Carlsberg Specific Plan Maintenance costs associated with landscaping and debris basins within this area will be borne by all properties within the planned community. Landscaped areas to be maintained shall include the Science Drive median, the Spring Road median south of Peach Hill Road, certain parkways on Spring Road, Tierra Rejada Road and Science Drive as identified on the boundary map for Zone 12, and certain slopes adjacent to Spring Road, Tierra Rejada Road and Science Drive as identified on the boundary map for Zone 12. 5 00016'7 13. Campesina Park Improvement and maintenance costs associated with the improvements within this park will be borne by all properties within Tract 4147. Plans and specifications for the irrigation, landscaping and lighting of streets, parks and easements, and other authorized improvements within the City are on file in the Department of Public Works. The lighting locations and specifications for Edison -owned lights are on file with the Southern California Edison Company. Reference is hereby made to said plans and specifications for the exact location and nature of the landscape and lighting improvements. Said plans and specifications by reference are hereby made a part of this report. SECTION 5 ASSESSMENT ROLL All parcels of real property affected are listed on the "Assessment Roll ", Exhibit "A," which will be on file in City Hall with the City Clerk, and is made a part hereof by reference. These parcels are more particularly described in maps prepared in accordance with Section 327 of the Revenue and Taxation Code which are on file in the office of the Ventura County Assessor in the County Government Center Administration Building, 800 S. Victoria Avenue, Ventura, California and which are also made a part hereof by reference. SECTION 6 COST ESTIMATE The City staff recommendation for the District budget is shown in Appendix "D" of this report. The costs attributed to landscaping and the costs attributed to lighting will be separately appointed, according to the formula, and added together to constitute the total assessment for each parcel. CONCLUSION In conclusion, it is our opinion that the assessments within Lighting Maintenance Assessment District No. AD -84 -2 are apportioned by a formula that fairly distributes the net cost in accordance with the benefits that are received. In addition to the landscape charge on the previous table, 265 lots within Tract No. 3032 are assessed an additional landscape maintenance charge for the maintenance of an entry monument at Buttercreek Road and Los Angeles Avenue and landscaping on the south side of Peppermill Street. The additional cost per lot is $11.62. 4 . In addition to the landscape charge on the previous table, 129 lots within Tract No. 3274 are assessed an additional Iandscape maintenance charge for the maintenance of the landscaped barrier in Williams Ranch Road at the Edison power lines, and the parkway landscaping on both sides of Williams Ranch Road east and west of the Edison Easement. In addition to the landscape charge on the previous table, 217 lots within Tract Nos. 3019 and 3525 are assessed an additional landscape maintenance charge for the maintenance of the Tierra Rejada Road slope and parkways, including the entry statements at Pheasant Run Street, and the parkway on the west side of Peach Hill Road between Williams Ranch and Tierra Rejada Roads. In addition to the landscape charge on the previous table, 96± AC northerly of Los Angeles Avenue, southerly of Poindexter Avenue, and between Gabbert and Shasta Avenues are assessed an additional landscape maintenance charge for the maintenance of the parkway on the north side of Los Angeles Avenue Parkway. The additional cost is $130.88 per acre. 8. In addition to the landscape charge on the previous table, 492 residential units within Tracts 4340, 4341, 4792 and a portion of Tract 4342 are assessed an additional $15.40 for fifty percent (50 %) of the improvement and maintenance costs for the Home Acres Buffer area. The remaining fifty percent (50 %) of such costs are recovered via an assessment upon the properties in the Home Acres area, in the amount of $37.69. AD -84 -2" AND CONFIRMING THE ASSESSMENT FOR SAID DISTRICT THE FISCAL YEAR COMMENCING JULY 1, 1999 AND ENDING JUNE 30, 2000. WHEREAS, the City Council of the City of Moorpark, by Resolution No. 99 -1562, adopted January 20, 1999, declared its intention to make certain changes to the "MOORPARK LIGHTING AND LANDSCAPING MAINTENANCE DISTRICT NO. AD- 84 -211, and to order the extension of the annual assessments for said district for the fiscal year commencing July 1, 1999 and ending June 30, 2000; and WHEREAS, said Resolution No. 99 -1562 ordered the City Manager to cause to be prepared an Engineer's Report for Assessment District 84 -2 for FY 1999/000 in accordance with Article 4, Chapter 1, Part 2, Division 15 of the California Streets and Highways Code; and WHEREAS, said "MOORPARK LIGHTING AND LANDSCAPING MAINTENANCE DISTRICT NO. AD -84 -2" consists of a single city -wide zone to provide electric current or energy for public lighting within the City, to install, construct or maintain any authorized improvements under the Act, including but not limited to one or more of street lights, public lighting facilities, landscaping, statuary, fountains, and other ornamental structures and facilities, and any facilities which are appurtenant to any of the aforementioned or which are necessary or convenient for the maintenance or servicing thereof, including irrigation, electric current and energy; and to provide incidental expenses in connection therewith; and WHEREAS, said "MOORPARK LIGHTING AND LANDSCAPING MAINTENANCE ASSESSMENT DISTRICT NO. AD -84 -2" also consists of a number of specific zones in order to provide for the assessment of the properties within said zones for the cost of maintaining certain specified improvements which benefit said properties; and WHEREAS, pursuant to the terms of a Joint Powers Agreement (JPA) between the City of Moorpark and the County of Ventura, the City Council of the City of Moorpark, by Resolution No. 92 - 860 adopted on June 29, 1992, annexed certain unincorporated area just 000225 Resolution No. 99- _ Page 2 west of the City known as Home Acres, to the "MOORPARK LIGHTING AND LANDSCAPING MAINTENANCE ASSESSMENT DISTRICT NO. AD -84 -2" in order to implement those provisions of the JPA pertaining to the construction and maintenance of a buffer area between said unincorporated area and the West Ranch area of PC -3 (Tracts 4340, 4341 and 4342); and WHEREAS, in accordance with the provisions of the aforesaid JPA, it has been determined that said buffer area provides benefit to both the aforesaid Home Acres area and the West Ranch area of PC -3, and a Zone of Benefit encompassing said areas was established to allow for the levy of assessments on the properties within said Zone of Benefit for the purpose of developing and maintaining said buffer area; and WHEREAS, the City Council of the City of Moorpark, by Resolution No. 99 -1603, adopted May 5, 1999, approved the Engineer's Report pertaining to such matters; and WHEREAS, certain of the assessment amounts forwarded to the County Tax Collector in FY 1998/99 were net amounts subsequent to a credit given for a prior year carry over -- the actual assessment amount being the full assessment prior to said credit; and WHEREAS, the assessment amounts for FY 1999/2000 for Zone 12 have been increased from zero to the amounts indicated in the Engineer's Report, said assessment amounts being consistent with the results of a mail ballot approving said assessments, which was provided to all affected property owners consistent with the requirements of Proposition 218; and WHEREAS, except as noted in above, the assessment amounts proposed for FY 1999/2000 have not changed from the assessments levied in FY 1998/99; and WHEREAS, subsequent to the adoption of Resolution 99 -1603 approving the Engineer's Report, the City Council has approved a number of changes to the Engineer's Report as deemed necessary and appropriate; and WHEREAS, said Resolution No. 99 -1603 also set 7:00 p.m., June 2, 1999, as the time and date of a public hearing to consider such matters; and WHEREAS, on June 2, 1999, the City Council held a public hearing to determine whether said changes to said district should be made, and whether the annual assessments should be ordered and confirmed for the fiscal year commencing July 1, 1999, and ending June 30, 2000; and 000226 Resolution No. 99- _ Page 3 WHEREAS, the City Council finds that written protests against the proposed work or assessment have not been made by owners representing more than one -half of the area of land to be assessed; and WHEREAS, the City Council, having duly received, considered evidence, oral and documentary, concerning the jurisdictional facts in this proceeding and concerning the necessity for the contemplated work and benefits to be derived therefrom, and the City Council having now acquired jurisdiction to order the proposed assessments for the fiscal year commencing July 1, 1999, and ending June 30, 2000. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. The Engineer's Report for "MOORPARK LIGHTING AND LANDSCAPING MAINTENANCE DISTRICT NO. AD- 84 -2 ", filed with the City Clerk on May 5, 1999, as amended or revised by action of the City Council, is hereby approved and adopted, and the improvements, changes to, and extension of the annual assessments in the Assessment District, in accordance with said report, as revised, and in accordance with Resolution No. 99 -1603 approving said Engineer's Report, is hereby levied for the Fiscal Year 1999/00.
