Subject: Consider Status of Lighting Issues and Determine If
Resolution is Complete at the Marketplace Properties
Commercial Center (Rite Aid /Kindercare)
BACKGROUND:
On December 10, 1999, a communication was provided to City Council
concerning the status of the exterior lighting (building and parking
lot) at the Rite Aid /Kindercare center at the northwest corner of
Tierra Rejada Road and Spring Road. The December 10 memorandum noted
that the project developer as of December 3, 1999, had completed
proposed modifications to the light fixtures including the
installation of opaque glass, louvers and cutoffs.
The December 10 memorandum also noted that this item would be placed
on this Council agenda to conclude if the developer had
satisfactorily resolved concerns relating to the brightness of the
lights and light migration beyond the project site. Surety remains
on deposit ($10,000 cash) for the purpose of resolving these
lighting concerns. Should Council conclude that this issue is
resolved with the latest developer modifications, the surety will be
released minus any outstanding processing and condition compliance
costs.
DISCUSSION•
On February 12, 1999, the Director of Community Development issued
a Conditional Certificate of Occupancy for the Rite Aid Drug Store
allowing that retail use to commence operation prior to completion
of several conditions of the City Council approving resolution. At
that time there was considerable attention focused upon the design
of the parking lot light bases because of their height and bulk.

This issue was subsequently resolved through the incorporation of
additional landscaping and a standard for light base design was
established through the recent adoption of the ordinance on lighting
standards. However, it became apparent during the early days of the
store operation, that the more important neighborhood and community
concerns related to the brightness of the parking lot and Rite Aid
building lights and the migration of the light beyond the project
property lines.
Following the receipt of a number of complaints concerning the
lighting characteristics the developer appeared before the City
Council on February 17, 1999, and provided an explanation to Council
concerning feasible options to correct the conditions. The City
Council established April 1, 1999, as the time frame for correction
and the developer agreed. Correction of the problem was approached
on a phased basis with the developer attempting to correct the most
offensive aspects of the lighting problem. Through the course of
this effort, staff and Council viewed several test conditions to
determine the effectiveness of the proposed solution which involved
the retrofit of the installed fixtures with louvers, cutoffs and
opaque glass. The louvers direct light downward at a 45 degree
angle, and the cutoffs are intended to block light horizontally. The
opaque glass removes the brightness and harsh rays of the metal
halide bulbs that were used in the fixtures.
Following the completion of several test areas and viewing by
Council and staff it was concluded that all of the fixtures would
require retrofit features to resolve the lighting issue to Council's
satisfaction. The developer subsequently agreed to apply
modifications to each fixture based upon its site location and
commenced that work. Progress has been slow because of delays in
receiving the necessary items from the manufacturer /supplier.
However, as noted earlier in this report as of December 3, 1999, all
exterior parking lot and Rite Aid building fixtures have been
retrofitted as follows:
1. All perimeter fixtures adjacent to Tierra Rejada Road and
Spring Road have all three modifications of: louvers, cutoffs
and opaque glass.

2. All interior poles /fixtures, including the poles /fixtures at
the westerly property line have louvers and opaque glass.
3. The Rite Aid building lights have cutoffs and opaque glass.
With the installation of the above noted modifications to the lights
at this commercial location the developer believes that the
Councils direction on this issue has been implemented and the
project should be considered as complete. Staff has observed the
site from several locations since the December 3 modifications and
it has been concluded that there is a considerable improvement in
the overall lighting solution and the most frequently criticized
characteristics have been corrected. It is not feasible to make
improvement beyond the current changes in site lighting with the
current lighting fixtures, unless the ballast is changed which would
allow lower wattage bulbs. During the course of previous discussions
between the developer and the City Council the developer stated that
the cost per pole (two fixtures) to replace the ballast was
approximately $1,500.00, and the developer was not willing to incur
that expense. Additionally, based upon the amount of light that
currently reaches ground level a reduction in bulb wattage that
could be implemented with the ballast change would likely reduce the
light factor, therefore, is not viewed as a feasible solution. If
the City Council concurs that the lighting characteristics of this
site have been satisfied, this project may be viewed as complete and
the remaining surety to guarantee project completion may be released
as appropriate.
STAFF RECOMMENDATION:
That City Council concur that the modified lighting satisfies the
conditions of approval.
