SUBJECT: CONSIDER AUTHORIZING RECORDATION OF THE NOTICE OF
COMPLETION FOR THE CONSTRUCTION TENNIS COURTS AT ARROYO
VISTA COMMUNITY PARK
BACKGROUND
The total project budget for the design and construction of the
eight lighted tennis courts at AVCP is $662,000 and is being funded
in equal parts by the City and the Moorpark Unified School
District. In included in the total budget was funds to perform the
construction work. On February 3, 1999, the City awarded the
construction contract to Malibu Pacific Tennis Courts.
Construction of the courts has been completed pursuant to the
approved plans and specifications, less "minor punch" list items.
There were five approved Change Orders, summarized as follows:
Change Order #1 (Cost - Deduct $66,105): Changed the light
fixtures and light poles from the specified Spaulding lights
to Beiber lights.
Change Order #2 (Cost - Add $66,105): Added Alternate #1 to
project Scope of Work including installation of drainage,
drinking fountains, irrigation sleeving, concrete paving, and
seat walls.
Change Order #3 (Cost - Add $1,070): Install time clock to
override coin operated lights.
Change Order 44 Cost - Add $800): Install two quick couplers
and 466 linear feet of expansion joint.

Change Order #5 (Cost - Add $250): Lower the irrigation line
at south east corner to facilitate fine grading.
Total Change Orders: $2,120 ($68,225 in additions less $66,105
in deductions = $2,120)
At the conclusion of the construction work, the total cost of the
construction contract awarded to Malibu Pacific Tennis Courts,
including the aforementioned Change Orders is $571,120. With the
Council's authorization to record the Notice of Completion, the
contractor will received the balance of payment due 35 days after
the recordation and fulfillment of all contractual obligations as
determined by the City.
In addition to construction, the tennis court project entailed
design and construction plans, plan check and building inspection,
topographic surveys, soils tests, project management, landscaping,
and site furniture. The total estimated final project cost,
including construction and the previously identified Change Orders,
continues to be $622,000. The Council will be provided with a
final cost report when all outstanding work has been completed.
STAFF RECOMMENDATION
Staff recommends that the City Council:
1. Accept the work as complete;
2. Authorize the City Clerk to file the Notice of Completion
for the project; and
3. Authorize the release of the balance of payment due upon
satisfactory clearance of the thirty -five (35) days after
Notice of Completion records and completion of close out
contractual obligations of contractor.
