Lindley, Director of Community Servicess')C` September 3, 1999 (CC Meeting of September 8, 1999) CONSIDER REQUEST BY PACKER FOOTBALL TO INSTALL AND USE LIGHTS AT ARROYO VISTA COMMUNITY PARK At its August 18, 1999, meeting the City Council indicated its intent to approve Packer Football's request to install and use lights at the practice field at Arroyo Vista Community Park, pending a scheduled demonstration of the proposed lights. At that time, the Council expressed a desire to see a light in operation to ensure that the light did not unfairly impact residents located to the south of the football field. A Special Meeting was held at AVCP on September 2 at 8:00 p.m. A light was mounted to an existing wooden pole located by the well pump- house, at a distance of approximately 25 feet. At the conclusion, the three Councilmembers present expressed an interest in allowing Packer Football to proceed with the installation and use of the lights for the 1999 season. The proposed installation includes six wooden poles with four lights on each pole. The poles are approximately 25 feet in above- ground height. The poles will be placed along the north and south side of the field, three on each side. A transformer and pad will be installed near the location of the well pump- house, east of the football field. The wire cable connecting the transformer to the first light pole will be placed underground, and the wire cable between the light poles will be overhead. The lights facing south may not exceed a ninety degree angle. The lights may be used Monday through Friday and they must be turned off no later than 8:00 p.m. The Council will evaluate the 0000 o Packer Football Light Request Page 2 continued use of the lights and any adjustments it deems necessary; e.g., undergrounding the wire between light poles, following the conclusion of the 1999 football season. The recommendation before Council is to formalize approval of Packer's request as stated, and approve an Amendment to the Use Agreement (Attachment A) incorporating the condition under which the installation and use of lights may take place. STAFF RECOMMENDATION Staff recommends that the City Council: 1. Approve the installation and use of lights, as specified in the Agenda Report, by Packer Football at the Arroyo Vista Community Park football practice field for the 1999 season; 2. Indicate its intent to evaluate the continued use of the lights at the conclusion of Packer's 1999 season; 3. Approve the proposed Amendment to the Joint Use Agreement with the Moorpark Boys and Girls Club (Moorpark Packer Football) incorporating the Council's direction regarding installation and use of lights for the 1999 season, and the Council's consideration of continued use upon the completion of this year's season; and 4. Authorize the City Manager to sign the Amendment on behalf of the City, pending final language changes by the City Manager and City Attorney. A:lpacker lights agd.doc 0000'1 3 DRAFT AMENDMENT NO. 1 AGREEMENT BETWEEN THE CITY OF MOORPARK AND THE BOYS AND GIRLS CLUB OF MOORPARK THIS AMENDMENT TO AGREEMENT, made and entered into this _ day of , 1999, by and between the City of Moorpark, a municipal corporation located in the County of Ventura, State of California (hereinafter "City" ) and Boys and Girls Club of Moorpark, a nonprofit Boys and Girls Club serving the City of Moorpark, California (hereinafter "Boys and Girls Club "). WITNESSETH Whereas, on August 5h, 1998, City and Boys and Girls Club entered into an agreement pertaining to the use and maintenance of certain park facilities at Arroyo Vista Park for Moorpark Packer Football; and Whereas, said Agreement states that the contact party regarding the operation its provisions shall be Moorpark Packer Football officials; and Whereas, on August 8h, 1999, the City Council approved a request from Packer Football to install semi permanent lights; and Whereas, City and Moorpark Packer Football have discussed and agreed to provisions governing the installation and use of certain lights at Arroyo Vista Community Park, as described herein, and now wish to document said agreement by jointly approving this Amendment No. 1 to the August 5, 1998 Agreement. NOW, THEREFORE, in consideration of the mutual convents, benefits, and Premises herein stated, the parties hereto agree and amend the aforesaid Agreement as follows: Section 1. Use of Lights Section 5, Use, paragraph E, concerning use of portable lights, of Agreement is hereby amended in its entirety as follows: City authorizes the Boys and Girls Club to install and use lights on the football practice field, located north of the football field and further identified on Exhibit A of this Amendment, for the fall 1999 season. The lights may be used for Moorpark Packer Football practice purposes, Monday through Friday and must be turned off no later than 8 p.m. The Boys and Girls Club agrees to install a separate electrical meter and to secure electrical services in its name and pay all electrical utility costs. The City reserves the right to evaluate the continued use of said lights by the Boys and Girls Club upon completion of the fall 1999 Packer Football season. The City shall have sole discretion regarding continued use of the lights and or modifications to the conditions set forth for use by the Agreement. The Boys and Girls Club shall be responsible for installation and maintenance of the lights at its own cost and pursuant to Section 10. Improvements, of amended Agreement. Section 2. Installation of Lights Section 10, Improvements, of Agreement is hereby amended by adding the following paragraph: City authorizes Boys and Girls Club to install semi permanent lights at the football practice field located on Premise. All costs associated with the installation work shall be at Boys and Girls Club's sole expense. Boys and Girls Club agrees to repair any and all 11M0R PRI_SERVU come_ foldersVALindley lADMIN\Packeramd.doc 000012 damaged caused to Premise, to the City's satisfaction, resulting from the installation work, including, but not limited to trenching, irrigation, and landscaping. The method approved for installation of the lights is as follows: 1. Obtain penuit for electrical transformer. 2. Install a concrete pad, approximately 4 ft. square, for the electrical transformer, in an area to be approved by City near the well pump- house. 3. Install an electrical meter and secure service in the name of the Boys and Girls Club or Moorpark Packer Football. 4. Install six wooden poles with an above - ground height of no more than 25 feet. The location of the poles shall be along the north and south sides of the practice field, three poles to a side. The exact location shall be approved by the City prior to installation. 5. Each of the six wooden light poles may contain no more that four light fixtures. Specify the fixture. The light fixtures facing south shall not exceed a ninety (90) degree angle from the ground. 6. Install electrical cable connecting the transformer to the light poles at the practices field underground and in accordance with building and electrical codes, in a line along the wooden pole fences on the east side of the football field. Re- compact the soil and reseed turf areas if necessary. 7. The electrical cable between the six light poles may be hung overhead during the fall 1999 season. Boys and Girls Club agrees that all material used shall meet with the approval of the Division of Industrial Safety and all governing bodies having jurisdiction. Material shall be manufactured in accordance with applicable standards established by A.N.S.1, U. L., N.E.M.A, and N.B.F.U. All installation shall be per manufactures recommendations. All equipment shall be weatherproof. All work performed by and for Boys and Girls Club shall be in accordance with all applicable City and state building codes, O.S.H.A., and the presently adopted California Electrical Codes (C.E.C.) The City shall have the right to inspect all work and to require any corrections and modifications it deems necessary. The Boys and Girls Club shall not use the lights until authorized in writing by the City, upon a final inspection. During the 1999 season, Boys and Girls. Club agrees to make any and all adjustments to die, lights and electrical system as deemed necessary by the City. Upon the completion of Moorpark Packer Football's fall 1999 season, the City Council, at its sole discretion, may require the Boys and Girls Club to make modifications to the installation of the lights and the light system, such as, but not limited to, undergrounding the electrical cable between light poles, or complete removal of the lights. Such work shall be performed by the Boys and Girls Club at its sole expense. Section 3 Maintenance Section 15 of Agreement is hereby amended to include the following maintenance activities: Maintain all components installed to operate the lights on the practice field, including, but not limited to, the transformer and transformer pad, electrical meter, underground and overhead electrical cabling, wooden light poles, and light fixtures. Boys and Girls Club agrees to respond to City's request for repair and maintenance to the lights and light system within 48 hours of receipt of said request. \\ N40R_ PRI_ SERWionne _folders\MLindley \ADMIN\Packer amd.doc 000013 Section 4 Remaining Provisions All other provisions of the aforesaid Agreement (Exhibit C) shall remain in full force and effect.
