Subject: Consider Minor Modification No. 1 to Planned Development
Permit No. 939 proposing construction of a wrought iron
fence and gates at the Los Angeles Avenue entrance to
Regal Park Homes (Applicant: Regal Park Homeowners
Association)
SUMMARY
This request is for the construction of a wrought iron fence and
gates across the Los Angeles Avenue access to the Regal Park
Condominiums, to restrict vehicular access to this residential
community. If constructed, the fence and vehicle gate will provide
for exiting traffic only, however, ingress by emergency vehicles
will still be allowed and key controlled pedestrian access in both
directions may still take place.
BACKGROUND
On September 21, 1983, the City Council adopted Resolution No. 83-
40 on the application of S.T.G. Development, approving Planned
Development No. 939 for the construction of 120 condominiums on an
8.66 acre parcel on Los Angeles Avenue, 500' east of Moorpark
Avenue. Access points to this site are currently provided on Los
Angeles Avenue and Majestic Court. No Zone Clearances have been
issued for the subject property since completion of the units in
1986 and 1987.

Definitions of Zoning designations: R -2 = Two Family Residential,
RPD = Residential Planned Development 12 and 15 units per acre, OS
= Open Space (10 acres per unit). General Plan Designations are: H
= High Density, VH = Very High Density, S = Schools, OS -2 = Open
Space (40 acres per unit).
This project is within the Redevelopment Project Area but not the
Downtown STDecific Plan Area.
DESCRIPTION
The exit gate and fence is proposed to be located 56' south of the
Los Angeles Avenue right -of -way (property line), as shown on
Exhibit 3. Both the fence and gate are proposed to be constructed
of wrought iron and painted black. The rolling vehicle exit gate
which will secure the 34' wide driveway is proposed to be 20' in
length and seven feet (71) in height. The gate will be connected to
the eastern property line by a ten (10) foot long, seven (7) foot
high wrought iron fence placed perpendicular to the landscaped
setback area. The gate will be connected to Building 1 on the west
by a wrought iron fence, 32' in length and seven (7) feet in
height. A four (4) foot wide pedestrian gate is also proposed to be
installed within this 32' long fence to allow a new pedestrian
walkway to connect the interior of the project to Los Angeles
Avenue. The control box and keycard for the vehicle gate will be
located adjacent to the westerly vehicle opening within the complex
(south side of the fence) as shown on Exhibit 3. A card control
system is proposed rather than a pavement sensor to limit all
movement through this driveway to Regal Park residents or other
authorized vehicles including emergency vehicles.
Applicant is requesting installation of this gate to reduce the
level of vehicular traffic which travels through the Regal Park
complex to other destinations. Vehicles originating from off -site

of Regal Park and entering from Los Angeles Avenue or from Majestic
Court have used this driveway as a pass- through for years to avoid
the Los Angeles and Moorpark Avenue intersection. Approval of this
request to install fencing and a gate would limit exiting from
Regal Park to residents only, as a card would be needed to activate
the gate and eliminate access for all vehicles from Los Angeles
Avenue except emergency vehicles. As a result, the residents of
Regal Park will be required to enter their community from Majestic
Court only, but may exit via Los Angeles Avenue or Majestic Court.
VEHICULAR ACCESS
As proposed, a 56' stacking area (three vehicles) will be created
on the Los Angeles Avenue side of the gate. The distance to the
gate from Los Angeles Avenue and the 34' driveway width is
sufficient to allow a passenger vehicle dropping off passengers or
accidentally entering the site to turn around (one vehicle at a
time). On the interior (south) side of the gate, the distance from
the gate to the nearest parking space is 821, which provides for
sufficient stacking area (four vehicles) for vehicles waiting to
exit onto Los Angeles Avenue. Construction of the gate will not
result in the loss of any parking space, or the reduction in access
to any trash enclosure or driveway.
Construction of the gate for exiting only onto Los Angeles Avenue
will not adversely effect the circulation pattern for Regal Park.
Currently, westbound entry to the site from Los Angeles Avenue
(left turns) is prohibited by the striping configuration of the
street. Although eastbound entry to the site from Los Angeles
Avenue would not be allowed, vehicles will continue to be able to
enter the site via Majestic Court from Moorpark Avenue.
FENCE REQUIREMENTS
Applicant is proposing a height of seven (7) feet for the exit gate
and the wrought iron fences on both sides of the driveway, which is
inconsistent with Section 17.24.090 of the Municipal Code which
limits the height of fences, including the gate, to six (61) feet
in residential zones. Staff recommends adoption of a condition of
approval to limit the height of the fences and gate to six (6) feet
in height which would be consistent with code provisions.

PEDESTRIAN PATH

At present, a four (4) foot wide sidewalk provides access from the
units in the south side of Building 1 to the driveway (Exhibit 2).
Applicant is proposing to extend this sidewalk 25' through the
existing 32' wide planter to a point north of the exit gate to
provide pedestrian access from Los Angeles Avenue. This sidewalk
will exit through the proposed key controlled pedestrian gate.
Extension of this sidewalk will result in the loss of approximately
100 sq.ft. of landscaping (grass). Staff recommends adoption of a
condition of approval for the installation of additional plant
materials on site and in the planter on both sides of the driveway
as determined by the Director of Community Development to
substitute for the landscaping which will be removed by the new
sidewalk.
AGENCY REVIEW
This application has been reviewed by the City Engineer, Ventura
County Fire District and the Police Department. The Fire District
and Police Department have requested that the installation of a
'knox box' (secure key box) on the Los Angeles Avenue side of the
gate be included as a condition to insure emergency vehicle access
to Regal Park from Los Angeles Avenue. Additionally, the
Engineering Department has indicated that installation of a right
turn only sign (directing vehicular traffic to the east) where the
existing driveway meets Los Angeles Avenue should be required.
CONCLUSION
Approval of this request is justified based upon the following
conclusions and a draft Resolution with conditions of approval has
been included with this report as Exhibit 1:
1) Construction of the gates and fence will provide increased
security in the Regal Park Condominium complex.
2) Illegal left turns onto the site from westbound traffic on Los
Angeles Avenue will be reduced.
3) A reduction in the amount of non - project traffic through the
Regal Park complex will occur, with a corresponding reduction
in the potential for accidents on site.

4) The design of the gate and fence will match the existing
fences on site.
5) Emergency access will be maintained through placement of a
Knox Box.
6) Adequate access alternatives for residents of Regal Park will
be maintained because of the existing access point on Majestic
Court.
ENVIRONMENTAL DETERMINATION
This project is Categorically Exempt from CEQA requirements as a
Class 3 Exemption, for new construction of small structures
including fences.
RECOMMENDATION
Adopt Resolution No. 99- conditionally approving Minor
Modification No. 1 to Planned Development Permit No. 939 for
installation of wrought iron vehicle exit gate and wrought iron
fencing.

RESOLUTION NO. 99-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, APPROVING MINOR MODIFICATION NO.
1 TO PLANNED DEVELOPMENT PERMIT NO. 939, REQUESTING
THE INSTALLATION OF A WROUGHT IRON EXIT GATE AND TWO
WROUGHT IRON FENCES AT THE LOS ANGELES AVENUE EXIT OF
REGAL PARK CONDOMINIUMS ON THE APPLICATION OF REGAL
PARK HOMEOWNERS ASSOCIATION (APN NO. 506 -0 -130).
WHEREAS, Regal Park Homeowners Association applied for
Minor Modification No. 1 to Planned Development Permit No. 939
for installation of a wrought iron exit gate and two wrought
iron fences; and
WHEREAS, the Director of Community Development referred the
matter to the City Council on September 1, 1999; and
WHEREAS, at its meeting of September 1, 1999, the City
Council after review and consideration of the information
contained in the staff report dated August 27, 1999, reached a
decision on this matter.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. Based upon the information and findings
presented in the staff report and accompanying documents and
public testimony, the City Council finds that:
1. The project is Categorically Exempt from California
Environmental Quality Act requirements as a Class 3
exemption for new construction of small structures
including fences;
2. The Minor Modification is consistent with the intent and
provisions of the City's General Plan and of the City
Zoning Ordinance;
3. The Minor Modification is compatible with the character of
surrounding development;
4. The proposed Minor Modification would not be obnoxious or
harmful, or impair the utility of neighboring property or
uses;

5. The Permit would not be detrimental to the public interest,
health, safety, convenience, or welfare;
6. The conditionally permitted use is compatible with existing
and planned land uses in the general area where the
development is to be located; and
7. The proposed project would not have a substantial adverse
impact on surrounding properties.
SECTION 2. The City Council conditionally approves Minor
Modification No. 1 to Planned Development Permit No. 939 for
installation of a wrought iron exit gate and two wrought iron
fences at the Los Angeles Avenue exit from Regal Park
Condominiums.
SECTION 3. Approval of Minor Modification No. 1 to Planned
Development Permit No. 939 subject to the following conditions:
1. Approval of a Zoning Clearance from the Community
Development Department and required permits from the
Building Department are required prior to the construction
improvements permitted by this Resolution.
2. The location and design of improvements shall be as shown
on the approved plans except as modified by the following
conditions of Section 3 of this Resolution.
3. All conditions of approval of Planned Development No. 939
shall apply unless otherwise modified by this permit.
3. The approved plans for the existing buildings and related
improvements and for construction of the gate and fence in
this application shall not be revised to reflect any
additional modifications, unless an appropriate permit is
approved by the City.
4. Maximum height of the gate and wrought iron fence shall be
six (6) feet.
5. Key cards for the exit gate and keys for the pedestrian
gate shall be supplied to all public safety agencies prior
to completion of the improvements. Agencies receiving key
cards shall include, but are not limited to, Moorpark

Police, Ventura County Fire, City ambulance service and the
City approved refuse hauler. The number of key cards
received by each agency shall be determined by that agency.
Additional key cards and gate keys shall be provided to
each public agency upon request.
6. Should the key card and /or pedestrian gate key be changed,
new cards and keys shall be issued to each public safety
agency as required in Condition No. 5.
7. Applicant shall install a 'Knox Box' on the Los Angeles
Avenue side of the exit gate for use solely by public
safety agencies who have been provided keys.
8. A 'right turn only' sign shall be placed at the driveway
exit, adjacent to Los Angles Avenue. The design and
placement of the sign shall be approved by the Director of
Community Development.
9. An 'exit only, no entrance' sign shall be placed at the
former entrance to the site on Los Angeles Avenue. The
design and placement of the sign shall be approved by the
Director of Community Development.
10. Prior to the issuance of a Zoning Clearance, a complete
landscaping plan together with specifications to include
additional trees and plant materials shall be submitted to
the City and approved by the Director of Community
Development. Landscaping shall be installed prior to the
operation of the gate.
11. The continued maintenance of the gate, fence, landscaping,
permit area, and facilities shall be subject to periodic
inspection by the City. The permittee shall be required to
remedy any defects in ground maintenance, as indicated by
the Code Enforcement Officer within thirty (30) days after
notification.
12. The applicant and successors, heirs, and assigns shall
remove any graffiti within five (5) days from written
notification by the City of Moorpark. All such graffiti
removal shall be accomplished to the satisfaction of the
Director of Community Development.

13. Prior to issuance of a Zoning Clearance for construction of
improvements, the applicant shall pay all applicable fees
and all outstanding case processing costs.
14. Failure to inaugurate this Minor Modification within
one (1) year from the date of approval will render this
Minor Modification null and void. A one (1) year extension
to this Minor Modification Permit may be granted by the
Director of Community Development upon the written request
and payment of the appropriate filing fee.
SECTION 4. The City Clerk shall certify to the adoption of
this Resolution and shall cause a certified Resolution to be
filed in the book of original Resolutions.
