Subject: Consider Conveyance of An Easement to the Southern
California Edison Company (SCE) and a Quitclaim Deed to
the Ventura County Flood Control District (VCFCD) for
the Access Ramps from Tierra Rejada Road to the
Maintenance Levee Road Along the North Side of the
Arroyo Simi
DISCUSSION
A. Background
In 1989 certain properties (see Exhibit 1) were acquired from
the Boething Family Trust, which were needed in order to
construct the Tierra Rejada Road bridge across the Arroyo
Simi. Those properties were acquired by Court Order under
eminent domain proceedings.
The Court Order stated that the City was to convey to the
electrical utility and the Ventura County Flood Control
District (VCFCD) , access rights to the ramps from Tierra
Rejada Road to the levee maintenance road on the north side of
the arroyo. Efforts to convey these rights were hampered by
problems with the legal descriptions of the properties
contained within the Court Order. Those problem were recently
resolved with the recordation of a new deed from the Boething
Family Trust to the City.
B. Concurrence with Proposed Action
Staff has been working with SCE and the VCFCD over the past
several years to convey to those agencies access rights to the
levee access ramps. Both agencies concur with and support that
objective.

C. Easement to SCE
Attached as Exhibit 2 is an Easement Deed from the City to
SCE, conveying to that utility legal access rights to the
subject levee ramps.
D. Quitclaim to VCFCD
In that the subject ramps are provided for the sole purpose of
providing access to the maintenance road along the north levee
of the arroyo, there is no particular reason why the ownership
of these ramps should remain with the City. It is recommended,
therefore, that these parcels be "Quitclaimed" to the primary
user - the Ventura County Flood Control District (VCFCD) . It
is also recommended that this property transfer occur
subsequent to the recordation of the Easement to SCE.
It is the intent of staff to prepare such a Quitclaim Deed for
the subject access ramps. Said document would convey to the
VCFCD the City's interest in these properties.
RECOMMENDATION
Staff recommends that the City Council take the following actions:
1. Authorize the Mayor to execute an Easement Deed (Exhibit 2) to
SCE for subject properties, and direct the City Clerk to cause
said Easement Deed to be recorded.
2. Authorize the Mayor to execute a Quitclaim Deed to the VCFCD
for the same subject properties, and direct the City Clerk to
cause said Quitclaim Deed to be recorded subsequent to the
recordation of the Easement to SCE.

ROAD EASEMENT
THE CITY OF MOORPARK, a municipal corporation, does hereby grant to SOUTHERN
CALIFORNIA EDISON COMPANY, a corporation, its successors and assigns, hereinafter called Grantee, an
easement and right of way to construct, reconstruct, use, maintain and repair existing roadways in, on,
over, along and across that certain real property in the County of Ventura, State of California, described as
follows:
Those certain parcels of land situated in the City of Moorpark, County of Ventura, State
of California being those portions of Subdivision "L ", as per map entitled "Map of the Lands of Rancho Simi
in Ventura and Los Angeles Counties, California" and recorded in Book 3, page 7 of Maps, in the Office of
the County Recorder of Ventura County, and of Lot 37 of Fremont Tract as per map recorded in Book 3,
page 39 of Maps, in the Office of the County Recorder of Ventura County, consisting of two parts and
described as follows:
Part A:
Parcel 10 as described in that certain Final Order and Judgment in Condemnation, in
Superior Court Case No. 96763, a certified copy of which is recorded on October 11, 1989 as Document
No. 89- 16 879 0 of Official Records, in the Office of said County Recorded, described as follows:
That certain parcel of land situated in the County of Ventura, State of California being
those portions of Subdivision "L" as per map entitled "Map of the Lands of Rancho Simi in Ventura and Los
Angeles Counties, California" and recorded in Book 3, Page 7 of Maps in the office of the County Recorder
of Ventura County, and of Lot 37 of Fremont Tract as per map recorded in Book 3, Page 39 of Maps, in the
office of the County Recorder of Ventura County, described as a whole as follows:

Company, recorded November 30, 1960 in Book 1933, Page 408 of Official Records in the office of said
County Recorder; thence South 59° 13' 24" West 17.90 feet along said Northwesterly line to a point in a
non - tangent curve concave to the Southwest having a radius of 60.00 feet and to which point a radial line
bears North 24° 48'07" East; thence Northwesterly 32.26 feet along said curve through a central angle of
30° 48' 33" to the Southerly prolongation of said Easterly line; thence North 000 24' 41" East 27.46 feet

Records in the office of said County Recorder; thence along said Northwesterly line South 59° 13'24" West
35.74 feet to the True Point of Beginning; thence continuing along said Northwesterly line south 59° 13'
24" West 28.58 feet; thence North 11° 51' 17" East 21.16 feet to the beginning of a curve concave to the
Southeast having a radius of 59.00 feet; thence Northeasterly 73.88 feet along said curve through a central
angle of 71° 44' 34" to the Southerly prolongation of said Westerly line; thence South 00° 24' 41" West
30.17 feet along said Southerly prolongation to a point in a non - tangent curve concave to the Southeast
having a radius of 42.00 feet and to which point a radial line bears North 9° 10' 58" West; thence
Southwesterly 39.49 feet along said curve through a central angle of 530 52' 19" to the True Point of
Beginning.
The location of said roadways (Part A and Part B) are shown on the Exhibit "B" attached
hereto, and by this reference made a part hereof.
In the event that public roads are constructed, which in the sole opinion of the Grantee,
its successors or assigns, will provide Grantee with access as convenient and adequate as that which
Grantee, its successors or assigns, may then be using, Grantee, its successors or assigns, agree to
quitclaim any such portion or portions of the rights herein granted which are no longer required
hereunder as may be determined by Grantee, its successors or assigns.
