HomeMy WebLinkAboutAGENDA REPORT 1999 1006 CC REG ITEM 11HCITY OF MOORPARK AGENDA REPORT To: The Honorable City Council From: Dirk Lovett, Assistant City Engineer Prepared by John Whitman I IN `'I0 ITEM Ci TV -W -,,f)MZPNT?K, C AI,1F0RN, IA AC T IV ' BY:- Date: September 23, 1999 (CC Meeting of October 6, 1999) Subject: Consider Request to Export 13,000 cubic yards of soil from Tentative Tract 4977 and Import and Stockpile to Tentative Tract 4976, in conjunction with early grading for model homes ( Lennar Homes) BACKGROUND Export /Import and Stockpile: On September 3, 1999 the City received a request from the developer to export approximately 13,000 cubic yards of earth from Tract 4977 and to import and stockpile that earth in Tract 4976 within the Carlsberg development (see attached letter) . Tract 4977 is situated between Peach Hill Road on the north, Tierra Rejada Road to the south, Science Drive on the east and Spring Road on the west. Tract 4976 is situated just east of Tract 4977 between Science Drive to the west, SR 23 to the east with a portion of the tract north of Peach Hill Road and a portion of the Tract south of Peach Hill Road (See Exhibit 1). The majority of grading has been completed on Tract 4977. Shrinkage of soils during the spreading operation of Tract 4977 was less than anticipated resulting in excess material. Part of the excess soils have been used to make minor grade adjustments on Tract 4977 and some of the excess was previously used in Tract 4980. There is still 13,000 cubic yards of soil to be disposed. Tract 4976 has not received a grading permit and no work is currently occurring in the tract. A portion of the tract was graded during construction of Science Drive. As such, the soils conditions are well known and the developer's engineer states that there will be a need to import soil. The imported soil is proposed to be placed on ground that has already been cleared and grubbed. Tract 4976 Model Homes Grading: Simultaneously with the request for this stockpile, Lennar Homes 0006 -L0 City Council Agenda Report Tract 4976 Import /Stockpile October 6, 1999 Page 2 is requesting approval to proceed with grading for a model home complex on Tract 4976 immediately, prior to the recordation of the final map. An interim model -only grading plan has been submitted to City Engineering for first plan check. These plans are on file in the office of the City Clerk. Tract 4976 has been previously approved by the City Council and the model -only grading plans are in compliance with the approved grading. The applicant requests the model -only grading permit so they may proceed with the model homes while environmental issues are resolved on the remainder of the tract. The developer anticipates that they will have environmental permits to grade the remainder of the tract within a couple months. DISCUSSION It is the City's policy that soil export or import in excess of 10 truck loads, along with haul routes, be approved by the City Council. In addition, it is also the City's policy to enter into an early grading agreement, guaranteeing certain improvements and sureties, should the developer choose to proceed with construction prior to the recordation of a final map and subdivision improvement agreement. Lennar Homes has indicated that it is their plan to go forward with developing Tract 4976 as a single family residential project. The starting construction date is uncertain because of ongoing environmental permit application process but the developer has indicated that they may be ready within 6 weeks. Due to the immediate need to export the soil from Tract 4977 and the planned grading of the model home site, it is the applicant's desire to incorporate the 13,000 cubic yards of imported soil into the grading for Tract 4976. The soil would be initially stockpiled in a location just to the southeast of the intersection of Peach Hill Road and Science Drive (See Exhibit 1). The stockpile would be up to five feet high. The proposed haul route is to proceed easterly out of Tract 4977 along the alignment of the most northerly entry street to Science Drive. The trucks would make a left turn onto Science Drive and proceed north to Peach Hill Road where they would turn right on Peach Hill Road. The soil would be dumped within 100 yards of the point where the trucks turned onto Peach Hill. The total average haul distance would be approximately 2200 feet with approximately 550 feet of the haul on Science Drive(the only paved portion of roadway). 0006 City Council Agenda Report Tract 4976 Import /Stockpile October 6, 1999 Page 3 Following City approval of the model -only grading plans, a portion of the imported soil would be used immediately to build up the model home pads, per the approve tentative map elevations. The remainder would be spread along the slopes immediately to the north and east of the model pads. Those slopes are not visible from Science Drive or points off the Carlsberg development. A surety, based on cost, will be required for both the stockpile and the grading for the model homes. This is necessary should the City have to remove the soil or finish the grading if the developer is unable. It is staff's opinion that the imported material, as proposed, will not create a noticeably abrupt or unstable feature. It is unlikely that the City would have to export the material even if the current owner is not capable of completing the construction after the soil is imported. The surety would provide resources for the City to spread and compact the soil if deemed necessary for any reason. If the City Council approves the requested export /import, stockpile and model complex early grading, staff recommends requiring the following conditions: Conditions: • Prior to the commencement of export operations the applicant shall obtain a zone clearance, grading and encroachment permits and shall pay all standard planning, plan check, and inspection fees for the zone clearance, plan review and permit issuance. • A revised grading plan for the model complex shall be resubmitted by which the final contours of the grading are acceptable to the City Engineer and Director of Community Development. • The model complex area of Tract 4976 shall have an erosion control plan for erosion and dust control which is to be reviewed and approved by the City Engineer and Director of Community Development prior to issuance of a grading or encroachment permit. • All hauling operations shall be limited to the hours of 9:00 a.m. - 3:00 p.m. on school days, with no haul occurring on Saturdays, Sundays or Holidays. • Flagman shall be available, as determined by the City Engineer, at the access points with Science Drive. • All streets shall be cleaned daily or as requested by the City Engineer. • Both the borrow and stockpile sites shall be watered regularly to eliminate dust. 0006 r.y City Council Agenda Report Tract 4976 Import /Stockpile October 6, 1999 Page 4 • Trucks shall be watered or covered to eliminate dust. • Modifications to the import plan, route or conditions may be required by the City and shall be complied with by the applicant at any time during the hauling and stockpiling process, as deemed necessary. If City Council approves the model complex grading, zone and environmental clearances along with standard early grading and hold harmless agreements will be required. SUMMARY Due to the immediate availability of soil from Tract 4977 and the need for soil on Tract 4976, the applicant is requesting that they be allowed to transport 13,000 yards of soil from Tract 4977 to Tract 4976. Some of this soil is proposed to be used immediately for constructing the model home complex by the applicant after a grading plan is approved and a grading permit is issued. Early grading and hold harmless agreements, encroachment permit fees, grading plan check fees, inspection deposits and sureties will be required for the import and model home site. STAFF RECOMMENDATION 1. Approve the transportation of 13,000 yards of soil from Tract 4977 to Tract 4976 as shown in the model home complex plan and the export /import plan, subject to and as revised pursuant to the conditions contained herein; and 2. Approve an early grading agreement for the model home complex in Tract 4976. Attachments: 1. Letter from applicant 2. In tract 4977 there was no dirt shrinkage as originally estimated and there was also some bulking experienced, causing a considerable excess of dirt in the tract. We raised the elevation of lots 53 thru 73 and lots 8Z thru 93 two feet and lots 5Z, 73, 81 and 94 one foot to accommodate placement of part of the excess dirt, we were also permitted to use part of the excess in tract 4980, however, there remains an excess of approximately 10,000 to.13,000 yards of dirt. The remaining excess will be used in tract 4976 where more flexibility exists and there is a need for the dirt. Tract 4976 was previously partially graded and the soils conditions are a more known factor than in the tracts that had no previous work. The possibility to use the remaining dirt within tract 4977 was evaluated and due to the finished state of the lots it was determined that the most reasonable, efficient and effective way to handle the situation was to haul the dirt to tract 4976 where it will be stock piled until tract 4976 is graded. The Section Seven Environmental Permit has been received and we anticipate having the other necessary permits within the next 6 weeks, we will then start the full grading of tract 4976. The haul route, as shown on the attached map, provides the shortest most efficient route. There will be traffic control as indicated to facilitate a smooth flow of traffic. The controllers will have radio communications to assure efficient safe traffic flow is maintained. 00061"1, The time required to move the dirt using 3 trucks will be approximately 14 days with a 6 hour work schedule to avoid conflict with the school and other peak traffic . We will coordinate all haul times with the Moorpark Unified School District so there is no conflict with the school traffic at the Mesa Uerde School during the morning and afternoon peak use periods. We respectfully request immediate approval of our plan to relocate the excess dirt from tract 4977 to 4976 so the least disruption will be experienced with the traffic flow, construction and the school schedule.
