Subject: Consider Acceptance and Maintenance of Spring Road
Median Landscaping

This requests a determination regarding the future City acceptance
and maintenance of the median landscaping on Spring Road between
Tierra Rejada Road and the Arroyo Simi bridge.
DISCUSSION
A. Landscape Improvements
The off -site improvements required to be constructed within
and adjacent to the Carlsberg Specific Plan, included parkway
landscaping on Science Drive, Tierra Rejada Road and Spring
Road, and median landscaping on Science Drive and Spring Road.
With the exception of the Spring Road median landscaping, all
of these improvements have been constructed. Although the
irrigation system for the Spring Road medians has been
installed, the developer was asked to defer installation of
the landscaping until after a determination had been made
regarding the future maintenance responsibility of these
medians and the source of funding for that maintenance.
The design for the Spring Road median landscaping calls for
ground cover and trees in the wider areas just north of Tierra
Rejada Road and just north of Peach Hill Road, with only tree
wells in the other areas.

B. Zone 12 Assessment
On July 21 the City Council will consider increasing the Zone
12 (Carlsberg Specific Plan) assessment from zero to a figure
required to fund the annual maintenance costs for certain
specified landscaping within Zone 12. The improvements to be
maintained by that assessment will not include the Spring Road
medians.
C. Request for Determination
The developer for the major "backbone" systems for the
Carlsberg Specific Plan area is nearing the end of those
construction efforts. That developer has asked that the City
advise whether or not the Spring Road median landscaping is to
be installed.
D. Spring Road / Tierra Rejada Road AOC Reimbursement
It should be noted that developer costs for the construction
of the subject landscaping would be included in the costs the
City would reimburse the developer from the Spring Road /
Tierra Rejada Road AOC Fund. Due to the Spring Road Bridge
Reconstruction project, there are no funds currently available
to pay that reimbursement. The developer is aware that the
City will defer payment of the reimbursement, possibly to be
made in installments, until funds become available as the
result of AOC fees payments by the developing properties
within the Carlsberg Specific Plan Area.
E. Annual Maintenance Costs / Fundinq Sources
The estimated annual cost for the maintenance of the Spring
Road medians is $6,000. Initially maintenance would be
provided by, or funded by, the developer as required by the
conditions set forth in Section F of this report. Pursuant to
those conditions, the City would not incur any costs until
FY2001 /02. In that and subsequent years such costs would be
funded by the Citywide landscape assessment levied by
Assessment District AD84 -2. These added costs are not expected
to cause expenses to exceed assessments.
It should be noted that at some point in the future, as more
areas are added and /or the cost of maintaining existing
facilities increase, Citywide maintenance costs may exceed
assessment revenues. At that time the City would have to
consider providing funding from other sources and /or consider
a Citywide Mail Ballot to seek approval of an increase to the
assessment.

F. Acceptance: Conditions
It is recommended below that the developer be directed to
proceed with the construction for the Spring Road median
landscaping. It is also recommended that, when completed, the
subject landscaping be accepted by the City subject to certain
conditions, listed as follows:
1. All work shall be constructed in accordance with the
approved plans and specifications;
2. The developer shall provide for the transfer to the City
of the water and electrical services for only the median
landscaping;
3. The developer shall provide for a two -year maintenance
period, to commence on the date the City approves the
completion of the installation;
4. The developer shall pay the City $6,000, said amount being
equal to the estimated cost for the City to maintain said
improvements for a period of one year from the date of the
end of the two -year maintenance period; and,
5. The City may accept early "buy -out" of the maintenance
period described in Condition #2, at the rate of $500 per
month of the time remaining in the maintenance period,
said "buy -out" date to be determined solely by the City.
RECOMMENDATION
Staff recommends that the City Council take the following actions:
