C1 11 Of - 'ri0E3kl' '4 th, C.10 _1 101UNIA of l �� ACTION: BY:u�� -� Works Subject: Consider Acceptance of a Grant Deed for Additional Street Right -of -Way on the South Side of Poindexter Avenue West of Sierra Avenue and Acceptance of a Related Deed for a Temporary Construction Easement OVERVIEW On June 23, 1999, the City Council approved the Right -of -Way Acquisition Agreement between the City and the grantors (Mr. and Ms. Roe), which set forth terms and conditions for the conveyance to the City of additional street right -of -way on the south side of Poindexter Avenue west of Sierra Avenue, plus a related Temporary Construction Easement. This report presents those deeds for acceptance and recordation. DISCUSSION A. Construction Project 1. Description: The acquisition of the subject street right - of -way and the widening of the south side of Poindexter Avenue at the subject location, is part of a much larger project to construct curb, gutter and sidewalks on the north side of the street from Sierra Avenue to Gabbert Road. A brief description of the various elements of the Poindexter improvement project is as follows: a) the subject street acquisition and street widening on the south side of Poindexter Avenue; b) construction of additional pavement width on the north side of Poindexter Avenue to accommodate painted Bike Lanes on both sides of the street; c) construction of a sidewalk on the north side of Poindexter Avenue from Sierra Avenue westerly to Gabbert Road; Pndx row roe 000418 Poindexter Improvement Project Right -of -Way Deed July 7, 1999 Page 2 d) the relocation of certain telephone poles on the north side of the street to locations compatible with the location of the new curb and sidewalk; e) the re- striping of Poindexter Avenue and Gabbert Road to provide painted Bike Lanes on both sides of these two streets; f) the re- striping of Poindexter Avenue to provide a center median and /or left turn lane; g) reconstruction of certain driveway aprons to render them handicap accessible; and, h) the construction of drainage improvements at the intersection of Gabbert Road and Poindexter Avenue. 2. Design: The City retained M3 Civil Engineering to prepare the plans and specifications for this project. That design effort is 99% complete. 3. Cost Estimate: The estimated cost of the project is as follows: • Construction . . $380,000 • Construction Contingency . . $ 38,000 $418,000 • Design . . $ 27,000 • Contract Admin / Inspection . . $ 50,000 $495,000 4. Funding: The City has received a State Bicycle / Pedestrian Facilities (SB -821) grant in the amount of $175,000 for this project. The remainder of the project funding is to come from the Local Transportation Fund (Fund 23). 5. Construction: In late July or early August it is the intent of staff to present to the City Council a Request for approval of the plans and specifications and authorization to advertise for receipt of bids. The plan is to be under construction in September. B. Deeds Attached as Exhibit 1 is a copy of the subject Grant Deed for the additional required street right -of -way. Attached as Exhibit 2 is a copy of the Temporary Construction Easement south of and adjacent to the added street right -of -way. The original signed documents have been provided to the City Clerk. Approve the Certificates of Acceptance for the subject Temporary Construction Easement and direct to the City Clerk to forward said Certificate and related Temporary Easement Deed to the County Recorder for recordation. 2. Approve the Certificates of Acceptance for the subject Grant Deed for additional street right -of -way and direct to the City Clerk to forward said Certificate and related Grant Deed to the County Recorder for recordation.
