Location Attached as Exhibit 1 is a map showing the location of the subject intersection. B. Requests for Traffic Controls The City is in receipt of a request from a local resident in the affected neighborhood that the City consider the installation of a STOP sign at the "T" intersection of Flowercreek Drive and Laurelview Drive, requiring westbound traffic entering this neighborhood to stop before turning right or left on to Laurelview. C. Traffic Engineer's Recommendation It is the recommendation of the City Traffic Engineer that STOP signs only be installed when Stop Sign Warrants are met. City staff and the City Traffic Engineer agree that the intersection would not meet warrants for the installation of the requested STOP sign. For this reason the City Traffic Engineer does not recommend that the requested STOP sign be installed. stopflower 0V06-L`' STOP Sign: Flowercreek Drive September 22, 1999 Page 2 D. Director of Public Works' Recommendation E. The placement of a STOP entry to a residential control device throughout as follows: • Rolling Knoll Road at • Pheasant Run Street at sign at "T" intersections at the neighborhood, is common traffic the City. Some examples are listed Laurelhurst Road Westport Street • Courtney Lane at Talmadge Road; and • Woodhill Drive at Broadview Drive. Based on this common traffic control design, the Director of Public Works recommends that the subject STOP sign be installed. Design Immunity For the reasons stated below, it will be necessary for the City Council to make certain findings as a part of the approval of the subject STOP sign. 1. Design Immunity: Cities rely on those provisions of the law pertaining to design immunity when faced with litigation involving the proper use and installation of traffic control devices. In order to be protected by design immunity the traffic controls in question must have been approved by the legislative body prior to installation, and the approval by the legislative body must have been based upon substantial reasonable evidence in support of said installation. 2. Warrants: In most cases, cities use as the evidence in support of the installation of STOP signs, the existence of one or more STOP sign warrants. As stated above, a STOP Sign Warrant Study was not performed for the subject intersection; and it is the view of staff that, if such a study were to be performed, none of the Stop Sign Warrants would be met. 3. Findings: It is the view of staff that there are certain factors and conditions which justify the installation of a STOP sign for westbound traffic at the subject intersection. Those factors and conditions are listed as follows: a. The placement of a STOP sign at the non - through leg of "T" intersection which is the entrance to a residential neighborhood, is a common method of traffic control throughout the City; stopflower 000613 STOP Sign: Flowercreek Drive September 22, 1999 Page 3 b. The installation of a STOP sign at the westbound leg of the intersection of Flowercreek Drive and Laurelview Drive would be consistent with that design standard and would, therefore, be consistent with the expectation of drivers regarding traffic controls at such intersection; and, C. Traffic safety at the subject intersection would be improved if questions regarding "right -of -way" were clarified by requiring westbound traffic to stop prior to entering the intersection. N* O O RESOLUTION NO. 99 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, DESIGNATING LAURELVIEW DRIVE TO BE A THROUGH STREET IN THE VICINITY OF FLOWERCREEK DRIVE, AND DIRECTING THE PLACEMENT OF A STOP SIGN AT THE FLOWERCREEK ENTRANCE THERETO WHEREAS, Section 21354 of the California Vehicle Code (CVC) authorizes the City to designate any City street to be a through street, thereby allowing the placement of STOP signs at the entrances to said street; and, WHEREAS, the City Council has determined that, in order to better provide for the safe movement of vehicular traffic at a certain "tee" intersection, that is necessary and appropriate to designate the "through" leg of that intersection as a through street and to direct the placement of a STOP sign at the non - through leg of said intersection. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE, FIND, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. There are certain factors and conditions pertaining to traffic controls at certain types of "tee" intersections which are relevant to the proper control of traffic at the intersection of Flowercreek Drive and Laurelview Drive, said factors being summarized as follows: a. The placement of a STOP sign at the non - through leg of "T" intersection which is the entrance to a residential neighborhood, is a common method of traffic control throughout the City; b. The installation of a STOP sign at the westbound leg of the intersection of Flowercreek Drive and Laurelview Drive would be consistent with that design standard and such a STOP sign would, therefore, be consistent with the expectation of drivers regarding traffic controls at such intersections; and, C. Traffic safety at the subject intersection would be improved if questions regarding "right -of -way" were clarified by requiring westbound traffic to stop prior to entering the intersection. SECTION 2. The above stated factors and conditions justify the placement of a STOP sign for westbound traffic entering the intersection of Flowercreek Drive and Laurelview Drive. 00060'O'la.
