SUBJECT: Certification of the Tabulation of Ballots Received
Regarding the Proposed Levy of Landscape Maintenance
Assessments Upon the Properties Within Zone 12 of
Assessment District 84 -2 - Carlsberg Specific Plan
DISCUSSION
A. Background
Two years ago Zone 12 was established in Assessment District
84 -2, encompassing all of the properties within the Carlsberg
Specific Plan. In that the median and parkway landscaping
along the arterial streets in and adjacent to this project
were only recently constructed, the assessment amount for Zone
12 for the past two years has been zero.
B. Request
The landscaping in this area is now or will soon be completed.
The developers of the properties within the Carlsberg Specific
Plan have asked that the City assume the responsibility for
the maintenance of this landscaping and that the expense for
same be funded by the Zone 12 assessment.

C. Scope of Improvements to be Maintained
The scope of the landscaping to be accepted and maintained by
the City, and funded by the Zone 12 Assessment, is generally
shown on the map attached as Exhibit 1, and generally
described as follows:
1. General Assessment: All of the affected properties will be
assessed an amount necessary to fund the following
landscape improvements:
• the medians on Science Drive;
• the parkways (within the R -O -W) on Science Drive south of
the Commercial /Industrial Frontage;
• the parkways (within the R -O -W) on Tierra Rejada Road;
• the parkways (within the R -O -W) on the east side of
Spring Road south of the Presbyterian Church;
• certain slopes (beyond the R -O -W) on Science Drive south
of the Commercial / Industrial frontage;
• certain slopes (beyond the R -O -W) on Tierra Rejada Road:
and
• certain slopes (beyond the R -O -W) on Spring Road south of
the Institutional lots.
Notes: (1) Maintenance of the slope areas will require
conveyance of a landscape easement to the
City; and
(2) The slope adjacent to the Institutional
lots is not included in the General
Assessment (see below).
2. Institutional Slope Assessment: In addition to the above
General Assessment, the institutional lots will be assessed
an additional amount necessary to fund the maintenance of
the slope adjacent to those lots.

E. Estimated Annual Maintenance Costs / Spread Formula
With input from the developers and their landscape architect,
staff developed estimated annual costs for the maintenance of
the landscaping identified in Section C above. Staff also
developed formulas for spreading these costs to the various
properties within the Specific Plan Area. The total assessment
amounts identified below are sufficient to fully fund these
estimated annual maintenance costs.

G. Distribution of Ballots
On June 2 Ballots were sent to the owners of the affected
properties. A copy of the Ballot is attached as Exhibit 2.
Each Ballot identified the assessment amounts for each
property based upon the assessments cited in Section F -1
above. A list of the affected property owners and assessment

H. Future Adjustment of Assessment Amount
Each ballot indicates that the City reserves the right to
increase the assessment for subsequent years in an amount not
to exceed the increase in the Consumer Price Index (CPI).
I. Votes
The owner of each affected property receives one vote for each
dollar assessed to that property. Support of the assessment
requires a majority vote from the ballots received.
J. Ballot Results
The deadline for submittal of the ballots is 5:00 p.m., June
16, 1999, just prior to the regularly scheduled City Council
meeting of that date. A supplemental report will be provided
to the City Council at the June 16 meeting regarding the
tabulation of the ballots received.
K. Acceptance and Maintenance of Improvements
It is the intent of staff to work with the developers of the
landscape improvements over the next few months on the various
tasks required to be completed prior to the City accepting and
maintaining the subject landscape improvements identified in
Section C above. The prerequisites for such action include,
but may not be limited to, the following:
1. Inspection and acceptance of the irrigation and landscape
improvements as being complete and in conformance with the
landscape architectural design plans and specifications and
City's specifications for landscape improvements maintained
by the City;
2. Identification of all water and electrical services for
said improvements, including meter numbers, service
numbers, locations and areas served;
3. Compilation and presentation, in a form acceptable to the
City, all required irrigation controller staging charts and
diagrams;
4. Except as noted in Number 6, completion of all irrigation
systems modifications necessary to separate water and
electrical services supplying City maintained landscaping
from landscaping to be maintained by others;

5. Compilation and processing of all applications and related
paperwork required for the transfer of necessary water and
electrical services to the City;
6. Identification of which, if any, water and electrical
services supplying City maintained landscaping will not be
transferred to the City because separation of City
maintained facilities and non -city maintained facilities is
impractical; and
7. In the event, utilities for certain of the City maintained
landscaping is to be provided by others, determine what, if
any, of the costs for those services will be refunded to
said utility customer by the City's Zone 12 assessment.
It is recommended that the landscape improvements identified
in Section C above not be accepted by the City unless and
until all of the prerequisites for same (as solely determined
by the City Manager and not limited to those items listed
above) have been completed to the satisfaction of the City
Manager. In the event it is determined that a portion of the
total improvements are in a condition suitable for acceptance,
partial acceptance may be approved.
L. Summary
The staff recommendations are based on the expectation that
the results of the ballot tabulation will be in support of the
proposed assessment. If the results are otherwise, staff will
revise the recommendations.
STAFF RECOMMENDATIONS
Staff recommends that the City Council take the following
actions:
1. Certify the tabulation of Ballots received pertaining to
the levy of assessments within Zone 12 (Carlsberg Specific
Plan area) of Assessment District 84 -2, finding the results
of said Ballot to be in favor of said future assessment.
2. Direct staff to include in the final amended Engineer's
Report for AD84 -2 for FY 1999/00, the assessment amounts
for Zone 12 identified in this report.

3. Authorize the City Manager to accept for maintenance the
landscape improvements identified in Section C of this
report, upon completion of the requirements for same as
discussed in Section K of this report, provided any such
acceptance does not occur prior to July 1, 1999, and
provided a Zone 12 assessment for FY 1999/00 is levied by
the City Council.

OFFICIAL BALLOT
SPECIAL BENEFIT ASSESSMENT
This is your official ballot to cast your vote on a Special Benefit Assessment to your property tax.
The ballot must be completed, signed and received by June 16, 1999, at 5:00 p.m.
This ballot must be returned to the City sealed in the enclosed stamped envelop, either by
mail or in person, to the City Clerk at the Moorpark City Hall, 799 Moorpark Avenue,
Moorpark, California, 93021. All of the envelops received pertaining to this ballot will be
opened at 5:30 p.m. on June 16, 1999.
This ballot pertains to the assessment for [AP Nos.
The total number of single family residential lots to be constructed upon this lot is ]
The total annual assessment for the above described property for FY 1999/00 is calculated by
multiplying the total number of residential lots by the per lot assessment amount, as follows:
The property owner understands that in future years the assessment amount may be increased to
cover maintenance cost increases due to inflation, provided said increase does not exceed the
increases to the Consumer Price Index (CPI) for all Urban Consumers for the Los Angeles
Metropolitan area. The property owner further understands that should this provision allowing for
future increases to the assessment amount be held to be invalid or unconstitutional by any court of
competent jurisdiction, such decision shall not affect the validity of the above stated assessment.
