BACKGROUND
On August 18, 1999, the City Council considered the subject item.
Certain questions were raised (see below for summary) and the
matter was continued to September 15, 1999, to allow the Traffic
Engineer and /or the Consultant who prepared to Speed Survey an
opportunity to respond.

A copy of the August 15 staff report is attached for your
reference. In addition, a second copy of the Speed Survey has been
distributed to the City Council under separate cover.
RECOMMENDATIONS
There is no change to the recommendation provided in the August 15
staff report. Please refer to that report for a copy of the draft
resolution.
Staff recommends that the City Council take the following actions:
1. Approve the Traffic Speed Zone Survey and Engineering Study
dated July 1999;
2. Adopt Resolution No. 99- Rescinding Resolution No. 97-
1287 and Approving Prima Facie Speed Limits for certain street
Segments and approving the Posting of Speed Limit Signs on
Said Streets.

The City recently retained a Traffic Engineer to prepare a new
Traffic Speed Zone Survey and Engineering Study. A copy of that
Study has been distributed to the City Council under separate
cover. This report presents a Resolution re- affirming and /or
revising the Speed Limits on all of the local streets within the
City, based on the findings, conclusions and recommendations set
forth in that study.
BACKGROUND
Section 40802 of the California Vehicle Code (CVC) requires, as a
prerequisite to the enforcement of any speed law with radar, the
preparation and adoption of a Traffic Speed Survey and Engineering
Study within the past seven years. In some cases the effectiveness
of the Speed Survey can be extended to ten years when certain
findings are made.
Although the majority of the street segments in the City were last
surveyed in June of 1994, changed conditions on a number of those
streets rendered the Speed Surveys for those streets obsolete. It
was determined, therefore, that a new Speed Survey was required for
all of the street segments within the City which are not designated
State Highways.

DISCUSSION
A. Speed Survey
A stated above, a copy of the Speed Survey recently completed
by a consultant retained by the City, was distributed to the
City Council under separate cover. It is recommended below that
that Survey be approved.
B. Scope of Work
As stated above, all of the street segments not designated a
State Highway were surveyed. Attached as Exhibit 1 is a map
identifying all forty segments.
C. General Criteria
As stated in the Speed Survey, in order to employ radar
enforcement, the posted speed limit for any street must be no
more than five miles per hour (5 MPH) less than the 85th
percentile speed (the speed at which eighty -five percent [85 %]
of the vehicles surveyed travel). Except as noted in Section D
below, the speed limits recommended in the Speed Survey conform
to this requirement.
D. Conditions Not Readily Apparent to the Driver
The findings and conclusions set forth in the Speed Survey list
a number of street segments where there are conditions which
are not readily apparent to the driver. These conditions
include such matters as traffic accident history or other
unique characteristics not discernable to the driver. For a
description of the specific conditions not readily apparent to
the driver on any given street segment, please refer to the
survey page for that street segment.

A discussion of the reasons set forth in the Speed Survey, for
the above recommend increased speed limits, is as follows:
Princeton Avenue: The survey found that the 85th percentile
speed for this street segment was 41 MPH. In that no unusual
conditions not readily apparent to the driver could be
identified, the posted speed limit must be 40 MPH if radar
enforcement is to be utilized.
Science Drive (north of Peach Hill Road): The 35 MPH signs on
Science Drive were installed by the developer of the Carlsberg
Specific Plan without the benefit of a Speed Survey. The survey
found that the 85th percentile speed for this street segment was
45 MPH. In that no unusual conditions not readily apparent to
the driver could be identified, the posted speed limit must be
40 MPH if radar enforcement is to be utilized.
Science Drive (south of Peach Hill Road): The 35 MPH signs on
Science Drive were installed by the developer of the Carlsberg

As an interim measure, the 1994 Speed Survey for these two
street segments has been included in the Speed Survey
distributed to the City Council. When the new speed survey for
these two streets is completed, an amendment to the Speed
Survey and the Speed Limit Resolution will be presented to the
City Council for approval. There will be no additional
consultant cost for this work.
RECOMMENDATIONS
Staff recommends that the City Council take the following actions:

RESOLUTION NO. 99 -
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, RESCINDING RESOLUTION NO.
97 -1287 AND APPROVING PRIMA FACIE SPEED LIMITS FOR
CERTAIN STREET SEGMENTS AND APPROVING THE POSTING
OF SPEED LIMIT SIGNS ON SAID STREETS
WHEREAS, a Traffic Speed Zone Survey and Engineering Study has
been performed on certain of the local streets within the City of
Moorpark; and
WHEREAS, the findings in said study support certain changes to
the prima facie speed limits and the posted speed limit for certain
of those street segments; and
WHEREAS, Resolution No. 97 -1287 setting the current speed limit
for all of the local streets within the City is, at least in part,
in conflict with the speed limits recommended by the aforesaid study.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That Resolution No. 97 -1287, pertaining to the
establishment of speed limits, is hereby rescinded.
SECTION 2. That the speed limit for each of the street segments
listed on Exhibit 'A', shall be the Adopted Speed Limit cited on said
Exhibit "A ".
SECTION 3. The City Manager is hereby directed to replace and /or
post new speed limit signs to reflect the Adopted Speed Limits set
forth in Exhibit "A ".
SECTION 4: The City Clerk shall certify to the adoption of
this resolution and shall cause a certified resolution to be filed
in the book of original resolutions.
