BACKGROUND: During discussion of potential zoning code amendments at the September 1, 1999, meeting, City Council directed staff to prepare appropriate recommended amendments to development processing fees for projects within the Downtown Specific Plan as an incentive to implement the plan. The attached resolution contains the appropriate modifications to the adopted fee schedule to achieve Council's direction. DISCUSSION• California Government Code Section 66014 permits cities to establish fees for development project applications or service charges, subsequent to discussion at a public meeting, with interested parties who are provided an opportunity to comment. After completion of a public meeting, the legislative body may adopt new or amended fees by ordinance or resolution. State law limits the effective date of any new or changed fees for the processing of development projects or issuance of permits or entitlements to no sooner than 60 days following final action on the adoption of the new fee or amendment of existing fees. The resolution attached would establish new fees for development project reviews only within the Downtown Specific Plan area. The revised fees were considered as part of the discussion City Council has had in determining options for providing incentives for encouraging development within the Downtown Specific Plan. The fee structure for processing use conversions in the Downtown M:\ JLibiez\ M \DWNTWNSP \DWNTWNSPfees10699.doc 00031101 City Council Agenda Report Fee Schedule Amendment October 6, 1999 Page 2 Specific Plan area was directed by City Council to be limited to 500 of the currently established fee for commercial planned developments ($4,200.00 X .50 = $2,100.00) or the actual cost of processing, whichever is less. Additionally, Council indicated that the fee for an appeal to a decision concerning a project within the Downtown Specific Plan area should be structured at the 50% ratio. The attached resolution includes language reflecting Council's direction and the Fee Schedule attached to the resolution has also been amended. No changes in language are required for the appeal fee, since it is tied to the original processing fee (at 25% of the original fee) for a project and would automatically reduce with the reduction of the processing fee of the original project application. A separate agenda item will be considered by the Moorpark Redevelopment Agency to determine if the Agency should reimburse the City's Community Development Fund for actual costs above the reduced fee amendment. STAFF RECOMMENDATION: Adopt Resolution No. 99- adopting revisions to the schedule of land use development preliminary processing fee deposits. Attachment: A. Resolution No. 99- 0003-1 ., RESOLUTION No. 99- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, STATE OF CALIFORNIA, ESTABLISHING A SCHEDULE OF LAND USE DEVELOPMENT PRELIMINARY PROCESSING FEE DEPOSITS AND RESCINDING RESOLUTION NO. 98- 1551. WHEREAS, the City of Moorpark provides land use development planning services; and WHEREAS, the City Council has determined that the cost of these services shall be offset by fees which accompany land use entitlement requests; and WHEREAS, the Community Development Department staff costs are charges against fees, based upon real time cost accounting; and WHEREAS, the City Council did consider and adopt Resolution 98 -1551 which established a schedule of land use development processing fees on December 2,1998; and WHEREAS, the City Council did consider and adopt under Ordinance No. revised procedures for the processing of development applications within the Downtown Specific Plan area, not previously a portion of the City's entitlement procedures; and WHEREAS, a fee for such revised entitlements is necessary; and WHEREAS, it is necessary to differentiate within certain fee categories, fees consistent with the demands for staff time for specific forms of applications. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, DOES RESOLVE AS FOLLOWS: SECTION 1. That the Community Development Department staff shall bill actual time spent on land use applications at a real time cost accounting rate of $88.00 per hour. SECTION 2. SECTION 3. Enforcement applications a real time That the Community Development Code staff shall bill actual time spent on land use and other items eligible for cost recovery at cost accounting rate of $82.00 per hour. SECTION 4. That the Administrative Services staff shall bill actual time spent on land use applications and other items eligible for cost recovery at a real time cost recovery rate of $90.00 per hour. SECTION 5. That the Director of Community Development has the authority to reduce certain deposit amounts up to fifty percent (50 %), where the project involves multiple applications of the same type of project on the same property, to be processed concurrently. SECTION 6. That there is a need to provide incentive to the economic development of the Downtown Specific Plan area through the reduction of development processing and review fees established in "Exhibit A" such that projects within the boundaries of the adopted Downtown Specific Plan shall be required to pay a fee equal to the lesser of the following (1) A fee not more than fifty percent (50 %) of the established deposit /review fee as shown upon the fee schedule in "Exhibit A ", or (2) a fee equal to the actual cost to process and review such applications when such costs may be less than the fee in (1) above. SECTION 7. Preliminary as those Resolution. That the schedule of Land Development Processing Fee Deposits shall be as identified revised fees shown in "Exhibit A" to this SECTION 8. That this Resolution shall become effective sixty days (60) following the public meeting held on October 6, 1999 (December 4, 1999), pursuant to Government Code Section 66016, implementing those changes to the fees described herein immediately upon the effective date set forth herein. 0003713 Moorpark City Council Resolution No. 99- Downtown Specific Plan Fees Page 3 SECTION 9. That Resolution No. 98 -1551 adopted December 2, 1998, is hereby repealed upon the effective date of this Resolution. SECTION 10. That the City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original Resolutions.
