TO: Honorable City Council %%����%%jj FROM: Mike Mathews, Senior Management Analyst 04fe 04 DATE: December 9, 1999 (CC Meeting of 01/05/2000) SUBJECT: CONSIDER RESOLUTION NO. 2000- TO ENABLE THE ENFORCEMENT OF THE CALIFORNIA VEHICLE CODE IN THE PRIVATELY OWNED PARKING FACILITIES AT THREE D ENTERPRISES/ PINECREST SCHOOLS LOCATED AT 14100 PEACH HILL ROAD (TRACT 4974 LOT 4, CPD 98 -1) EXECUTIVE SUMMARY This presents for consideration at a public hearing, a resolution making the privately owned parking facilities at 14100 Peach Hill Road subject to certain provision of the California Vehicle Code (CVC). DISCUSSION A. Authority The City enforces Section 21107.8 (Private Parking Facilities) of the CVC in a number of privately owned parking areas within commercial/ industrial property and multi- family residential developments. Enforcement of the CVC on private property requires the adoption of a resolution by the local agency at the request of the property owner. B. Request The City is in receipt of a letter (Exhibit B) from Three D Enterprises /Pinecrest Schools requesting that the California Vehicle Code be enforced in their parking facilities. 00000 Honorable City Council December 9, 1999 Page 2 C. Notice A notice of this Public Hearing (Exhibit C) was sent to the property owner, as required by CVC section 21107.8 (c) . D. Effective Date The effective date of the Resolution is the date of the first occupancy permit. STAFF RECOMMENDATION Staff recommends that the City Council adopt the attached Resolution No. 2000- (Exhibit D) declaring the privately owned parking facilities at 14100 Peach Hill Road to be subject to certain provisions of the California Vehicle Code. THIS IS TO NOTIFY YOU THAT, pursuant to Section 2110'7.8 (c) of the California Vehicle Code (CVC), a public hearing on this matter will be held on Wednesday, January 5, 2000, at 6:30 p.m. in the City Council Chambers located at 799 Moorpark Avenue, Moorpark California. You are invited to attend and be heard at the meeting. It is not required that you attend. WOZNIAK Mayor Mayor Pro Tern Councilmember Councilmember Councilmember RESOLUTION NO. 2000- A RESOLUTION OF THE CITY MOORPARK, CALIFORNIA, CERTAIN PRIVATE PARKING SCHOOL (14100 PEACH HILL CPD 98 -1) SUBJECT TO CALIFORNIA VEHICLE CODE COUNCIL OF THE CITY OF FINDING AND DECLARING FACILITIES AT PINECREST ROAD, TRACT 4974 LOT 4, THE PROVISIONS OF THE WHEREAS, Section 21107.8 (Private Parking Facilities) of the California Vehicle Code (CVC) provides for the enforcement of said code in privately owned and maintained parking facilities held open for public use, upon receipt of a request for such enforcement from the property owner; and WHEREAS, the owner of certain property has provided the City with a written request for such enforcement; and WHEREAS, the property to be subject to such regulation is located at 14100 Peach Hill Road, (Lot 4 of Tract 4974, CPD 98 -1) and shown on the map attached as Exhibit A); and WHEREAS, pursuant to the requirements of said code, a public hearing has been held on the matter and the owner of the affected property was notified of said hearing at least ten (10) days prior to the date thereof. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That, pursuant to CVC Section 21107.8 (Private Parking Facilities), privately owned parking facilities located at 14100 Peach Hill Road, which are held open for public use, shall be subject to Sections 22350 (Basic Speed Law), 23103 (Reckless Driving), 23109 (Speed Contests), Division 16.5 (Off Highway Vehicles) and other applicable provisions of the California Vehicle Code. SECTION regulations appropriate 2. That the above traffic and parking shall take effect upon the placement of signs giving notice of said regulation. SECTION 3. That said signs shall be placed and maintained by the property owner and shall comply with the 000025 Resolution No. 2000 - Page 2 requirements set forth in Section 21107.8 (b) of the California Vehicle Code. SECTION 4. That this Resolution shall become effective upon the date of the first approval of the Occupancy Permit issued for Lot 4 of Tract 4974. SECTION S. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
